A RESOLUTION SUPPORTING ASSEMBLY BILL 1035, A
BILL DECLARING THE INTENT OF THE LEGISLATURE TO
ENACT CIVIL FORFEITURE PROVISIONS APPLICABLE IN
CASES OF OBSCENITY OR CHILD PORNOGRAPHY THAT
ARE CONSISTENT WITH AND IDENTICAL TO THE CIVIL
FORFEITURE PROVISIONS RELATING TO OBSCENITY OR
CHILD PORNOGRAPHY UNDER FEDERAL LAW.
WHEREAS, child pornography and exploitation activities are counter to the good
health and quality of life of the community; and
WHEREAS, under existing law, upon conviction of a criminal profiteering activity,
including child pornography or exploitation, obscene or harmful matter, property interest
acquired through the activity is subject to forfeiture upon proof that the defendant engaged
in the activity and that the property interest or proceeds are forfeitable; and
WHEREAS, AB 1035 declares the intent of the Legislature to enact civil forfeiture
provisions applicable in cases of obscenity or child pornography that are consistent with
and identical to the civil forfeiture provisions relating to obscenity or child pornography
under federal law; and
WHEREAS, the City of Bakersfield supports efforts to reduce child pornography
and/or exploitation.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
BAKERSFIELD AS FOLLOWS:
1. The City Council of the City of Bakersfield wholeheartedly supports AB 1035
relating to civil penalties against child pornographers and exploiters.
2. The City Council directs staff to forward this resolution to Bakersfield's State
Legislators and the Governor of the State of California.

I HEREBY CERTIFY that the foregoing Resolution was passed and adopted by the
Council of the City of Bakersfield at a regular meeting thereof held on MAY 26 1999 ,
