HomeMy WebLinkAboutRES NO 085-2023RESOLUTION NO. 0 8 5- 2 0 2 3 A RESOLUTION OF THE CITY OF BAKERSFIELD APPROVING THE APPLICATION FOR GRANT FUNDS FOR THE ORGANIZED RETAIL THEFT PREVENTION GRANT PROGRAM. WHEREAS, the Legislature and Governor of the State of California have provided funds for the Organized Retail Theft Prevention Grant Program through the State Budget Act; and WHEREAS, the Board of State and Community Corrections (BSCC) has been delegated the responsibility for the administration of this grant program, establishing necessary procedures; and WHEREAS, said procedures established by the BSCC require a resolution certifying the approval of application(s) by the applicant's governing body before submission of said application(s) to the State; and WHEREAS, the City of Bakersfield, through the Bakersfield Police Department, desires to participate in the Organized Retail Theft Prevention Grant Program funded through the State Budget Act and administered by the BSCC; and WHEREAS, the City, if selected, will enter into an agreement with the State of California to receive the grant funding and carry out the project in furtherance of the Organized Retail Theft Prevention Grant Program; and WHEREAS, the City Council of the City of Bakersfield therefore approves, via this Resolution, submission of the application to the State and authorizes the City Manager or designee to execute all documents necessary to apply for and participate in the Organized Retail Theft Prevention Grant Program. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Bakersfield, as follows: 1. The above recitals are true and correct and incorporated herein. 2. The City Manager or Chief of Police, or their designees, are authorized to submit the grant proposal for funding through the Organized Retail Theft Prevention Grant Program, and to sign a Grant Agreement with the BSCC, including any amendments thereto. Grant funds received by the City and/or Bakersfield Police Department as a result of this Resolution and participation in the Grant Program shall not be used to supplant expenditures controlled by the City Council, nor shall it control future legislative authority of the Council. 4. The City of Bakersfield agrees to abide by the terms and conditions of the Grant Agreement as set forth by the BSCC.
