A RESOLUTION ADOPTING THE GOSFORD
ROAD PLANNED SEWER AREA AND MAKING
FINDINGS RELATIVE THERETO.
WHEREAS, the City Council by Resolution of Intention No. 2169, adopted
June 14, 2023, in the Council chambers in the City Hall, 1501 Truxtun Avenue,
Bakersfield, California, identified the amended fee schedule and boundary of
the Gosford Road Planned Sewer Area; and
WHEREAS, Chapter 16.32.060.E of Title 16 of the Bakersfield Municipal Code
and Section 66483 of the California Government Code, provides for a
procedure by which the City Council may assess and collect fees for the
purpose of defraying the cost of constructing sewer facilities for local and
neighborhood sewer areas, and;
WHEREAS, The City of Bakersfield desires to provide sewer facilities for a
rapidly developing area as shown on the map entitled "Gosford Road Planned
Sewer Area" attached hereto as Exhibit "A", and incorporated by reference,
and;
WHEREAS, the parcels within the "Gosford Road Planned Sewer Area" will
receive a benefit from the sewer system shown in Exhibit "A".
WHEREAS, the developer of Tract 6859 will construct a portion of the sewer
system shown in Exhibit "A";
WHEREAS, the remaining parcels shall construct the sewer system along
their parcel frontage and/or fund their proportionate fair share of the sewer
system shown in Exhibit "A";
WHEREAS, the City desires to recoup the cost of constructing said sewer
line;
WHEREAS, the City has notified all affected property owners and is
proposing the formation of the Gosford Road Planned Sewer Area to reimburse
the cost of the improvements upon subdivision or development of property.
within the Gosford Road Planned Sewer Area; and
WHEREAS, the fees and charges set forth in Exhibits "B" and "C" attached
hereto and incorporated by reference, are based on the actual cost of
providing the services for which the fees are charged.
WHEREAS, parcels which construct more than their proportionate fair share,eaK,4-,'
of the sewer system shown in Exhibit "A" shall be reimbursed through cred@ %�

towards sewer fees of the corresponding project or fees collected as shown on
Exhibit "C."
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield
as follows:
1. The foregoing recitals are true and correct and are incorporated
herein.
2. The Council hereby finds that, as to the Gosford Road sewer, as
described in the fee schedules attached hereto and incorporated herein by
reference, subdivision and development of property within such area will benefit
from the construction of said sewer facilities, and that the fees provided are
fairly apportioned either on the basis of benefits conferred on property for
subdivision or on the need for such facilities created by the proposedsubdivision
and development of other property within such area.
3. The Gosford Road Planned Sewer Area is hereby adopted.
HEREBY CERTIFY that the foregoing Resolution was passed and adopted
by the Council of the City of Bakersfield at a regular meeting thereof held on
