AN ORDINANCE AMENDING SECTION 17.08.125 OF
TITLE 17 OF THE BAKERSFIELD MUNICIPAL CODE
RELATING TO I SETBACK EXCEPTIONS FROM
STREETS.
BE IT ORDAINED by the City of Bakersfield as follows:
Section 1.
Section 17.08.125 of Title 17 of the Bakersfield Municipal Code is hereby
amended to read as follows:
17.08.125 Street Setback Excgption - Front and Side Yard
Where more than fifty percent (50%) of the linear frontage along the same
side of a street within the same block contains existing buildings having setbacks from
the street less than the required minimum specified by the zone district in which the
buildings are located, any new building may be setback a distance equal to the average
setback of the existing buildings. However, in no instances, shall any building be
required to be located more than the minimum setback specified by the zone district.
Section 2.
This ordinance Shall be posted in accordance with the Bakersfield
Municipal Code and shall become effective not less than thirty (30) days from and after
the date of its passage.
