AN ORDINANCE AMENDING CHAPTER 15.40
SUBSECTION A OF 15.41.020 AND SUBSECTION
A OF 15.41.030 OF THE BAKERSFIELD MUNICIPAL
CODE RELATING TO UNREINFORCED MASONRY BUILDINGS.
BE IT ORDAINED by the Council of the City of Bakersfield as
follows:
SECTION 1.
Chapter 15.40 of the Bakersfield Municipal Code is deleted
in its entirety and hereby amended to read as follows:

SEISMIC STRENGTHENING PROVISIONS FOR UNREINFORCED MASONRY
BEARING WALL BUILDINGS.
Note: This chapter has been revised in its entirety.

Purpose.
Modifications.
Section A102(a) - General.
15.40.010 PurDose.
The purpose of this chapter is to implement the
provisions of Appendix Chapter 1, of the Uniform Code for Building
Conservation, 1991 Edition, sponsored and copyrighted by the
International Conference of Building Officials, a copy of which is
filed in the Building Department of the City for use and
examination by the public, and each portion and provision thereof,
as they exist at the time of the adoption, and as amended in this
chapter. The intent of this chapter is to provide a reference for
regulating seismic strengthening provisions for unreinforced
masonry bearing wall buildings.

15.40.020 Nodifications.
The section of Appendix Chapter 1 of the Uniform Code
for Building Conservation, 1991 Edition, mentioned in Section
15.40.030 of this chapter, as adopted by reference, is amended as
provided in Section 15.40.030 of this chapter.
15.40.030 Section A102(a) - General.
Section A102(a), EXCEPTION is amended to read as
follows:
EXCEPTIONS: This chapter shall not apply to detached
one or two family dwellings and detached multi-unit dwellings
containing less than five (5) dwelling units and used solely for
residential purposes, nor shall it apply to single story warehouse
buildings used solely for storage purposes and occupied less than
three (3) hours per day.
SECTION 2.
Chapter 15.41 of the Bakersfield Municipal Code is amended
to read as follows:

Seismic safety analysis.
Enforcement - Appeal
15.41.020 Seismic Safety Analysis
Paragraph (A) under Seismic safety analysis is amended
to read as follows:
A. Each owner, as shown on the latest equalized
assessment roll of the County of Kern, of an unreinforced masonry
building constructed prior to 1946 shall complete and submit to the
City Building Director a seismic safety analysis of their building
on or before December 31, 1993.
15.41.030 Enforcement - ADDeal
Paragraph (A) under Enforcement - Appeal is amended to
read as follows:
A. Whenever the Building Director finds that any
building subject to the provisions of this chapter has not been
analyzed as required by this chapter after December 31, 1993
referred in Section 15.41.020, he shall commence proceedings to
cause the analysis of such building.
SECTION 3.
This ordinance shall be posted in accordance with the
City Charter provisions and shall become effective thirty (30) days
from and after the date of its passage.
