HomeMy WebLinkAboutRES NO 64-99RESOLUTION NO. 6 zt ' 9 iB A RESOLUTION OF THE CITY OF BAKERSFIELD ELECTING TO RECEIVE ALLOCATION OF TAXES PURSUANT TO THE PROVISIONS OF THE COMMUNITY REDEVELOPMENT LAW WHEREAS, the Bakersfield Central District Development Agency ("Agency") is engaged in activities necessary or appropriate to carry out the California Community Redevelopment Law (Health & Safety Code Sections 33000, et seq.) within the City of Bakersfield; and WHEREAS, pursuant to Section 33330 of the Community Redevelopment Law, the Agency has prepared a proposed Redevelopment Plan for the Old Town Kern - Pioneer Redevelopment Project in the City of Bakersfield; and WHEREAS, pursuant to Section 33670 of the Community Redevelopment Law, the Redevelopment Plan for the Old Town Kern - Pioneer Redevelopment Project contains a provision for the allocation of taxes; and WHEREAS, pursuant to Section 33676 of the Community Redevelopment Law, an "affected taxing agency" may elect to be allocated, in addition to the portion of taxes allocated pursuant to subdivision (a) of Section 33670, all or any portion of tax revenues allocated to a redevelopment agency pursuant to subdivision (b) of Section 33670 attributable to increases in the rate of tax imposed for the benefit of the taxing agency which levy occurs after the tax year in which the ordinance adopting the redevelopment plan becomes effective; and WHEREAS, the City of Bakersfield is an "affected taxing agency" as defined in Section 33353.2 of the Community Redevelopment Law; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Bakersfield as follows: Section 1: The City Council of the City of Bakersfield hereby finds and determines that the recitals contained hereinabove are true and correct. Section 2: The City of Bakersfield, as an affected taxing agency, does hereby elect to receive, in addition to that portion of taxes allocated to the City pursuant to subdivision (a) of Section 33670 and subdivisions (a) and (b) of Section 33607.5, all that portion of the tax revenues allocated to the Agency pursuant to subdivision (b) of Section 33670 attributable to increases in the rate of tax imposed for the benefit of the taxing agency which levy occurs after the tax year in which the ordinance adopting the redevelopment plan becomes effective. The City Clerk is hereby authorized and directed to filed copies of this Resolution with the Agency, the Auditor-Controller of the County of Kern, and the Tax Collector of the County of Kern. Section 4.
