Types:l A RESOLUTION ORDERING THE VACATION OF EYE STREET BETWEEN 14TM STREET AND THE BURLINGTON NORTHERN SANTA FE RAILWAY IN THE CITY OF BAKERSFIELD. WHEREAS, on WEDNESDAY, APRIL 14, 1999, the Council of the City of Bakersfield, pursuant to the provisions of the "Public Streets, Highways and Service Easements Vacation Law," Government Code Sections 8300 et seq. of the Streets and Highways Code of the State of California, passed and adopted Resolution of Intention No. 1193 declaring its intention to order the vacation of Eye Street between 14th Street and the Burlington Northern Santa Fe Railway in the City of Bakersfield; and WHEREAS, the Council did fix a time and place for hearing all persons interested in or objecting to said proposed vacation, which hearing was held on Wednesday, May 12, 1999, after notices of said hearing were duly published and posted as required by law. WHEREAS, for the above-described project, it was determined that the proposed vacation is exempt from CEQA, pursuant to Section 15305 of CEQA Guidelines as a minor deposition of existing public right of way and a minor alteration in land use limitation; and WHEREAS, at its meeting on November 19, 1998, the proposed vacation was duly heard and considered by the Planning Commission and was found to be consistent with the Metropolitan Bakersfield General Plan; and NOW, THEREFORE BE IT RESOLVED by the Council of the City of Bakersfield as follows: 1. The above recitals are true and correct and are incorporated herein. Page 1 of 3 Pages All of the public street right of way for Eye Street, being 82.5 feet in width, lying between blocks 354 and 355 and bounded Northerly and Southerly by prolongations of the North and South Lines of said blocks, as said street and blocks are shown on "Map of the City of Bakersfield" filed for record November 25, 1898 in Book I of Maps, Pages 13 and 14, in the office of the Kern County Recorder, is unnecessary for present or prospective use for I HEREBY CERTIFY that the foregoing Resolution was passed and adopted by the City Council of the ~ity of Bakersfield at a regular meeting thereof held on MAY 1 g 199 , by the following vote: AYES: NOES: ABSTAIN: ABSENT: COUNCILMEMBER CA SON, DEMOND.
