PUBLIC STATEMENTS a. Agenda Item Public Statements Michael Turnipseed spoke regarding agenda item 3.a., requesting legible materials. b. Non -Agenda Item Public Statements Emmet McCormick, Ron Nelms (written material provided), Russell Johnson, Nick Hills, Derek Sprague, and Michael Turnipseed (written material provided) spoke regarding the Climate Action Plan. 3. REPORTS a. City Council Priority Initiatives - Fiscal Year 2023-24 Work Plan (Staff recommends the City Council review and discuss the Fiscal Year 2023-24 Work Plan in support of Council Priority Initiatives and provide feedback and direction. Staff recommends the Council receive and file the Fiscal Year 2023-24 Work Plan.) City Clerk Drimakis announced a staff memorandum was received transmitting the workplan. City Manager Clegg made staff comments and provided a PowerPoint Presentation. Motion by Vice Mayor Gonzales to receive and file the workplan. Motion unanimously approved. 4. Proclamation to Pryscyla Russell and Gigi the Warrior, declaring Childhood Cancer Awareness Month in Bakersfield during September 2023. 5. PUBLIC STATEMENTS a. Agenda Item Public Statements None. b. Non -Agenda Item Public Statements 1. Tracy Dominguez spoke regarding an invitation to the Medical Board of California in -person meeting, August 24, 2023, regarding medical negligence. 2. Marylee Shrider and Penny Martinez, Bakersfield Republican Women Federated, spoke regarding sponsoring Christmas wreaths to honor a veteran's grave (written material provided). 3. Eddy Laine and Antje Lauer, Sierra Club spoke regarding city water issues. (written material provided). Councilmember Arias and Kaur requested an opportunity to meet with County staff with the members of the Board of Supervisors to discuss water issues. 4. Yvette Ward spoke regarding chain link fencing, noise, and other concerns in front of her home, 2200 Roosevelt. Vice Mayor Gonzales requested staff work with Caltrans to discuss alternative solutions such as construction of a decorative wall for the neighborhood located at Roosevelt adjacent to Hwy 58 (south of Brundage Ln), east of Hughes Ln to address concerns with noise, cracks in foundation, etc. He requested staff reach out to Ms. Ward to gather additional details regarding her concerns. 4474 Bakersfield, California, August 23, 2023 - Page 3 5. PUBLIC STATEMENTS continued 5. Ocie Crawford spoke regarding True Love Tribe and expressed his appreciation to Mayor and Councilmembers for attending the events. 6. APPOINTMENTS a. League of California Cities (CalCities) Annual Conference appointment of voting delegate(s). (City staff recommends the City Council appoint a voting delegate and alternate delegate(s).) Motion by Vice Mayor Gonzales to nominate Councilmember Kaur as the voting delegate, and Councilmember Arias as the alternate delegate. Motion unanimously approved. b. One appointment (Ward 1 Alternate Member) to Youth Commission to complete an unexpired term expiring July 2024. (Staff recommends Council determination.) City Clerk Drimakis announced one application was received from Raquel Robledo. Councilmember Arias, Ward 1, nominated Raquel Robledo, alternate member. Motion by Vice Mayor Gonzales to appoint Raquel Robledo, as the Alternate member for Ward 1 to the youth Commission, term to expire July 31, 2024. Motion unanimously approved. 7. CONSENT CALENDAR (Staff recommends adoption of Consent Calendar items.) Minutes: a. Approval of minutes of the August 9, 2023, Regular City Council Meeting. Payments: b. Receive and file department payments from July 28, 2023, to August 10, 2023, in the amount of $14,678,241.82 and Self -Insurance payments from July 28, 2023, to August 10, 2023, in the amount of $2,197,125.71, totaling $16,875,367.53. Ordinances: C. First Reading of the following ordinances amending various sections of the Bakersfield Municipal Code: FR ONLY l . Repealing Section 2.84.610 relating to employee leave of absences due to a death in the family. 2. Amending Section 3.20.125 relating to sale of surplus real property. 3. First reading of ordinance amending Bakersfield Municipal Code Section 17.06.020 by changing the official zoning map from A (Agriculture) to M-2 (General Manufacturing) to facilitate consistency with the existing General Plan designation. FR ONLY e. Adoption of an ordinance amending Bakersfield Municipal Code Section 1.12.030 by adding Annexation No. 708 consisting of 4.21 gross acres to Ward 3, located along the south side of Rosedale Highway, generally between Parker Lane and Gibson Street. (FR 08/09/23) ORD 5130 Resolutions: Resolution approving an application to the Kern County Local Agency Formation Commission to annex inhabited territory into the City identified as Annexation No. 714 (Snow No. 17) located on the northwest corner of Snow Road and Calloway Drive. Resolution approving an application to the Kern County Local Agency Formation Commission to annex inhabited and uninhabited territories into the City identified as Annexation No. 721 (Centennial No. 1) generally located along Highway 99 between Terrell Court and Madrid Avenue, north and east terminus of Elicia Drive, and south of Stockdale Highway between Stine Road and south Real Road. RES 125-2023 h. Dispense with Bidding for the purchase of four (4) front loader trucks for the Solid Waste Division: Resolution determining that front loader trucks can most efficiently be obtained through cooperative procurement bidding procedures from E.M. Tharp Inc., dba Golden State Peterbilt and authorizing the Finance Director to dispense with bidding thereof, not to exceed $2,202,300. Authorize the creation of the new SR99 and SR58 Interchange Project and transfer $450,000 from savings inherited from Project TRB118 ($294,000) and Project TRCC17 ($156,000) to the new project. 2. Approve agreement with Parsons Transportation Group (not to exceed $419,872.89) for the preparation of project report and environmental support for the southbound to westbound connector at SR58/SR99 Interchange. AGR 2023-208 r. Agreements to provide TCP analytical services for the Water Resources Department: Agreement with Fruit Growers Laboratory, Inc., (not to exceed $350,000 for a one-year term). AGR 2023-209 2. Agreement with BSK Associates, Inc., (not to exceed $150,000 for a one-year term). AGR 2023-210 Amendment No. 5 to Agreement No. 2020-004 with Central Square Inc. Agreement with Bakersfield Rescue Mission, DBA The Mission at Kern County (not to exceed $192,000) for the purchase of real property located at 800 Baker Street. AGR 2023-212 Z. Amendment No. 1 to Agreement No. 2023-100 with Bowman Asphalt, Inc., for earthmoving and equipment, to add the construction of traffic calming elements to the scope of work. REMOVED FOR SEPARATE CONSIDERATION. See Page 7. City Clerk Drimakis announced a staff memorandum was received for item 7.h. transmitting correction to administrative report background and 7.z correcting the subject title. Councilmember Smith requested item 7.f., be removed for separate consideration. Councilmember Weir requested item 7.z., be removed for separate consideration. Motion by Vice Mayor Gonzales to adopt Consent Calendar items 7.a. through 7.z., with the removal of item 7.f. and 7.z., for separate consideration. Motion unanimously approved. f. Resolution approving an application to the Kern County Local Agency Formation Commission to annex inhabited territory into the City identified as Annexation No. 714 (Snow No. 17) located on the northwest corner of Snow Road and Calloway Drive. Notice of Exemption on file. RES 124-2023 Councilmember Smith requested staff follow up and provided a letter to the developer and LAFCO regarding annexation No. 714 to ensure that the property currently under development of County of Kern remains so until completion. 4 479 Bakersfield, California, August 23, 2023 - Page 8 7. AGR 2022-237 (1) Motion by Vice Mayor Gonzales to adopt Consent Calendar item 7.z. Motion approved with Councilmember Weir voting no. 8. CONSENT CALENDAR PUBLIC HEARINGS (Staff recommends conducting Consent Calendar Public Hearing and approval of items.) None. 9. HEARINGS a. Public Hearing to consider amended and restated Resolution No. 168-08(1) to confirm participation in the Statewide Community Infrastructure Program (SCIP). (Staff recommends adoption of the resolution.) RES 168-08 (1) City Manager Clegg made staff comments. Hearing item 9.a. opened at 6:22 p.m. No one spoke in opposition or support. NEW BUSINESS None. 13. COUNCIL AND MAYOR STATEMENTS Vice Mayor Gonzales requested the Planning and Development Committee discuss the Downtown Housing Capacity Strategy. COUNCIL AND MAYOR STATEMENTS continued Councilmember Arias requested the Housing and Homelessness Committee research alternative preventative strategies to assist individuals who are at risk or are becoming homeless. Vice Mayor Gonzales requested an update on the construction of the Jefferson Park restrooms. Vice Mayor Gonzales expressed his appreciation to the Public Works Streets Division for their hard work due to the storm. Mayor Goh announced a large award of $7 million from the State for the assistance to address our homeless housing, mental health, and substance use crisis, this encampment resolution funding will move homeless persons off our streets and highways into housing with supportive services. Councilmember Freeman asked if the City could resolve the water issue with Kern River Golf Course. Vice Mayor Gonzales requested the City Attorney schedule the Kern County Golf Course water usage at a future closed session. 14.
