I '1 AN ORDINANCE OF THE BAKERSFIELD CITY COUNCIL APPROVING AN AMENDMENT TO TITLE 17 OF THE BAKERSFIELD MUNICIPAL CODE TO CHANGE THE PREZONE CLASSIFICATION FROM A (AGRICULTURE), C-2 (REGIONAL COMMERCIAL), R-S-20A (RESIDENTIAL SUBURBAN 20 ACRE MINIMUM), R-S-SA (RESIDENTIAL SUBURBAN 5 ACRE MINIMUM) AND R- 5-2.5A (RESIDENTIAL SUBURBAN 2.5 ACRE MINIMUM) TO C-2 (REGIONAL COMMERCIAL), R-1 (ONE FAMILY DWELLING), R-2 (LIMITED MULTIPLE FAMILY DWELLING), R-3 (MULTIPLE FAMILY DWELLING), R-4 (HIGH DENSITY MULTIPLE FAMILY DWELLING) AND R-5 (VERY HIGH DENSITY RESIDENTIAL) LOCATED GENERALLY ON TAFT HIGHWAY AND GOSFORD ROAD IN THE METROPOLITAN BAKERSFIELD AREA WITHIN THE CITY OF BAKERSFIELD'S SPHERE OF INFLUENCE (GPA/ZC NO. 23-0244) WHEREAS, the City of Bakersfield filed an application requesting an amendment to official zoning map in Title 17 of the Bakersfield Municipal Code by changing the prezone classification from A, C-2, R-S-20A, R-S-SA and R-S-2.5A to C-2, R-1, R-2, R-3, R-4 and R-5, located generally on Taft Highway and Gosford Road in the metropolitan Bakersfield area within the City of Bakersfield's Sphere of Influence (the "Project"); and WHEREAS, the Planning Commission held a public hearing on August 17, 2023, and approved Resolution No. 63-23, which recommended that the City Council approve the Project; and WHEREAS, the City Council held a public hearing on September 13, 2023 at which time a related General Plan Amendment was approved for the Project; and WHEREAS, the City Council considered all facts, testimony, and evidence concerning the Project, including the staff report, and the Planning Commission's deliberation, and action; and WHEREAS, the Project is consistent with the Metropolitan Bakersfield General Plan. SECTION 1. NOW, THEREFORE, BE IT ORDAINED by the Bakersfield City Council as follows: 1. The above recitals, incorporated herein, are true and correct. 2. The Planning Commission's findings as contained in its Resolution No. 63-23 are hereby adopted. 3. The Project is hereby approved incorporating the change into the official zoning map as described in Bakersfield Municipal Code Section 17.06.020 and located on the map as shown in Exhibit A, all of which are incorporated herein.
