SITE CHARACTERISTICS: The proposed project site is enclosed within a chain-link fence and utilized for truck parking and storage without land use approvals. Surrounding properties are primarily developed as: north – truck storage yard (unpermitted); east – single-family residential (Kern County jurisdiction); south – truck repair/overhaul shop, church, and vacant land; west – commercial and industrial. SPR 21-0173 Page 2 BACKGROUND AND TIMELINE: • October 21, 1987 – City Council approved the pre-zoning of the property site to M-2 (General Manufacturing) as part of a larger area (Ordinance No. 3123). • May 18, 1988 – Project site was annexed to the City of Bakersfield as a portion of the greater annexation of 364.45 acres of land (Oswell No. 6; Annexation 317). PROJECT ANALYSIS: Site Plan Approval Required. Pursuant to Bakersfield Municipal Code Section 17.08.060, no person shall construct any improvements on land which require a building permit without first obtaining site plan approval. Site Plan Approval Process. Pursuant to Bakersfield Municipal Code Section 17.08.080 the application for site plan approval is reviewed by the Site Plan Review Committee (Committee) which is established and consists of the Planning Director, Building Director, Fire Chief, and Public Works Director, or their designated representatives. The site plans are reviewed by the following City Departments: • Development Services Department/Building Division • Development Services Department/Planning Division • Fire Department • Water Resources • Public Works Department/Engineering Division • Public Works Department/Traffic Division • Public Works Department/Solid Waste Division • Recreation and Parks Department (as needed) • Bakersfield Police Department (as needed) The Committee reviews and provides comments to the Planning Director who, in turn, shall conduct an environmental review pursuant to the California Environmental Quality Act (CEQA) implementation guidelines and state law to determine if the project is subject to CEQA. After considering the recommendations from the Committee and the Planning Director, and after approving any necessary CEQA documents, the Development Services Director may approve, conditionally approve, or deny the site plan. Site Plan Review Project Description (SPR No. 21-0173). The proposed development would entail the construction of a 14,300-square-foot maintenance facility with accompanying office spaces, as well as an attached 4,000-square-foot canopy and associated parking and landscaping. The remainder of the site would be paved for truck storage and driving aisles. Ingress and egress into the site will be from Quantico Avenue. The truck repair/overhaul facility would be staffed with approximately ten (10) employees, operating Monday through Saturday from 7:00 AM to 6:00 PM. Approximately fifteen (15) trucks, with or without trailers, will be at this facility on any given day. This includes approximately ten (10) trucks entering and exiting, with approximately five (5) trucks being parked at the facility for up to one (1) week. The truck storage yard would accommodate up to forty (40) trucks, with overnight storage being limited to thirty (30) trucks. No deviations from zoning ordinance standards have been requested by the applicant. The Committee completed its review of Site Plan Review No. 21-0173 and as proposed, the project complies with the City of Bakersfield’s development standards. SPR 21-0173 Page 3 ENVIRONMENTAL REVIEW AND DETERMINATION: In accordance with the California Environmental Quality Act (CEQA), staff has reviewed the project for potential environmental impacts. An Initial Study was prepared and based on the following project- specific analysis and technical studies: Cultural Resources Assessment for the Quantico Avenue Development Project, Air Quality (AQ) and Greenhouse Hass (GHG) Analyses Letter Report, Noise Impact Analyses Letter Report, Vehicle Miles Travelled (VMT) Analyses Letter Report, and Biological Resources Study. The Initial Study determined that compliance with the recommended mitigation measures, local ordinances, state laws, and construction to the standards of the Uniform Building Codes, project impacts will be reduced to a less than significant level. Therefore, a Mitigated Negative Declaration (MND) for the project was prepared in accordance with CEQA. The MND was circulated for a 31-day public and agency review period starting September 15, 2023, through October 16, 2023 (SCH No. 2023090353). Environmental Conclusion. The State CEQA Guidelines and the City of Bakersfield’s CEQA Implementation Procedures have been followed in the evaluation of the environmental effects of this project. PUBLIC NOTIFICATION: Public notice for the proposed project and environmental determination was advertised in The Bakersfield Californian and posted on the bulletin board in the City of Bakersfield Development Services Building, 1715 Chester Avenue, Bakersfield, California. All property owners within 300 feet of the project site were notified by United States Postal Service mail regarding this public hearing in accordance with city ordinance and state law. Signs are required as part of the public notification process and must be posted between 20 to 60 days before the public hearing date. Photographs of the posted signage and the Declaration of Posting Public Hearing Notice signed by the applicant are on file at the Planning Division. Comments Received. As of this writing, no written comments have been received. CONCLUSIONS: Consideration. Prior to project approval, your Commission shall consider the proposed MND with any comments received during the review process. Your Commission can adopt the MND if it finds that based on the Initial Study, and comments received, there is no substantial evidence of potential significant effects on the environment. Recommendation. Staff finds that the applicable provisions of CEQA have been complied with and that the project would not result in any significant environmental impacts. Additionally, as conditioned, the project will be developed in compliance with the applicable regulations. Based on the foregoing, staff concludes that the request sufficiently demonstrates compliance with the necessary findings. Therefore, staff recommends your Commission adopt the Resolution ADOPTING the Mitigated Negative Declaration, pursuant to Section 15074 of the California Environmental Quality Act, for Site Plan Review No. 21-0173 as depicted in the project description, and subject to the listed mitigation measures. The proposal meets the minimum required codes, policies, and standards for development as adopted by the Bakersfield City Council. Your next step is to either apply for necessary building permits to construct your project or begin your business activities depending on the request submitted. You must submit the final building plans to the Building Division. Conditions of Approval for the project are attached to this decision letter. Please read them carefully. Failure to satisfy an item may delay obtaining a building permit or commencing your project. After the construction of your project but before the City of Bakersfield can allow occupancy, the Building Division must inspect the development to find if it complies with the approved plans, and any other relevant permits and codes. If you have satisfied all the requirements, the Building Director will issue a certificate of occupancy; if not, the area inspector will give you a correction notice. Once you have made all the corrections, the Building Director can issue a certificate of occupancy. You may not occupy a development until the Building Director has issued a certificate of occupancy. ENVIRONMENTAL DETERMINATION In reviewing the project for compliance with the California Environmental Quality Act (CEQA), staff determined it was not eligible for either a statutory or categorical exemption. In accordance with CEQA, staff has reviewed the potential environmental impacts of the project during the preparation of an initial study. The initial study was based on the following project-specific analysis and technical studies provided by SOAR Environmental Consulting: Cultural Resources Assessment for the Quantico Avenue Development Project, Air Quality (AQ) and Greenhouse Hass (GHG) Analyses Letter Report, Noise Impact Analyses Letter Report, Vehicle Miles Travelled (VMT) Analyses Letter Report, and Biological Resources Study. SPR 21-0173 Page | 2 of 12 The initial study determined that compliance with the recommended mitigation measures, local ordinances, state laws, and construction to the standards of the Uniform Building Codes will reduce impacts to a less than significant level. Therefore, the Mitigated Negative Declaration (MND) for Site Plan Review No. 21-0173 was prepared in accordance with CEQA. The MND was circulated for a 31-day public and agency review period starting September 15, 2023, through October 16, 2023 (SCH No. 2023090353). Environmental Conclusion. The State CEQA Guidelines and the City of Bakersfield’s CEQA Implementation Procedures have been followed in the evaluation of the environmental effects of this project. With mitigation, significant environmental impacts were not identified for the proposed project. APPEAL Any person may appeal this decision. An appeal is limited to whether or not an adopted development standard, zoning regulation, mitigation, or policy applied or not applied to the project, was consistent with the authority granted by city ordinances or the California Environmental Quality Act (CEQA). The appeal must be in writing stating the precise basis or issue as noted, must include the appropriate filing fee, and must be filed within 10 days of the decision date to the City of Bakersfield Planning Commission (c/o Bakersfield Planning Director, 1715 Chester Avenue, Bakersfield, CA 93301). The Planning Commission will hold a public hearing on the appeal and their decision will be final unless their decision is appealed to the City Council. Site plan approval is based on the statements made in the application and the plans you submitted. Any errors or omissions on these plans could alter the compliance list and/or void this decision. If you have questions about any of the items noted in the Site Plan Compliance List, you must speak to the contact person representing the department requiring that item. Correspondence will continue to be sent to the applicant on record. Should the applicant change, it is the property owner’s responsibility to update the contact information with the Planning Division. These include conditions based on adopted City of Bakersfield plans and policies, those determined through site plan review, those determined through environmental review essential to mitigate adverse effects on the environment including the health, safety, and welfare of the community, and recommended conditions for development that are not essential to health, safety, and welfare, but would on the whole enhance the project and its relationship to the neighborhood and environment. The following conditions include specific items that you need to resolve before you can obtain a building permit or be allowed occupancy. In addition, there are informational items included to alert you to specific fees and/or requirements moving through the development permitting process. REVISIONS TO THE APPROVED PLAN Any time after site plan approval but before the approval expires, you may submit revisions to the plan. We will treat these revisions as a new site plan application subject to a new review and required fees. The Planning Director can only approve minor changes to the original plan without a new application if they are necessary to meet a condition, mitigation, or result from physical obstacles or other comparable constraints (See Section 17.08.080.C.3 of the Zoning Ordinance). Site plan approval is based on the statements made in the application and the plans you submitted. Any errors or omissions on these plans could alter the compliance list and/or void this decision. If you have questions about any of the items noted in the Conditions of Approval, you must speak to the contact person representing the department requiring that item. For conditions that require compliance prior to a building permit, or other permit issuance, provide the appropriate documentation as evidence of compliance with your building permit submittal. SPR 21-0173 Page | 4 of 12 MITIGATION MEASURES AND CONDITIONS OF APPROVAL FOR SITE PLAN REVIEW NO. 21-0173 GENERAL CONDITIONS 1. In consideration by the City of Bakersfield for land use entitlements, including but not limited to related environmental approvals related to or arising from this project, the applicant, and/or property owner and/or subdivider ("Applicant" herein) agrees to indemnify, defend, and hold harmless the City of Bakersfield, its officers, agents, employees, departments, commissioners and boards ("City" herein) against any and all liability, claims, actions, causes of action or demands whatsoever against them, or any of them, before administrative or judicial tribunals of any kind whatsoever, in any way arising from, the terms and provisions of this application, including without limitation any CEQA approval or any related development approvals or conditions whether imposed by the City, or not, except for CITY’s sole active negligence or willful misconduct. This indemnification condition does not prevent the Applicant from challenging any decision by the City related to this project and the obligations of this condition apply regardless of whether any other permits or entitlements are issued. The City will promptly notify the Applicant of any such claim, action, or proceeding, falling under this condition within thirty (30) days of receiving such claim. The City, in its sole discretion, shall be allowed to choose the attorney or outside law firm to defend the City at the sole cost and expense of the Applicant and the City is not obligated to use any law firm or attorney chosen by another entity or party. 2. Project approval is conditioned upon acceptance of the conditions of approval contained herein, as evidenced by the applicant’s signature on the Acknowledgement and Acceptance portion of the Conditions of Approval. 3. This site plan expires 2 years from the decision date, unless building permits have been issued, or where the use has commenced on projects not requiring a building permit. The project must be completed within 5 years of the decision date. If the property is rezoned, site plan approval will expire upon the effective date for the rezoning unless the use is permitted in the new zone. The Planning Director may extend the expiration date up to one (1) year if you resubmit new plans to check against the code requirements in effect at that time and include a written request for the extension. We must receive this request before the expiration of the project approval. We will not require a fee for this extension request; however, changes to the plans originally approved for purposes other than code requirements shall be subject to a new site plan review, including payment of all required fees (See Section 17.08.080.D of the Zoning Ordinance). It shall be the responsibility of the property owner, operator, and/or management to ensure that any required permits, inspections, and approvals from any regulatory agency be obtained from the applicable agency prior to issuance of a building permit and/or the issuance of a certificate of occupancy. I. The following mitigations shall be satisfied as part of the approval of this project: AIR QUALITY IMPACT MITIGATION MEASURES 1. Prior to grading plan approval, the applicant/developer shall submit documentation to the Planning Division that they are compliant with air quality control measures and rules required by the San Joaquin Valley Air Pollution Control District. 2. Prior to grading plan approval, the applicant/developer shall submit proof to the Planning Division that they have complied with the San Joaquin Valley Air Pollution Control District’s Indirect Source Rule (Rule 9510). BIOLOGICAL RESOURCES IMPACT MITIGATION MEASURE 3. Prior to ground disturbance and/or construction activities, the applicant/developer shall consult with and follow all California Department of Fish and Wildlife and United States Fish and Wildlife Service requirements related to the listed plant and animal species protected under the Federal Endangered Species Act (FESA) and the California Endangered Species Act (CESA). Applicant/developer shall have a qualified professional conduct and prepare a biological resource clearance survey no less than 14 days and no more than 30 days prior to the beginning of ground disturbance and/or construction activities for the detection of listed, or otherwise special-status species, likely to be impacted by any project related activity. a. If known or natal dens are detected during the survey, protective measures enumerated in the USFWS Standardized Recommendations for Protection of Endangered San Joaquin Kit Fox Prior to or During Ground Disturbance (2011) shall be initiated. If the identified dens are unavoidable, pursuant to the guidelines, the CDFW and USFWS shall be contacted for additional guidance and take authorization. b. If Bakersfield cactus is identified during the survey, the CDFW shall be contacted for guidance concerning the feasibility of translocation. SPR 21-0173 Page | 6 of 12 c. The survey or separate survey shall include a focus on the burrowing owl. The survey shall follow the methodology developed by the California Burrowing Owl Consortium (CBOC 1993). The applicant/developer shall follow CDFW protocol for mitigation and comply with the provisions of the Migratory Bird Treaty Act. CULTURAL RESOURCES IMPACT MITIGATION MEASURES 4. Prior to construction and as needed throughout the construction period, a cultural awareness training program shall be provided to all new construction workers within one week of employment at the project site. The training shall be prepared and conducted by a qualified cultural resources specialist. 5. If buried paleontological or cultural resources are encountered during construction or ground disturbance activities, all work within 50 feet of the find shall immediately cease and the area cordoned off until a qualified cultural and/or paleontological resource specialist that meets the Secretary of the Interior’s Professional Qualification Standards can evaluate the findings and make recommendations. If the specialist determines that the discovery represents a potentially significant resource, additional investigations may be required. These additional studies may include avoidance, testing, and excavation. All reports, correspondence, and determinations regarding the discovery shall be submitted to the California Historical Resources Information System’s Southern San Joaquin Valley Information Center at California State University Bakersfield. 6. During construction, if human remains are discovered, further ground disturbance shall be prohibited pursuant to California Health and Safety Code Section 7050.5. The specific protocol, guidelines, and channels of communication outlined by the Native American Heritage Commission, in accordance with Health and Safety Code Section 7050.5, Public Resources Code 5097.97, and Senate Bill 447 shall be followed. In the event of the discovery of human remains, at the direction of the county coroner, Health and Safety Code Section 7050.5© shall guide Native American consultation. TRAFFIC IMPACT MITIGATION MEASURE 7. Prior to the issuance of building permits, the project applicant shall participate in the Regional Transportation Impact Fee (RTIF) program by paying the adopted fees in place for the land use type at time of development. SPR 21-0173 Page | 7 of 12 II. The following are specific items that you need to resolve before you can obtain a building permit or be allowed occupancy. These items include conditions required by previous site entitlement approvals (these will be specifically noted), changes or additions that need to be shown on the final building plans, alerting you to specific fees, and other conditions for your project to satisfy the City of Bakersfield’s development standards. A. DEVELOPMENT SERVICES – BUILDING (1715 Chester Avenue) (661-326-3720 or DEVBld@bakersfieldcity.us) 1. Prior to the review of improvement plans by the City of Bakersfield, the developer shall submit a grading plan for the proposed site to be reviewed and approved by the City Engineer and Building Official (Bakersfield Municipal Code Section 16.44.010). With the grading plan, if the project is subject to the provisions of the National Pollutant Discharge Elimination System (NPDES), a Notice of Intent (NOI) to comply with the terms of the General Permit to Discharge Storm Water Associated with Construction Activity (WQ Order No. 99-08-DWQ) must be filed with the State Water Resources Control Board in Sacramento before the beginning of any construction activity. Compliance with the general permit requires that a Storm Water Pollution Prevention Plan (SWPPP) be prepared, continuously carried out, and always available for public inspection during normal construction hours. 2. Prior to building permit issuance, the developer shall obtain a grading permit. The developer shall submit four (4) copies of grading plans and two (2) copies of the preliminary soils report to the Building Division. A final soils report shall also be submitted to the Building Division prior to the issuance of a building permit. Please note that grading plans must be consistent with the final building site plans and landscaping plans. Building permits will not be issued until the grading permit is approved by the Building Division, Planning Division (HCP), and Public Works Department. 3. Prior to building permit issuance, an approved site utilities plan shall be included in the plans submitted to the Building Division. 4. Prior to building permit issuance, the plans shall show how and where water will be drained from the property. 5. Prior to building permit issuance, an acoustical consultant, approved by the Building Division, shall be contacted to prepare and include with the final building plans measures that mitigate noise exposures for all buildings on the project site that are subject to noise levels of 65 dB or greater as delineated by the CNEL contour maps of the city. These implementation measures shall comply with the requirements of Title 24 of the California Building Code. SPR 21-0173 Page | 8 of 12 6. At the time of building permit issuance, the Building Division will calculate and collect the appropriate school district impact fee. 7. Prior to receiving final building or site occupancy, the Building Division will verify that a water meter serving the development is in place. Therefore, it is recommended that the developer contact the applicable water purveyor to inquire about their process for obtaining water service for the development as soon as possible. To determine who the water purveyor for the development is, you may contact the City of Bakersfield Water Resources Department (1000 Buena Vista Road, Bakersfield, CA, phone: 661-326-3715). B. DEVELOPMENT SERVICES – PLANNING (1715 Chester Avenue) (Staff Contact – Ethan Estrada; 661-326-3594 or eestrada@bakersfieldcity.us) 1. Prior to receiving final building or site occupancy, the developer must contact the Planning Division (staff contact noted above) for final inspection and approval of the landscaping, parking lot, lighting, and other related site improvements. Inspections will not be conducted until all required items have been installed. Any deviations from the approved plans without prior approval from the Planning Division may result in reconstruction and delays in obtaining a building or site occupancy. 2. Federal and state laws protect certain species of plants, fish, and wildlife that are listed or proposed for listing as endangered or threatened, as well as their designated critical habitat. The presence of an endangered or threatened species on private land that overlaps with development may impose certain duties, such as avoiding unauthorized take and, in some cases requiring consultation with the United States Fish & Wildlife Service and/or California Department of Fish & Wildlife agency. Property owners and developers shall take the necessary steps to ensure compliance with federal and state laws. If unauthorized take occurs, a violation of the prohibition on unauthorized take can lead to civil and criminal penalties by federal and state agencies. SPR 21-0173 Page | 9 of 12 C. Prior to and during construction and prior to building permit issuance, where fire apparatus access roads or a water supply for fire protection is required to be installed, such protection shall be installed and made serviceable. 3. Facilities, buildings, or portions of buildings hereafter constructed shall be accessible to fire department apparatus by way of an approved fire apparatus access road with an asphalt, concrete, or other driving surface approved by the fire chief. Must be capable of supporting the imposed load of fire apparatus weighing at least 75,000 pounds and shall be surfaced with the first lift of asphalt to provide all-weather driving capabilities. All-access (Permanent and temporary) to and around any building under construction must be at least 20 feet wide (26 feet wide where building height exceeds 30 feet), with an overhead clearance of 13 feet 6 inches, and contain no obstruction. Prior to building permit issuance, the final plans shall show that the minimum turning radius shall be thirty-seven (37) feet. 5. Electric gates shall be equipped with a means of opening the gate by fire department personnel for emergency access. Emergency opening devices shall be approved by the fire code official. All new construction of access gates shall be equipped with an automatic opening device which is activated through the wireless activation system utilized on City of Bakersfield-owned vehicles for traffic preemption. Installation and maintenance of the wireless activation system on access gate(s) shall be completed by the gate owner. The gate-opening device shall have a disconnect feature for manual operation of the gate when the power fails. 6. In consideration by the City of Bakersfield for land use entitlements, including but not limited to related environmental approvals related to or arising from this project, the applicant, and/or property owner and/or subdivider ("Applicant" herein) agrees to indemnify, defend, and hold harmless the City of Bakersfield, its officers, agents, employees, departments, commissioners and boards ("City" herein) against any and all liability, claims, actions, causes of action or demands whatsoever against them, or any of them, before administrative or judicial tribunals of any kind whatsoever, in any way arising from, the terms and provisions of this application, including without limitation any CEQA approval or any related development approvals or conditions whether imposed by the City, or not, except for CITY’s sole active negligence or willful misconduct. Prior to grading plan approval, the applicant/developer shall submit documentation to the Planning Division that they are compliant with air quality control measures and rules required by the San Joaquin Valley Air Pollution Control District. 2. Prior to grading plan approval, the applicant/developer shall submit proof to the Planning Division that they have complied with the San Joaquin Valley Air Pollution Control District’s Indirect Source Rule (Rule 9510). BIOLOGICAL RESOURCES IMPACT MITIGATION MEASURE 3. Prior to ground disturbance and/or construction activities, the applicant/developer shall consult with and follow all California Department of Fish and Wildlife and United States Fish and Wildlife Service requirements related to the listed plant and animal species protected under the Federal Endangered Species Act (FESA) and the California Endangered Species Act (CESA). Applicant/developer shall have a qualified professional conduct and prepare a biological resource clearance survey no less than 14 days and no more than 30 days prior to the beginning of ground disturbance and/or construction activities for the detection of listed, or otherwise special-status species, likely to be impacted by any project related activity. a. If known or natal dens are detected during the survey, protective measures enumerated in the USFWS Standardized Recommendations for Protection of Endangered San Joaquin Kit Fox Prior to or During Ground Disturbance (2011) shall be initiated. If the identified dens are unavoidable, pursuant to the guidelines, the CDFW and USFWS shall be contacted for additional guidance and take authorization. b. If Bakersfield cactus is identified during the survey, the CDFW shall be contacted for guidance concerning the feasibility of translocation. SPR 21-0173 Page | 6 of 12 c. The survey or separate survey shall include a focus on the burrowing owl. The survey shall follow the methodology developed by the California Burrowing Owl Consortium (CBOC 1993). The applicant/developer shall follow CDFW protocol for mitigation and comply with the provisions of the Migratory Bird Treaty Act. CULTURAL RESOURCES IMPACT MITIGATION MEASURES 4. Prior to construction and as needed throughout the construction period, a cultural awareness training program shall be provided to all new construction workers within one week of employment at the project site. The training shall be prepared and conducted by a qualified cultural resources specialist. 5. If buried paleontological or cultural resources are encountered during construction or ground disturbance activities, all work within 50 feet of the find shall immediately cease and the area cordoned off until a qualified cultural and/or paleontological resource specialist that meets the Secretary of the Interior’s Professional Qualification Standards can evaluate the findings and make recommendations. If the specialist determines that the discovery represents a potentially significant resource, additional investigations may be required. These additional studies may include avoidance, testing, and excavation. All reports, correspondence, and determinations regarding the discovery shall be submitted to the California Historical Resources Information System’s Southern San Joaquin Valley Information Center at California State University Bakersfield. 6. During construction, if human remains are discovered, further ground disturbance shall be prohibited pursuant to California Health and Safety Code Section 7050.5. The specific protocol, guidelines, and channels of communication outlined by the Native American Heritage Commission, in accordance with Health and Safety Code Section 7050.5, Public Resources Code 5097.97, and Senate Bill 447 shall be followed. In the event of the discovery of human remains, at the direction of the county coroner, Health and Safety Code Section 7050.5© shall guide Native American consultation. TRAFFIC IMPACT MITIGATION MEASURE 7. Prior to the issuance of building permits, the project applicant shall participate in the Regional Transportation Impact Fee (RTIF) program by paying the adopted fees in place for the land use type at time of development. SPR 21-0173 Page | 7 of 12 II. The following are specific items that you need to resolve before you can obtain a building permit or be allowed occupancy. These items include conditions required by previous site entitlement approvals (these will be specifically noted), changes or additions that need to be shown on the final building plans, alerting you to specific fees, and other conditions for your project to satisfy the City of Bakersfield’s development standards. A. DEVELOPMENT SERVICES – BUILDING (1715 Chester Avenue) (661-326-3720 or DEVBld@bakersfieldcity.us) 1. Prior to the review of improvement plans by the City of Bakersfield, the developer shall submit a grading plan for the proposed site to be reviewed and approved by the City Engineer and Building Official (Bakersfield Municipal Code Section 16.44.010). With the grading plan, if the project is subject to the provisions of the National Pollutant Discharge Elimination System (NPDES), a Notice of Intent (NOI) to comply with the terms of the General Permit to Discharge Storm Water Associated with Construction Activity (WQ Order No. 99-08-DWQ) must be filed with the State Water Resources Control Board in Sacramento before the beginning of any construction activity. Compliance with the general permit requires that a Storm Water Pollution Prevention Plan (SWPPP) be prepared, continuously carried out, and always available for public inspection during normal construction hours. 2. Prior to building permit issuance, the developer shall obtain a grading permit. The developer shall submit four (4) copies of grading plans and two (2) copies of the preliminary soils report to the Building Division. A final soils report shall also be submitted to the Building Division prior to the issuance of a building permit. Please note that grading plans must be consistent with the final building site plans and landscaping plans. Building permits will not be issued until the grading permit is approved by the Building Division, Planning Division (HCP), and Public Works Department. 3. Prior to building permit issuance, an approved site utilities plan shall be included in the plans submitted to the Building Division. 4. Prior to building permit issuance, the plans shall show how and where water will be drained from the property. 5. Prior to building permit issuance, an acoustical consultant, approved by the Building Division, shall be contacted to prepare and include with the final building plans measures that mitigate noise exposures for all buildings on the project site that are subject to noise levels of 65 dB or greater as delineated by the CNEL contour maps of the city. These implementation measures shall comply with the requirements of Title 24 of the California Building Code. SPR 21-0173 Page | 8 of 12 6. At the time of building permit issuance, the Building Division will calculate and collect the appropriate school district impact fee. 7. Prior to receiving final building or site occupancy, the Building Division will verify that a water meter serving the development is in place. Therefore, it is recommended that the developer contact the applicable water purveyor to inquire about their process for obtaining water service for the development as soon as possible. To determine who the water purveyor for the development is, you may contact the City of Bakersfield Water Resources Department (1000 Buena Vista Road, Bakersfield, CA, phone: 661-326-3715). B. Prior to receiving final building or site occupancy, the developer must contact the Planning Division (staff contact noted above) for final inspection and approval of the landscaping, parking lot, lighting, and other related site improvements. Federal and state laws protect certain species of plants, fish, and wildlife that are listed or proposed for listing as endangered or threatened, as well as their designated critical habitat. The presence of an endangered or threatened species on private land that overlaps with development may impose certain duties, such as avoiding unauthorized take and, in some cases requiring consultation with the United States Fish & Wildlife Service and/or California Department of Fish & Wildlife agency. Property owners and developers shall take the necessary steps to ensure compliance with federal and state laws. Prior to building permit issuance, the developer shall show on the final building plans the following items: a. All fire hydrants, both offsite (nearest to site) and on-site. Include flow data on the nearest fire hydrant. Hydrants shall be in good working condition and are subject to testing for verification. Fire flow requirements must be met prior to construction commencing on the project site. Please provide two (2) sets of the water plans stamped by a licensed Registered Civil Engineer to the Water Resources Department (1000 Buena Vista Road, Bakersfield, CA. 93311; 661-326-3715). (Note: Show: 1) distance to the nearest hydrant; and 2) distance from that hydrant to the farthest point of the project site.) b. All fire sprinkler and/or stand pipe systems, fire alarms, and commercial hood systems. These suppression systems require review and permits by the Fire Department. The Fire Department will issue guidelines for these various items as they may apply to this project (Deferred Submittal). 2. Prior to receiving final building or site occupancy, the developer shall pay the required fees and request an inspection from the Water Resources Department (1000 Buena Vista Road, Bakersfield, CA, phone: 661-326-3715) for any underground sprinkler feeds at least 2 full business days before they are buried. The Prevention Services Division (2101 H Street, Bakersfield CA, Ph. 661/326-3979) must complete all on-site inspections of fire sprinkler systems and fire alarm systems before any building is occupied. 2. Prior to and during construction and prior to building permit issuance, where fire apparatus access roads or a water supply for fire protection is required to be installed, such protection shall be installed and made serviceable. 3. Facilities, buildings, or portions of buildings hereafter constructed shall be accessible to fire department apparatus by way of an approved fire apparatus access road with an asphalt, concrete, or other driving surface approved by the fire chief. Must be capable of supporting the imposed load of fire apparatus weighing at least 75,000 pounds and shall be surfaced with the first lift of asphalt to provide all-weather driving capabilities. All-access (Permanent and temporary) to and around any building under construction must be at least 20 feet wide (26 feet wide where building height exceeds 30 feet), with an overhead clearance of 13 feet 6 inches, and contain no obstruction. The fire apparatus access road shall extend to within 150 feet of all SPR 21-0173 Page | 10 of 12 portions of the facility and all portions of the exterior walls of the first story of the building as measured by an approved route around the exterior of the building or facility. 4. Prior to grading plan approval, the applicant/developer shall submit documentation to the Planning Division that they are compliant with air quality control measures and rules required by the San Joaquin Valley Air Pollution Control District. 2. Prior to grading plan approval, the applicant/developer shall submit proof to the Planning Division that they have complied with the San Joaquin Valley Air Pollution Control District’s Indirect Source Rule (Rule 9510). Biological Resources Impact Mitigation Measures: 3. Prior to ground disturbance and/or construction activities, the applicant/developer shall consult with and follow all California Department of Fish and Wildlife and United States Fish and Wildlife Service requirements related to the listed plant and animal species protected under the Federal Endangered Species Act (FESA) and the California Endangered Species Act (CESA). Applicant/developer shall have a qualified professional conduct and prepare a biological resource clearance survey no less than 14 days and no more than 30 days prior to the beginning of ground disturbance and/or construction activities for the detection of listed, or otherwise special-status species, likely to be impacted by any project related activity. a. If known or natal dens are detected during the survey, protective measures enumerated in the USFWS Standardized Recommendations for Protection of Endangered San Joaquin Kit Fox Prior to or During Ground Disturbance (2011) shall be initiated. If the identified dens are unavoidable, pursuant to the guidelines, the CDFW and USFWS shall be contacted for additional guidance and take authorization. b. If Bakersfield cactus is identified during the survey, the CDFW shall be contacted for guidance concerning the feasibility of translocation. c. The survey or separate survey shall include a focus on the burrowing owl. The survey shall follow the methodology developed by the California Burrowing Owl Consortium (CBOC 1993). The applicant/developer shall follow CDFW protocol for mitigation and comply with the provisions of the Migratory Bird Treaty Act. Cultural Resources Impact Mitigation Measures: 4. Prior to construction and as needed throughout the construction period, a cultural awareness training program shall be provided to all new construction workers within one week of employment at the project site. The training shall be prepared and conducted by a qualified cultural resources specialist. 5. If buried paleontological or cultural resources are encountered during construction or ground disturbance activities, all work within 50 feet of the find shall immediately cease and the area cordoned off until a qualified cultural and/or paleontological resource specialist that meets the Secretary of the Interior’s Professional Qualification Standards can evaluate the findings and make recommendations. If the specialist determines that the discovery represents a potentially significant resource, additional investigations may be required. These additional studies may include avoidance, testing, and excavation. All reports, correspondence, and determinations regarding the discovery shall be submitted to the California Historical Resources Information System’s Southern San Joaquin Valley Information Center at California State University Bakersfield. SPR 21-0173 Page | 2 of 2 6. During construction, if human remains are discovered, further ground disturbance shall be prohibited pursuant to California Health and Safety Code Section 7050.5. The specific protocol, guidelines, and channels of communication outlined by the Native American Heritage Commission, in accordance with Health and Safety Code Section 7050.5, Public Resources Code 5097.97, and Senate Bill 447 shall be followed. In the event of the discovery of human remains, at the direction of the county coroner, Health and Safety Code Section 7050.5© shall guide Native American consultation.
