HomeMy WebLinkAboutORD NO 3549ORDINANCE NO. 3 ~ 4 9 AN ORDINANCE AMENDING TITLE SEVENTEEN OF THE BAKERSFIELD MUNICIPAL CODE AND ZONING MAP NOS. 123-19 AND 123-20 BY CHANGING THE ZONING ON A SITE LOCATED NORTH OF PANAMA LANE, WEST OF PROGRESS ROAD, SOUTH OF PACHECO ROAD, AND EAST OF BUENA VISTA ROAD FROM A-20A (AGRICULTURE-20 ACRE MINIMUM) TO A R-1 (ONE FAMILY DWELLING), R-1 CH (ONE FAMILY DWELLING-CHURCH), C-1 (NEIGHBORHOOD COMMERCIAL) AND C-2 (REGIONAL COMMERCIAL) ZONES. WHEREAS, in accordance with the procedure set forth in the provisions of Title 17 of the Municipal Code of the City of Bakersfield, the Planning Commission held a public hearing on a petition to change the land use zoning of those certain properties in the City of Bakersfield generally located north of Panama Lane, west of Progress Road, south of Pacheco Road, and east of Buena Vista Road; and WHEREAS, by Resolution No. 31-93 on April 1, 1993, the Planning Commission recommended approval and adoption of an ordinance amending Title 17 of the Municipal Code to approve R-1 (One Family Dwelling) on 567.9 acres, R-1 CH (One Family Dwelling-Church) on 8.3 acres, C-1 (Neighborhood Commercial) on 16.8 acres and C-2 (Regional Commercial) on 17.5 acres as delineated on attached maps marked Exhibits "B" and "C", by this Council and this Council has fully considered the findings made by the Planning Commission as set forth in that Resolution; and WHEREAS, the Planning Commission, as a result of said hearing, did make several general and specific findings of fact which warranted a negative declaration of environmental impact and changes in zoning of the subject property from A-20A (Agriculture-20 acre minimum) to R-1 (One Family Dwelling), R-I CH (One Family Dwelling-Church), C-1 (Neighborhood Commercial) and C-2 (Regional Commercial) zones and the Council has considered said findings and all appear to be true and correct; and WHEREAS, the law and regulations relating to the preparation and adoption of Negative Declarations, as set forth in CEQA and City of Bakersfield's CEQA Implementation Procedures, have been duly followed by city staff, Planning Commission and this Council; and WHEREAS, a Negative Declaration with mitigation was advertised and posted on March 1, 1993, in accordance with CEQA; and WHEREAS, the general plan designation for this area allows commercial and residential develop~nent; and ORIGINAL WHEREAS, the City Council has considered and hereby makes the following findings: 1. All required public notices have been given. 2. The provisions of CEQA have been followed. 3. That proposed Zone Change No. 5432 is consistent with the Metropolitan Bakersfield 2010 General Plan. 4. The proposed zoning with mitigation will not have a significant adverse effect on the environment. 5. Conditions of approval attached to the project as Exhibit "A" are included in the project to minimize and/or mitigate impacts, and to ensure that the density allowed by the general plan is not exceeded. 6. Proposed 5.3 gross acre C-2 site at the northwest corner of Mountain Vista and Harris Road and the 11.1 gross acre C-2 site at the southeast corner of Pacheco Road and Buena Vista are not considered adequate size for regional Commercial C-2 uses. These sites are more appropriate for C-1 (Neighborhood Commercial) uses. 7. The recommended zones are compatible with existing zoning and land use designations and proposed development adjacent to the site. 8. The California State Legislature enacted Senate Bill 1287 that preempts the City's ability to impose mitigation above and beyond the $1.65 per square foot for residential fee plus additional $1 per square foot as may be imposed by a school district. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Bakersfield as follows: All of the foregoing recitals are hereby found to be true and correct. 2. The Negative Declaration is hereby approved and adopted. 3. Section 17.06.020 (Zoning Map) of the Municipal Code of the City of Bakersfield be and the same is hereby amended by changing the land use zoning of that certain property in said City, the boundaries of which property is shown on the map marked Exhibits "B" and "C"" attached hereto and made a part hereof, and are more specifically described in attached Exhibit "D". 4. (Mitigation) No habitable portion of a structure may bc built within 50 fcct of a gas main or the natural gas transmission line on-site. (Mitigation) Prior to or concurrently with recordation of a final map, a covenant shall be recorded on all lots of this tract, or portion thereof, which are within 250 feet of aforementioned pipeline. Covenant shall acknowledge the proximity of pipeline easement to said property and describe the name, type and dimension of the pipeline. Prior to recordation, subdivider shall submit and obtain approval of the covenant wording with the City Attorney, Fire Safety Control Division, and City Engineer. (Mitigation) The pipeline shall be located within a right-of-way or other location acceptable to the Planning Director. (Mitigation) An acoustical analysis shall be submitted with all applications for subdivision maps within 100 feet of the centerline of the adjacent Southern Pacific Railroad tracks. This report shall indicate the means by which the developer proposes to comply with: Items 3 (a)-(f) listed on pages VII-23 and VII-24 of the Noise Element and with the noise standards of 65 dB CNEL or less in outdoor activity areas and 45 dB CNEL or less within interior living spaces; Performance standards within page VII-5 of the Noise Element of the Metropolitan Bakersfield 2010 General Plan. (Mitigation) At the time of subdivision or development, the developer shall pay a proportionate share of the cost for future signals, railroad crossings and canal crossings. The memo from Public Works dated March 29, 1993, gives the current estimated amounts. They are subject to change over time. (Condition) Municipal sewer service shall be provided to future development on the property. (Condition) Public Works Del~artment DISCRETIONARY The following conditions are discretionary. The applicant shall comply with the following conditions to provide for orderly development, ensure required improvements are constructed, and to curtail the proliferation of smaller, independent drainage basins. NOTE: * indicates adjustments have been made on these items to account for the Regional Transportation Impact Fee's contribution towards the item. 1. These fees shall be paid at the time of issuance of a building permit. If a church is constructed in the R-ICH zone, then local traffic impact mitigation fees based on the residential dwelling unit density and cost listed in the chart above shall be paid at the time of building permit. Should an increase of more than 5% in commercial square footage/dwelling unit density be proposed for any specific project within the zone change area, then a review and possible revision to the traffic study may be required. Otherwise, the above unit costs per dwelling/commercialsquare foot shall be maintained irregardless of the number of dwellings/commercial square footage that is finally created so that proportionate traffic mitigation will be achieved. 5. At the time of further development or subdivision, the property owner(s) within the zone change area Exhibit "A" Zone Change No. 5432 Page 4 10. 11. 12. not already within a maintenance district shall request to be annexed to an existing maintenance district or request creation of a new maintenance district for their property. Municipal sewer service to each development, lot, or parcel shall be provided upon further subdivision or development of the property. Prior to submitting any tentative subdivision maps or development plans, a proposal for providing that municipal service shall be submitted to and approved by the City Engineer. The proposal shall include provisions for providing service to the entire zone change area. If a new pump station is required to provide service for this development, then the developer shall perform an economic analysis of the operation and maintenance over the expected life of this pump station and, prior to acceptance by the City of this pump station, shall pay a fee based on the economic analysis for this station's operation and maintenance. Any upgrades to the existing sewer system will be the responsibility of the developer. The Circulation Plan of the Metropolitan Bakersfield 2010 General Plan shows collectors along the east-west and north-south midsection lines and Pacheco Road east of Old River Road, with Buena Vista Road, Panama Lane, Old River Road, and Pacheco Road west of Old River Road shown as arterials. Prior to final approval of any development plan or recordation of a subdivision map, fully executed offers of dedication shall be submitted to the City for all arterial and collector streets within the zone change area. Construction may be deferred to time of development. A drainage study for a drainage system, or systems, for the entire zone change area shall be submitted to and approved by the City Engineer prior to submittal of any tentative subdivision maps or development plans. The drainage study should include, but not necessarily be limited to, drainage calculations, pipe sizes and locations, the drainage basin site(s) and size, and construction phasing. The applicant shall initiate proceedings to form a Planned Drainage Area if necessary to facilitate construction of the drainage system(s). Necessary flowage/drainage easements as indicated in the approved drainage study, which may be off- site from a proposed subdivision, shall be submitted to the City prior to recordation of any subdivision map or approval of any development plan. Buena Vista Road and Panama Lane are future bikeways on the "Bikeways Master Plan" and shall be constructed to a 96' curb to curb standard as required for arterial streets with bike lanes in the circulation element of the 2010 General Plan. The applicant shall enter into an agreement with the city to indemily and defend it against a challenge to any action of the city upon the application.
