RESOLUTION DETERMINING THAT THE COFFEE ROAD
SOUND WALL CANNOT BE CONSTRUCTED THROUGH THE USUAL
BIDDING PROCEDURES AND AUTHORIZING THE FINANCE
DIRECTOR TO DISPENSE WITH BIDD1NG AND TO
NEGOTIATE CONTRACT(S) THEREFORE, NOT TO EXCEED $90,000
WHEREAS, the City of Bakersfield has determined there is a need for a concrete block
sound wall along the east side of Coffee Road from Olive Drive south to approximately Weldon
Avenue; and
WHEREAS, the City has advertised for bids for construction of the Coffee Road sound
wall twice; and
WHEREAS, only one bid was received on each of the bid opening dates of April 22,
'1999, and June 8, 1999; and
WHEREAS, both of these bids exceeded the Engineer' s Estimate by a considerable
amount and both bids were rejected, and
WHEREAS, City desires to complete construction of this project in a timely manner; and
WHEREAS, the Finance Director recommends the Council find that the Coffee Road
sound wall cannot be reasonably constructed in a timely manner because of the fixed requirements
and the schedules required with a formal bid, and recommends that the Council dispense with
bidding, in accordance with subsection D.2 of Section 3.20.060 of the Bakersfield Municipal
Code.
NOW, THEREFORE, BE IT RESOLVED, by the Council of the City of Bakersfield as
follows:
1. The above-recitals are true and correct and incorporated herein by reference.

The Coffee Road sound wall has been sent out to bid twice with each yielding only
one bid, both of which were significantly higher than the Engineer's Estimate.
Readvertising the project for a third time will delay the project's start date and
there is no reason to believe that readvertising this project would produce different
results.
The Finance Director is authorized to dispense with bidding in accordance with
subsection D2 of Section 3.20.060 of the Bakersfield Municipal Code and

negotiate a contract to complete the Coffee Road sound wall.

The expenditure of funds for said construction of the Coffee Road sound wall shall
not exceed $90,000.
I HEREBY CERTIFY that the foregoing Resolution was passed and adopted by
