HomeMy WebLinkAboutRES NO 032-2024RESOLUTION NO. 0 3 2- 2 0 2 4 A RESOLUTION DECLARING REAL PROPERTY EXEMPT SURPLUS LAND AND SURPLUS TO THE NEEDS OF THE CITY AND AUTHORIZING THE CITY MANAGER TO NEGOTIATE ITS SALE WHEREAS, the City purchased fee simple interest in the eleven properties located at 113 Dunlap Street (APN 020-265-08), 117 Dunlap Street (APN 020-265- 07), 121 Dunlap Street (APN 020-265-06), 124 Dunlap Street (APN 020-262-06), 125 Dunlap Street (APN 020-265-05), 128 Dunlap Street (APN 020-262-05), 129 Dunlap Street (APN 020-265-04), 132 Dunlap Street (APN 020-262-04, 133 Dunlap Street (APN 020-265-03), 136 Dunlap Street (APN 020-262-03), and 140 Dunlap Street (APN 020-262-02) as part of the Centennial Corridor project; and, WHEREAS, the City has completed the project related improvements on each of these parcels which has created eleven remnant parcels (''Properties") more particularly described in the attached Exhibit "A 1 's'' and depicted in the attached Exhibit "A'2's"; and WHEREAS, City desires to sell each of the remnant Properties; and WHEREAS, the Bakersfield Planning Department found the sale of this property to be consistent with the Metropolitan Bakersfield 2010 General Plan pursuant to Government Code Section 65402: and WHEREAS, pursuant to Government Code Section 54221(f) (1) (B) (i), the Property is exempt surplus land as each of the individual remnant properties are less than 5,000 square feet in area; and WHEREAS, Bakersfield Municipal Code 3.20.125 authorizes the negotiated sale of City property deemed to be ''surplus" in accordance with Government code Section 54220 et seq. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as follows: 1. The foregoing findings and recitals are true, correct, and incorporated herein. 2. Pursuant to Government Code Section 54221(f) (1) (B) (i), the Properties are "Exempt Surplus'' land. PAGE - 1 'ORIGINAL' 3. The Property is hereby declared surplus to the City's needs, and the City Manager is authorized to negotiate its sale.
