Motion was made by Commissioner McGinnis, seconded by Commissioner Gay, to approve the minutes of November 4 & 7, 2002. Motion carried by group vote. 4.2 Public Hearing Items 4.2a Approve Development Plan Review No. 02-0922 (Mark Costa) Commissioner Tragish requested this item be removed from the Consent Calendar. PUBLIC HEARING - Tentative Tract Maps 5.1 Vestinq Tentative Tract Map 6095 (The Lusich Co., Inc.) Public portion of the hearing was opened. Staff report given recommending approval with conditions including the memorandums from the Planning Department and Public Works Department. Minutes, PC, December 5, 2002 Page 2 No one spoke against the project. Robert Lusich, representing the applicant, concurred with staff's recommendation. Public portion of the hearing was closed. Commissioner Tragish asked Mr. Grady to draw an example of how staff would like lots 11 and 12 of Phase G and 18 and 19 of Phase H placed since staff denied the applicant's request to change the configuration of the lots to fit the rectangular building envelop planned for the houses. Mr. Grady said he was unable to draw it on the screen but explained the rational behind radial and perpendicular lots. The lots are square to the street with a uniform frontage. Mr. Grady showed Commissioner Tragish how lot 18 would be drawn. Commissioner Tragish asked Mr. Lusich if he agreed with this and he said yes. Commissioner McGinnis asked about item 8 of the environmental checklist. It said "low density residential" and asked if it should say "high density residential" and if so what affect that would have on the school situation. Mr. Grady said yes it should but that the school fees would still be paid at building permit based on the project that is being built. If it is a single family house, there is a fee for that. If it is a four-plex lot, there is a fee for that. Commissioner Sprague asked if the tract is developed in order such as A through G or can they develop any phase of that tract anytime they want to? Ms. Shaw said that usually the developer would do them sequentially but sometimes the sequence changes. Staff tries to be as flexible as possible while making sure there is all the appropriate infrastructure to support each phase as it goes. Commissioner Sprague asked that if Phase G is developed before Phase H if there are any conditions for secondary access? There is only one access into Phase G. Can a condition be made to require Phase H be constructed before Phase G? Mr. Lusich said that in working with the Fire Department, there is actually a note on the end of the cul-de-sac in Phase G to require secondary emergency access. It will have removable bollards in it and will provide both pedestrian and emergency secondary access to the subdivision. Commissioner Sprague asked what an equivalent barrier to concrete would be as stated on Page 3 of the staff report? Mr. Grady said the equivalent barrier refers to the fence, not the concrete curbing. They can put up a block wall or a chainlink fence. Commissioner Ellison asked staff if this tract map will connect to other tract maps to the east and west? Ms. Shaw said they are trying to provide as much flexibility as possible for future development adjacent to this property. Right now as the property is being developed, there is no access to the west or east. All access is off of Berkshire or Hosking. Access to Wible will be provided if the property to the west is developed, through the points that they have asked for street right-of-way. The same goes for the property to the west. Commissioner Ellison asked if the lots designed radically on the cul-de-sacs will affect those easements? Ms. Shaw said that it looks to be effective. Motion was made by Commissioner Tragish, seconded by Commissioner McGinnis, to approve and adopt the Negative Declaration and approve Vesting Tentative Map No. 6095 with the findings and conditions set forth in the attached resolution Exhibit A including the Planning Department and Public Works memos dated December 5, 2002. Staff report given recommending approval. No one spoke against the project. Roger Mclntosh, representing the applicant, said that they concur with the conditions in the staff report along with the Public Works memorandum dated December 4, 2002 deleting condition number five. Public portion of the hearing was closed. Commissioner Tragish asked if this project is approved if it will be subject to the new ordinance regarding four-plexes? Mr. Grady said the new ordinance has not been adopted by the City Council so this project would not be subject to it. Commissioner Gay asked if this project will be required to have a block wall since it is next to industrial and Mr. Grady said yes. Commissioner Sprague asked if it would be a six foot or an eight foot block wall? Mr. Grady said the standard is six foot. Commissioner Sprague asked what the two dark blips are in the tract map? Mr. Grady said they appear to be topo lines which will be taken care of in the grading process. Motion was made by Commissioner Tragish, seconded by Commissioner Blockley, to approve Vesting Tentative Map No. 6132 with the findings and conditions set forth in the attached resolution Exhibit A and as set forth in the Public Works memorandum of December 4, 2002. Commissioner Gay asked if when they reduce the open space area if it affects their park contribution? Mr. Grady said these are minor adjustments and would not affect it. Motion was made by Commissioner Tragish, seconded by Commissioner Ellison, to approve and adopt the Negative Declaration and approve Vesting Tentative Map No. 6150 with the findings and conditions set forth in the attached Exhibit A. Staff report given recommending approval including the memorandum from the Public Works Department. No one spoke against the project. Mark Costa, applicant, stated he concurs with the staff report and is here to answer any questions from the Commission. Public portion of the hearing was closed. Commissioner Tragish asked if there is a requirement for a block wall in the rear of the property? Minutes, PC, December 5, 2002 Page 5 Mr. Grady said no there is no requirement for a block wall. Commissioner Tragish said he has a concern about a buffer between this property and the residential to the rear and asked if it could be made a condition of approval? Mr. Grady said yes the Commission could apply a condition to the project since it is a PCD. Commissioner Tragish asked Mr. Costa if he had a problem putting a six foot block wall in the rear of the property? Mr. Costa said that if the majority of the Commission would like a block wall, he would be in agreement with that. Commissioner Tragish asked where the floodlights in the rear of the property will be placed? Mr. Costa showed him on the screen. Commissioner Tragish also asked if Mr. Costa will be hooking up to city sewer and if the existing septic tank will be removed? Mr. Leonard said they generally break the top, fill it and leave it in place. Commissioner Tragish stated that that is all the questions he has but requested the other Commissioners consider his request for a block wall. Commissioner Gay had a question about trash pickup and was told by staff that the trash pickup will be on June Street. Commissioner Sprague asked if the trash enclosure was Calcrete and Ms. Shaw said it was made with concrete blocks. Commissioner Ellison said that it appears that the rear parking area is about 80 feet to the back wall with trees and a grass area. Although he could go either way, he feels there is sufficient setback for a wood fence. Commissioner Tragish asked if a gate is needed off of June Street for fire access? Commissioner Tragish said he is not thrilled about having access off of June Street even for Mr. Costa's personal use. Dave Weirather, from Fire Prevention, said there are no structures in the back area so the Fire Department can access the area from Ming Avenue. Commissioner Blockley asked if on future projects they would have the discretion to impose a condition for a block wall? Mr. Grady said yes. Also, if Mr. Costa or a subsequent landowner wanted to add a structure in the rear, if it would come through the Planning Commission? Mr. Grady said yes through a Revised PCD. He said he is in agreement with Commissioner Ellison and does not believe a block wall should be required. Commissioner McGinnis asked if staff has a problem with Mr. Costa being able to access his property from the rear? Mr. Grady said no and Commissioner McGinnis said he does not either. Mr. Costa has complied with everything staff has asked him to do and has maintained the property very well. He does not see a necessity for a block wall. Commissioner Sprague said he does not see the necessity for a block wall either and asked if there has been any correspondence from adjacent residents in approval or in opposition to this project? Mr. Grady said not to his knowledge. Commissioner Gay said that at some point he agrees a block wall would be good but at the same time the chainlink fence would allow the neighbors to see the landscaping and trees and the graffiti problem would be reduced significantly. Commissioner Gay said he would like a motion as it stands without a block wall. Minutes, PC, December 5, 2002 Page 6 Commissioner Tragish asked if there will be other tenants in the building? Mr. Costa said no. Motion was made by Commissioner Gay, seconded by Commissioner McGinnis, to adopt the resolution making findings approving the development plan for 2210 Ming Avenue as delineated in the attached Exhibit 3 with findings set forth in the attached resolution and including the memo dated December 4 from Marian Shaw and recommend same to City Council. Motion carried by the following roll call vote: AYES: Commissioners Blockley, Ellison, Gay, McGinnis, Sprague NOES: Commissioner Tragish ABSENT: Commissioner Tkac Commissioner Tragish, explaining his no vote, said that even with a chainlink fence, commercial property should have a buffer with the neighborhood. People will be coming and going and he feels there should be some blocking off of that activity from the residential neighborhood. He also does not think it is necessary for Mr. Costa to have access from both the front and rear of his property. COMMUNICATIONS Mr. Grady told the Commission they have been provided with the Environmental Impact Reports for the two commercial PCDs that will be housing Walmarts that the Commission will be hearing on December 19, 2002. COMMISSION COMMENTS Commissioner Gay requested that the Commission forgo their dinner break for the upcoming long meeting that is scheduled. He suggested a 15 minute break so that the public is not kept waiting. Commissioner Ellison mentioned he gave a planning presentation to a seventh grade class on Tuesday where they conducted a mock Planning Commission meeting. Commissioner Tragish said he would prefer having the usual 30 minute dinner break. Commissioner Sprague agreed with Commissioner Tragish. Commissioner Gay said in that case he would hope the break would come between the two agenda items and not stop in the middle on one. Commissioner Sprague praised Councilmember Salvaggio's efforts in preserving Kern River water. 9. DISCUSSION AND ACTION REGARDING POSSIBLE CANCELLATION OF THE NEXT PRE- MEETING. Minutes, PC, December 5, 2002 Page 7 It was decided there would be a pre-meeting on December 16, 2002. 10.
