HomeMy WebLinkAboutRES NO 098-2023(9)RESOLUTION NO. 098-2023 (9) AMENDMENT NO. 9 TO RESOLUTION NO. 098-2023 SETTING SALARIES AND RELATED BENEFITS FOR OFFICERS AND EMPLOYEES OF THE GENERAL SUPERVISORY AND MANAGEMENT UNITS WHEREAS, Resolution No. 098-2023 sets salaries and related benefits for employees of the General Supervisory and Management Unit, including those classified as Fire Management, for the term of July 1, 2019 to June 30, 2025; and WHEREAS, special compensation (such as uniform allowance, holiday and education pay) are a few examples of what a member may be paid, in addition to the base regular rate, pursuant to a labor policy or agreement to similarly situated members of a group or class of employment (i.e. MOU) and is reported in addition to and separately from base salary; and WHEREAS, eligibility of pensionable special compensation, which is reported and used to calculate retirement benefits, is defined by the California Public Employees' Retirement System (CaIPERS); and WHEREAS, CalPERS has recently updated its guidance in how special compensation is reported to ensure compliance with Government Code section 20636 and CCR section 571; and WHEREAS, CalPERS recently notified the CITY that it must change some of the terms in certain labor agreements in order to continue to meet the requirements that special compensation remains an element of pensionable income eligible for final compensation calculations for retirement benefits; and WHEREAS, Resolution No. 098-2023 needs to be amended to comply with the CalPERS requirements; and WHEREAS, the updated resolution expresses the intent and understanding of the existing benefit and does not expand or otherwise create any new benefit for applicable members. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield that: 1. The above recitals are true and correct and incorporated herein by reference. 2. Effective immediately, paragraph 3 of Section 14 of Exhibit A attached to Resolution No. 098-2023, entitled "Incentive Pay" is hereb�epKF� s amended to read as follows: ° m r Amendment No. 9 To Resolution No. 098-2023 'ORIGINAL - Page 1 of 2 Pages - Section 14 Incentive Pay Effective July 1, 2019, for the term of the agreement, the City shall contribute an additional five percent (5/a) of employee's base salary to Fire Management personnel holding an Associate in Arts Degree which fulfills all requirements of a Fire Science Certificate or two and one-half percent (2 1 /2%) of employee's base salary for those safety personnel in the Bakersfield Fire Department who have obtained a Fire Science Certificate requiring thirty (30) units of Fire Management Certificate requiring twenty-one (21) units. 3.
