HomeMy WebLinkAboutRES NO 204-2022(1)RESOLUTION NO. 204-2022 (1) AMENDMENT NO. 1 TO RESOLUTION NO. 204-2022 APPROVING THE MEMORANDUM OF UNDERSTANDING "MOU" SETTING SALARIES AND RELATED BENEFITS FOR THE FIRE SUPERVISORY UNIT OF THE FIRE DEPARTMENT OF THE CITY OF BAKERSFIELD. WHEREAS, Resolution No. 204-2022 sets salaries and related benefits for employees of the Fire Supervisory Unit within the Memorandum of Understanding dated July 1, 2022 to June 30, 2025 ("MOU"); and WHEREAS, special compensation (such as uniform allowance, holiday and education pay) are a few examples of what a member may be paid, in addition to the base regular rate, pursuant to a labor policy or agreement to similarly situated members of a group or class of employment (i.e. MOU) and is reported in addition to and separately from base salary; and WHEREAS, eligibility of pensionable special compensation, which is reported and used to calculate retirement benefits, is defined by the California Public Employees' Retirement System (CalPERS); and WHEREAS, CalPERS has recently updated its guidance in how special compensation is reported to ensure compliance with Government Code section 20636 and CCR section 571; and WHEREAS, CalPERS recently notified the CITY that it must change some of the terms in certain labor agreements in order to continue to meet the requirements that special compensation remains an element of pensionable income eligible for final compensation calculations for retirement benefits; and WHEREAS, Resolution No. 204-2022 and the current MOU need to be amended to ensure compliance with the CalPERS requirements; and WHEREAS, the updated resolution and MOU expresses the intent and understanding of the existing benefit and does not expand or otherwise create any new benefit for applicable members. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield that: 1. The above recitals are true and correct and incorporated herein by reference. Amendment No. 1 To Resolution No. 204-2022 - Page 1 of 3 Pages - 0 m ORIGINAL 2. Effective immediately, Article 1.07 of the MOU attached to Resolution No. 204-2022, entitled "Educational Incentive Pay" is hereby amended to read as follows: Article 1.07 Educational Incentive Pay Effective July 1, 2022, for the term of the agreement, the City shall pay the following amounts to employees meeting the standards set forth below: 1. 2.5% of employee's base salary and holiday pay for those fire safety personnel in the Bakersfield Fire Department who have obtained a Fire Science Certificate requiring thirty (30) units or Fire Management Certificate requiring twenty- one (21) units. 2. 5% of employee's base salary and holiday pay for those fire safety personnel holding an Associate of Arts or Associate of Science Degree which fulfills all requirements of a Fire Science Certificate (inclusive of the 2. 5% above). Employees will be eligible for the following additional incentives: 1. 5% of base salary and holiday pay for a Bachelor of Arts or Bachelor of Science Degree from an accredited College or University. 2. 5% of base salary and holiday pay for a Certified Chief Fire Officer Certificate (individuals in the classification of Firefighter, Fire Engineer or Fire Captain) shall be eligible for this payment if they have completed all of the requirements for Certified Chief Officer except holding a rank necessary to obtain the certification. Once eligible, employees must apply for, obtain and provide to the department the actual certification. The maximum amount of educational incentive pay is 10%. 3.
