ROLL CALL Present: Mayor Goh, Vice Mayor Gonzales, Councilmembers Arias, Weir, Smith, and Kaur Absent: Councilmembers Freeman and Gray 2. PUBLIC STATEMENTS a. Agenda Item Public Statements b. Non -Agenda Item Public Statements Victor E. Garcia spoke regarding speed humps in his neighborhood and summited written materials. Vice Mayor Gonzales requested staff follow up with Mr. Victor Garcia regarding his request for speed humps and share the Neighborhood Traffic Calming Toolkit. 3. REPORTS a. Update on Innovative and Efficient Government Council Goal Priorities. (Staff recommends receive and file.) City Manager Clegg made staff comments and provided a PowerPoint presentation. Mike Turnipseed made comments regarding the deferred maintenance list for Recreation and Parks. Motion by Vice Mayor Gonzales to receive and file update. Approval of minutes of the February 28, 2024, Regular City Council Meetings. (Staff recommends approval of the minutes.) b. Payments: 1. Receive and file payments from February 16, 2024, to February 29, 2024, in the amount of $18,808,597.06 and Self Insurance payments in the amount of $351,906.42, totaling $19,160,503.48. Adoption of an Ordinance amending Bakersfield Municipal Code Title 17, adding, deleting, and amending various Chapters primarily related to residential zoning and mixed -use zoning to address evolving community needs, enhancing housing options, and providing compatibility with the City's long-term development goals in support of the Bakersfield General Plan comprehensive update; specifically, the Housing Element. (FR 02/28/2024) (Staff recommends adoption of the ordinance.) REMOVED FOR SEPARATE CONSIDERATION. See page 6. d. Resolutions: Resolution to Authorize sale of surplus police vehicles (equipment) to the Kern High School District's Regional Occupational Center (ROC) and the Career and Technical Educational Center (CTEC), a non-profit organization, for one dollar ($1.00). (Staff recommends adoption of the resolution.) RES 024-2024 2. Resolution Dispensing with Bidding for the 18th and Eye Street Parking Garage Elevator Modernization Project under Section 3.20.060 of the Bakersfield Municipal Code authorizing the design/build approach. (Ward 2) (Staff recommends adoption of the resolution.) RES 025-2024 3. Amendment No. 8 to Resolution No. 098-2023 setting salaries and related benefits for officers and employees of the General Supervisory and Management Units and adopting salary schedule and related benefits. (Staff recommends adoption of the amendment.) RES 098-2023 (8) e. Agreements: 1. Agreement with Golden Empire Affordable Housing, Inc. II ($1,134,896), for the Construction of Affordable Housing. (Ward 2) (Staff recommends approval of the agreement.) Agreement lending up to $719,953 in Permanent Local Housing Allocations funds and $414,943 in Regional Early Action Planning 2.0 funds to Golden Empire Affordable Housing, Inc. II for the purpose of developing 16 affordable senior housing units located at 610 & 624 4th Street (APN: 009-403-13-00-8 & 009-403-14-00-1) in east Bakersfield. AGR 2024-058 2. Agreement with California Partnership for Safe Communities (not to exceed $95.000) to continue to build out and strengthen the Bakersfield Gun Violence Reduction Strategy (GVRS) for the City's California Violence Intervention and Prevention Program. (Ward 2) (Staff recommends approval of the agreement.) AGR 2024-060 4. Agreements with the following contractors to provide on -call overhead door maintenance, installation, and repair services for a one-year term with an automatic extension of time option for up to three years: (Staff recommends approval of the agreements.) 1. Final Map, Improvement Agreement, and Landscape Agreement with Norris Road LLC for Tract 6874 Phase 2, the Developer is requesting to enter into agreements, so the final map for Tract 6874 Phase 2 located on the north side of McCutchen Road, east of Gosford Road, can be approved and recorded. (Ward 7) (Staff recommends the approval of the agreement.) AGR 2024-068, AGR 2024-069 7. Amendment No. 1 to Agreement No. PD24-002 with Serological Research Institute ($60,000; not to exceed $100,000), to continue DNA testing services. (Staff recommends the approval of the amendment.) AGR 2024-070 8. Amendment No. 3 to Agreement No. 2022-047 with San Joaquin Fence and Supply (extend term one year), for the continuance of supplying installed fencing. (Staff recommends approval of the amendment.) AGR 2022-047 (3) 9. Amendment No. 1 to Agreement No. 2023-077 with California Water Technologies (extend term one year; may be extended for three one-year increments under same terms and conditions) to continue the supply of ferric chloride. (Staff recommends approval of the amendment.) AGR 2023-077 (1) 10. Contract Change Order Nos. 74, 148, 149, and 150 to Agreement No. 19-069 with Security Paving Company (increasing compensation by $152,050; revised not to exceed $150,953,658.85), for the Centennial Corridor Mainline Project. Contract Change Order No. 62 and 92 to Agreement No. 18-176 with Security Paving Company (increasing compensation $80,356.32; revised not to exceed $51,933,585.57), for the Bakersfield Freeway Connector Project. (Wards 1 & 2) (Staff recommends approval of the change orders.) CCO 18-176 (62), (92) f. Bids: 1. Accept bid and approve purchase from Resource Machinery & Engineering, Ventura, CA ($972,888.22) of a track drive windrow composting machine for the Solid Waste Division. (Staff recommends extension of bid and approval of the purchase.) g. Miscellaneous: 1. Authorize the Finance Director to write off accounts receivable in various funds totaling $25,481.57 and forward non -bankrupt accounts to a collection agency for additional collection efforts. Public Safety/Vital Services Measure: Telestaff Software Annual Subscriptions: (Staff recommends adoption of the resolution and approval of the agreement.) Resolution Determining Purchase of Annual Subscriptions for Telestaff Software cannot be obtained through usual bidding procedures, and authorizing the Finance Director to dispense with bidding for Purchase of same, not to exceed $95,000; and RES 026-2024 2. Agreement with UKG Kronos Systems LLC, formerly Kronos Incorporated (not to exceed $68,505). for Telestaff Software Licenses. AGR 2024-071 2. Economic Opportunity Area Grant Agreement with Mill Creek Pets Inc. ($30,880), for site improvements located at 414 21st Street. (Ward 2) AGR 2024-072 3. Economic Opportunity Area Grant Agreement with San Joaquin Tractor Company ($35,000) for site improvement located at 1201 Union Avenue. (Ward 2) AGR 2024-073 4. Economic Opportunity Area Grant Agreement with EeDee Fitness LLC ($45,000), for site improvements located at 314 Truxtun Avenue. (Ward 2) AGR 2024-074 Motion by Vice Mayor Gonzales to adopt Consent Calendar items 7.a. through 7.i. with the removal of Consent Calendar item 7.c.1. for separate consideration. Motion approved with Councilmembers Freeman and Gray absent. Mayor Goh recessed the meeting at 5:53 p.m. and reconvened the meeting at &03 p.m. Motion by Councilmember Arias to pull the second reading of Chapter 17 Ordinance and bring back to a Council Meeting in April; Referral to bring back to the March 27, 2024, Council Meeting a parking ordinance for first reading which would include the following: 1) Eliminate minimum parking standards for single family residential development; 2) Eliminate minimum parking standards for deed restricted affordable housing projects; A Z"I � Bakersfield, California, March 13, 2024 - Page 7 7. CONSENT CALENDAR continued Item 7.c.1. continued 3) Eliminate minimum parking standards for all residential development in the Central District and Old Town Kern; 4) Eliminate minimum parking standards for multi -family residential development with 19 or less dwelling units; 5) Require multi -family residential development with 20 or more dwelling units to allocate a minimum of .25 parking spaces per unit and i) Add an opportunity for a developer who is developing multi -family of 20 units or more to have the ability to appeal to the Planning Commission and City Council if there is pertinent information that needs to be communicated so parking requirement is waived. 8. CONSENT CALENDAR PUBLIC HEARINGS None. 9. HEARINGS a. Public Hearing to consider a resolution ordering to vacate an easement on a portion of O Street, located on the west side of O Street and east side of Jewett Avenue abutting 4023 O Street. (Ward 3) (Staff recommends adoption of the resolution.) RES 027-2024 Public Works Director Strakaluse made staff comments and provided a PowerPoint Presentation. Hearing item 9.a. opened at 6:16 p.m. No one spoke. Hearing item closed at 6:17 p.m. Motion by Councilmember Weir to adopt staff s recommendations. Motion approved with Councilmembers Freeman and Gray absent. 10. REPORTS None. 11. DEFERRED BUSINESS None. 12. NEW BUSINESS None. 13. COUNCIL AND MAYOR STATEMENTS Vice Mayor Gonzales requested staff discuss the current delegated maintenance agreement with Caltrans to include weed abate, graffiti removal, debris, and litter as it relates to encampments to allow the city to proactively address issues as they arise. Councilmember Arias requested staff discuss with Caltrans the possibility of planting mature trees along the hardscape/landscaping areas along Hwy 99 and 58. Councilmember Arias requested staff continue to be proactive when addressing vacant infill properties. A 6 1 7 Bakersfield, California, March 13, 2024 - Page 8 13. COUNCIL AND MAYOR STATEMENTS continued Mayor Goh expressed her appreciation to volunteers who planted 33 trees on Arbor Day at Yokuts Park. Councilmember Weir requested staff reach out to Caltrans to find out their expected construction timeline for improvements around Garces Circle. Councilmember Kaur requested staff discuss landscaping improvements for the area near Highway 99 and the Automall with Caltrans and the Automall Association Group. Vice Mayor Gonzales requested staff develop a plan to systematically engage with property owners along the corridors (99, 58, & 204) to remove outdated signage. 14.
