HomeMy WebLinkAboutRES NO 96-99A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAKERSFIELD REGARDING THE USE OF HOUSING SET ASIDE MONIES OUTSIDE THE DOWNTOWN REDEVELOPMENT PROJECT AREA. WHEREAS, there is a need in the City of Bakersfield (the "City") for decent, safe and sanitary housing and particularly for housing affordable to low-income and moderate- income persons; and WHEREAS, the Community Redevelopment Law of the State of California (Health and Safety Code Section 33000 et. seq.), (the "Law"), imposes specific obligations on each redevelopment agency to respond to housing needs within their jurisdiction, including, but not limited to, establishment of a Low- and Moderate-Income Housing Fund (the "Fund"); and WHEREAS, Section 33334.2 of the Law provides that the redevelopment agency shall use not less than twenty percent (20%) of all taxes which are allocated to it for the purposes of increasing, improving, and preserving the community's supply of low- and moderate-income housing; and WHEREAS, Section 33334.2 also provides that an agency may use these funds inside or outside the Downtown Redevelopment Project Area upon a resolution of the agency and the legislative body that such use of funds will be of benefit to the Downtown Redevelopment Project Area; and WHEREAS, a number of conditions limit the ability of the Central District Development Agency ("Agency") to provide residential development in the Downtown Redevelopmerit Project Area, such as, the existing land uses and socio-economic characteristics of the Downtown Redevelopment Project Area; and WHEREAS, available land that is suitable for multi-family development is limited and probable land acquisition costs indicate a need to provide significant levels of financial assistance for the new construction of housing projects; and WHEREAS, there is very little housing available to low- or moderate income persons in or in close proximity to the Downtown Redevelopmerit Project Area; and WHEREAS, the Agency can provide more people affordable housing opportunities by allowing the use of housing monies outside the Downtown Redevelopment Project Area; and -- Page 1 of 3 Pages -- WHEREAS, in 1995, the City Council of the City of Bakersfield adopted the Bakersfield Consolidated Plan 2000 ("the Plan"), a five-year strategic planning document required by the United States Department of Housing and Urban Development ("HUD') and; WHEREAS, the Plan discussed the use of federal funds throughout the City; and WHEREAS, the Home Investment Partnership Program ("HOME") is funded through HUD; and WHEREAS, the HOME program was created to provide decent, affordable housing to lower-income households, to expand capacity of nonprofit housing providers, to strengthen the ability of state and local governments to provide affordable housing and to leverage private sector participation in affordable housing production; and WHEREAS, the City of Bakersfield has been an entitlement jurisdiction for the HOME Program since 1993; and WHEREAS, the City's HOME Program funds a variety of housing activities, such as: building acquisition, First Time Homebuyer Mortgage Assistance, and rehabilitation of multi-family residences; and WHEREAS, Golden Empire Affordable Housing, Inc., ("GEAH") has submitted a proposal to construct an 80-unit residential complex ("the Project") to house low- and moderate-income senior citizens; and WHEREAS, the Project is to be located just to the northeast of the Downtown Redevelopment Project area; and WHEREAS, GEAH is seeking assistance of $800,000.00 in housing-set aside monies from the Agency and $550,000.00 in federal HOME program monies from the City to go toward acquisition and construction of the Project. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAKERSFIELD as follows: 1. The above recitals are true and correct; The use of funds from the Downtown Redevelopment Project Area's Low- and Moderate-Income Housing Fund outside of the Downtown Redevelopment Project Area will benefit the Downtown Redevelopment Project Area; -- Page 2 of 3 Pages -- The Finance Director is instructed to allocate $800,000.00 from the Agency's Downtown Redevelopment Project Area Low- and Moderate-Income Housing Fund to be used to assist GEAH in the creation of an 80-unit residential complex to be occupied by low- and moderate-income senior citizens.
