A RESOLUTION OF THE COUNCIL OF THE CITY OF
BAKERSFIELD CONFIRMING ASSESSMENT FOR SEWER
CONNECTION FEE AND AUTHORIZING THE COLLECTION
OF ASSESSMENT BY THE KERN COUNTY TAX
COLLECTOR.
WHEREAS, the City has constructed sewer mains in the newly annexed Panama
No. 10 area using Community Development Block Grant funds; and
WHEREAS, to assist property owners in this area in paying the sewer connection
fee the City has agreed to spread the cost of the fee over a three year period; and
WHEREAS, an additional property owner within the area (set forth in Exhibit "A")
has contracted with the City to pay the cost of the connection fee through his property
taxes over the next three years.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield
as follows:
1. The foregoing recitals are true and correct and are incorporated herein.
2. The City Council hereby confirms and approves the individual assessment for
sewer connection fee set forth in Exhibit "A".
3. The Kern County Tax Collector is hereby authorized to collect the assessment
for sewer connection fee to be collected in three equal payments over the next three fiscal
years.
4. The provisions of Proposition 218 do not apply as the sewer connection fee was
imposed as a condition of property development and at the request of the property owner.
