(Regional Commercial/Planned Commercial Development) STAFF RECOMMENDATION: Adopt Resolution ACCEPTING the Planning Director’s Report on Revised Planned Development Review No. 22-0330 as depicted in the project description and subject to the listed conditions of approval. SITE CHARACTERISTICS: The project site is located within the existing parking lot of the commercial center, just north of an existing recycling center. Surrounding properties are primarily developed as: north – shopping center; east – single-family residential; south – shopping center; west – shopping center. BAKERSFIELD THE SOUND OF fJ'tJlllfd/4W)' 1J+ Revised PDR 22-0330 Page 2 BACKGROUND AND TIMELINE: • March 21, 1990 - Calloway No. 3 was annexed to the City of Bakersfield. The project site was included in this annexation area (Annexation 335; Ord. 3284). • November 28, 2001 - City Council approved General Plan Amendment and Zone Change No. P01-0219 to rezone the 10.56 acres from residential to the current zoning classification (Ord. 4037). • December 7, 2006 - PDR No. 06-1672 was approved to allow a 97,422-square-foot shopping center with various single and multi-tenant buildings ranging from 2,689 square feet to 54,790 square feet. • February 1, 2007 - Revised PDR No. 07-0063 was approved to replace a 7,500-square-foot multi- tenant building with a 5,120-square-foot single-tenant building, make alterations to the parking lot and drive approach, and the removal of a loading dock. • October 4, 2007 - Revised PDR No. 07-1762 was approved to reconfigure and reduce a 54,790-square- foot building to a 52,316-square-foot building, to increase an 8,855-square-foot multi-tenant building to 9,660-square-feet, and to make minor alterations to the parking lot and loading dock location. • June 5, 2008 - Revised PDR No. 08-0617 was approved to replace a 5,210-square-foot multi-tenant building with a 7,381-square-foot single-tenant building. • October 18, 2018 - Revised PDR No. 18-0353 was approved to reconfigure a 3,000-square-foot building with a drive-thru pad to a 3,230-square-foot fuel canopy (Res. 85-18). PROJECT ANALYSIS: Planning Director Review. Bakersfield Municipal Code Section 17.54.100(D) allows the Planning Director to administratively approve minor changes, modifications, alterations, deviations, or substitutions to an approved preliminary development plan provided the changes do not substantially or substantively change the project as approved by the Planning Commission or City Council. Such changes are generally limited to colors, materials, architectural elevations, landscape plans, and other physical changes of a similar nature. Should the Planning Director make a finding that submitted revisions to an approved preliminary or final development plan constitute minor changes or substitutions; the Director is to report that determination to the Commission at the next regular meeting. At that time, the Commission may: 1. Accept the Planning Director’s report; or 2. Further modify the Planning Director’s approved changes; or 3. Direct staff to set the matter for public hearing. In this instance, staff is recommending the Commission accept the Planning Director’s Report (Option 1). Proposed Development. This proposal includes the construction of a 525-square-foot wireless telecommunication facility. The proposed facility will include a 55-foot-tall camouflaged cell tower, equipment building, and a 20-kW diesel generator, with a 6-foot-tall masonry wall enclosing all structures. Per the technical pages provided for the diesel generator, the average sound level produced at full load is 67 dB. This is consistent with the permitted sound levels listed in the Noise Element of the General Plan for this land use. An existing parking lot light fixture immediately adjacent to the project site will remain. Revised PDR 22-0330 Page 3 Parking. The commercial center provides shared parking between all uses and legal parcels. As proposed, the construction of this facility will require the removal of four (4) parking spaces. Staff notes that 492 parking spaces are required for the entire commercial center (per Revised PDR No. 07-1762), where 517 will remain. Therefore, the commercial center will continue to provide a surplus of parking consistent with the Bakersfield Municipal Code Chapter 17.58. Landscaping. Construction of this wireless telecommunication facility will require the removal of two (2) trees. The applicant has proposed to replace these trees by installing two (2) new trees in nearby parking lot landscape islands. Therefore, with the proposed replacement trees, the commercial center will remain consistent with Bakersfield Municipal Code Section 17.61.050. Zoning Ordinance Analysis. The purpose of the Bakersfield Municipal Code Chapter 17.59 (Wireless Telecommunication Facilities Not in the Public Right-of-Way) is to establish general guidelines for the siting of wireless telecommunication facilities not in the public right-of-way, in accordance with the Telecommunications Act of 1996, as amended. Compliance with Development Standards. Height: The maximum height for a tower, including equipment, is 125 feet or no more than 20 percent above the existing height of adjacent natural objects, whichever is less, on property zoned or designated commercial or industrial. Natural objects do not include fabricated structures such as buildings, signs, utility poles/towers, or other telecommunication towers. The nearest substantial natural objects include a row of perimeter trees along the eastern boundary of the commercial center. Per a topographic study of the commercial center, the tallest tree along this eastern boundary is approximately 47 feet. Therefore, the development and design standards allow for a maximum height of 56 feet. As proposed, the stand-alone tower will be 55 feet tall and camouflaged as a pine tree. Setbacks: Equipment buildings and towers shall be set back 50 feet from any public or private street, and 50 feet from adjacent lots zoned or designated residential. As proposed, the lease area is set back more than 100 feet from the frontage street and 62 feet from the nearest residential property. Enclosure: Associated equipment shall be within a completely enclosed building. Use of underground vaults, landscaping, or other camouflaging completely screening equipment is encouraged and may be considered by the approving authority in place of a building. If security fencing is used, it shall be wrought iron or similar decorative material. Chain-link fencing may only be used if screened with landscaping. Equipment buildings shall not exceed a height of 12 feet and an area of 750 square feet. As proposed, the proposed equipment will adhere to this development standard, with the lease area being enclosed by a 6-foot-tall masonry wall. ENVIRONMENTAL REVIEW AND DETERMINATION: This project is exempt from the provisions of the California Environmental Quality Act (CEQA) and the City of Bakersfield’s CEQA Implementation Procedures in accordance with Section 15303 (Class 3: Small Structures). This exemption includes projects that consist of a small facility that does not have the potential to have a significant effect on the environment. A Notice of Exemption has been prepared. Revised PDR 22-0330 Page 4 PUBLIC NOTIFICATION: Public notice for the proposed project and environmental determination was advertised in The Bakersfield Californian and posted on the bulletin board in the City of Bakersfield Development Services Building, 1715 Chester Avenue, Bakersfield, California. All property owners within 300 feet of the project site were notified by United States Postal Service mail regarding this public hearing in accordance with city ordinance and state law. Comments Received. As of this writing, no written comments have been received. CONCLUSIONS: Findings. As noted above, Bakersfield Municipal Code Section 17.54.100(D) allows the Planning Director to administratively approve substitutions to an approved final development plan with respect to colors, materials, architectural elevations, landscape plans, and other physical changes provided such changes do not alter any use, environmental mitigation measure, conditions of approval, or substantially affect the basic character of architecture established with the previous approval of the project. Staff finds that the proposed wireless telecommunications facility: (1) is a physical change that does not alter the use of any structure within the P.C.D.; (2) does not affect any environmental mitigation measure or conditions of approval; and (3) does not substantially affect the basic character of architecture established with the previous approval of the project. Recommendation. Staff finds that the applicable provisions of CEQA have been complied with, and the proposal sufficiently demonstrates compliance with the necessary findings. Therefore, staff recommends your Commission adopt the Resolution ACCEPTING the Planning Director’s Report on Revised Planning Development Review No. 22-0330. The applicant's rights granted by this approval are subject to the following provisions: • The project shall be in accordance with all approved plans, conditions of approval, and other required permits and approvals. We developed and provided photovoltaic charging controls for telecommunications in the 1980s along with DC generators for the military. In 1994 we were first to provide DC generators with remote control and monitoring to the telecommunications industry. Polar's success is based on engineering generators to meet the very specific needs of each application. Telecom site optimization is best met with the DC generator technology as the loads and batteries are DC. It makes no sense to install an AC generator and convert the output to DC.
