5. CONSENT PUBLIC HEARINGS
a. Extension of Time Vesting Tentative Tract Map 7252 (Phased): RES NO 01-23
McIntosh & Associates is requesting an extension of time for Vesting
Tentative Tract Map 7252 consisting of 50 multi-family residential lots,
and a designated remainder on 32 acres located at the southwest
corner of Seventh Standard Road and Shane Street. Notice of
Exemption on file.
b. Tentative Parcel Map 12453: Palmetto Engineering is requesting to RES NO 02-23
subdivide 25.83 acres into two commercial parcels and one multi-
family parcel located at the northeast corner of South H Street and
Berkshire Road in southeast Bakersfield. Previously adopted
Mitigated Negative Declaration on file.
c. Extension of Time for Conditional Use Permit 19-0356: Weisenhaus RES NO 03-23
Architecture is requesting an extension of time for Conditional Use
Permit 19-0356 that allowed an assisted living facility in the R-3
(Multiple-Family Dwelling Zone) district, located at 2101 Mt. Vernon
Avenue. Notice of Exemption on file.
d. Conditional Use Permit 22-0329: Salim Development Group, LLC is RES NO 04-23
requesting a conditional use permit to allow the construction of a
carwash in a C-1 (Neighborhood Commercial) and C-2 (Regional
Commercial) zone districts located at 1624 24th Street. Notice of
Exemption on file.
e. Revised Planned Development 22-0111: Halferty Development RES NO 05-23
Company, LLC is requesting a revised planned development review
to allow a fitness center, car wash, and restaurant in an established
commercial center in the C-2/PCD (Regional Commercial/Planned
Commercial Development Zone) district, located at 11411, 11417,
and 11425 Stockdale Highway. Notice of Exemption is on file.
f. Text Amendment to the Bakersfield Municipal Code: The City of RES NO 06-23
Bakersfield is proposing amendments to Chapters 17.25 and 17.26
relating to floor area ratio; Chapter 17.58 relating to parking space
dimension; and Chapter 17.71 relating to outdoor lighting. Notice
of Exemption on file.

a. Planned Commercial Development 22-0320: McIntosh & RES NO 07-23
Associates is requesting a planned commercial development
review to allow an approximate 346,500 square foot retail and
commercial center in the C-2/PCD (Regional
Commercial/Planned Commercial Development zone) district,
located at 3000 Mall View Road. Addendum to Mitigated
Negative Declaration on file.
Staff report given. Public hearing open. Duane Keathley spoke in
favor. Josh Taylor, representing union labor, spoke in opposition.
Rebuttal given in favor by Duane Keathley. No rebuttal in opposition.
Public hearing closed. Commission deliberated.
Motion by Commissioner Lomas, seconded by Commissioner Bittle,
to approve Item 6.a. with revisions to Conditions I1.B.9, I1.E.1, and
I1.E.2. to address outdoor sales, require additional sidewalks along
Mall View Road, and require curb cuts for direct pedestrian access
across driveways, respectively. Motion approved with
Commissioner Neal absent.
COMMUNICATIONS
There will be a regular meeting on February 2, 2023. There will also be a
Housing Element Workshop on April 26. 2023.
COMMISSION COMMENTS
Congratulations to Commissioner Wade on his new baby!
ADJOURNMENT
There being no further business, Chair Cater adjourned the meeting at
