NOTICE OF RIGHT TO APPEAL Planning Commission decisions on Zone Changes, Parcel Maps and Tentative Subdivision maps are subject to appeal by any person aggrieved. No permit shall be issued for anyuse involved in an application until after the final acceptance date of appeal. Such appeal must be filed in writing within 10 days from date of hearing, addressed to the City Council, c/o Office of the City Clerk, 1501 Truxtun Avenue, Bakersfield, CA 93301. A $275 non-refundable filing fee must be included with filing of the initial appeal. If all appeals are withdrawn prior to the City Council 'hearing, it will not be conducted and the decision of the Planning Commission will stand. PUBLIC HEARING - ZONE CHANGE 2) FILE 5307 -- Time set for public hearing on an application_by DAVID MANNING to amend the zoning boundaries from R-S (Residential Suburban) zone'to an R-l-10,000 (One Family Dwelling-10,000 square foot minimum lot size), or more restrictive Zone for 4.96 +/- acres located south of HoSking Avenue between Wible Road and Akers Road. (Negative-DeclaratiOn on file) -' Roll call vote PUBLIC HEARING - ORDINANCE ADDITION a) Proposed inclusion of the Canfield Ranch Oil Field as Class 3 permit in Section 15.66.030(A.3:) of the Oilwell Ordinance. Group vote b) Proposed ordinance to be added to the Bakersfield Municipal Code (Chapter 15.66) relating to the drilling for and production of hydrocarbon substances (petroleum, natural gas and related drilling/Production). This new ordinance consolidates the regulations for drilling and/or production into one .area of the code under the authority of the Fire Marshal. This consolidation necessitates the repeal of associated sections from Title 17 (Zoning Ordinance). (Continued from the regular meeting of April 16, 1992) · .: Roll call vote PUBLIC HEARING - PROPOSED AMENDMENTS TO DENSITY BONUS · ORDINANCE Proposed Ordinance adding Chapter 15.79 to the Bakersfield Municipal Code relating to Density Bonuses. To comply with Section 65195 (c) of the California Government Code, the City of Bakersfield is required to adopt an ordinance to allow maximum residential densities to exceed applicable zoning and land use designations and provide other regulatory concessions or incentives to developers to encourage construction and continued affordability of housing for low or qualifying income residents. Project will supersede expired Resolution #68-82, establishing policy .for granting density bonus incentives to developers of housing for low- or moderate-income families.
