NOTICE OF RIGHT TO APPEAL Planning Commission 'decisions on Zone Changes, Site Plan Reviews, Parcel Maps and Tentative Subdivision maPs are subject to appeal by any person aggrieved. No permit shall be issued for any use involved in an application until after the final acceptance date of appeal. Such appeal-must be filed'in writing within 10 days from date of hearing, addressed to the City Council, c/o Office of the City Clerk, 1501 Truxtun Avenue, Bakersfield, CA 93301. A $275 non-refundable filing fee must be included with filing of the initial appeal. If all appeals are withdrawn prior to the City Council -hearing, it will not be cOnducted and the project may go forward. If no appeal is received.within the specified time period or if all appeals filed are withdrawn, the 'action of the planning Commission shall become final. SEGMENT II: MARTIN-MCINTOSH has requested an' amendment to the Land Use Element of the Metropolitan Bakersfield 2010 General Plan changing the land use_ designation from OS-P (Open Space-Park) to LR (Low Density Residential) on approximately 8 acres, and from LR (Low Density Residential) to ,OS-P (Open Space-Park) on approximately 8 acres for the purposes of relocating a future neighborhood park within the boundaries of Ming Avenue, Old River Road, White Lane and Buena Vista Road, commonly known as a Portion of the Seven Oaks Development. PUBLIC HEARING- GENERAL PLAN AMENDMENTS 4-91, ASSOCIATED REZONINGS AND CIRCULATION ELEMENT AMENDMENT 2a) b) 3a) SEGMENT III: Simpson-VanCuren, Inc. agent for Lawton Powers, has applied-to amend the Land Use Element of the Metropolitan Bakersfield 2010 General Plan by changing the land use designations from LR (Low Density Residential-less than or equal to 7.26 dwelling units per net acre) to GC (General Commercial) on approximately 6,000 square feet for that site generally located along the east side of Oak Street between California Avenue and Park Way. (Negative Declaration on file) Roll call vote SEGMENT VII: CITY OF BAKERSFIELD has proposed a formal acknowledgement of the Kern County Board of Supervisors' approved amendments to.the Metropolitan Bakersfield 2010 General Plan's land use maps from March, 1990 to October 30, 1991 to retain consistent general ~plan land use maps for the unincorporated and incorporated land within the Metropolitan Bakersfield 2010 General Plan area.
