NOTICE OF RIGHT TO APPEAL
Planning Commission decisions on Zone Changes, Site Plan Reviews, Parcel
Maps-and Tentative Subdivision maps. are subject to appeal by any person
aggrieved. No permit shall be issued for any use involved in an application until
after the .final acceptance date of appeal.
Such appeal must be filed in writing within 10 days from date of hearing,
addressed to the City Council, c/o Office of the City Clerk, 1501 Truxtun Avenue,
Bakersfield, CA 93301. A $275 non-refundable filing fee must be included with
filing of the initial appeal. If all appeals are withdrawn Prior to the City 'Council
hearing, it will not be conducted and the project may go forward.
ff no appeal is received within the specified time period, or if all appeals filed are
withdrawn, the action Of the Planning Commission shall become final.

SEGMENT ii: A proposed amendment to the text of the Land Use
Element of the Metropolitan Bakersfield 2010 General Plan. The text for
Land Use Implementation Measure 6(a), Development Review, is
proposed to be revised to remove the requirement for a public hearing
before the Planning Commission for Class "A" Site Plan Review projects
and uses' in Civic Center, Hospital and Church zones within the City of
Bakersfield. Development projects within these zones shall be subject to
_ review and approval by staff. (General Rule Exemption 15061(b)(3)).

SEGMENT III: Application to amend the Land Use Element of the
Metropolitan Bakersfield 2010 General Plan for a 522 4:/- acre site
generally located south of Olive Drive, east of Fruitvale Drive and north of
Rosedale Highway. The requested general plan amendment is from P
(Public Facilities) to LR (Low Density Residential), LI (Light Industrial),
SI (Service Industrial) and HI (Heavy Industrial). THE PURPOSE 'OF
THIS AMENDMENT IS TO-MAINTAIN CONSISTENCY IN THE 2010
METROPOLITAN BAKERSFIELD GENERAL PLAN AND ZONING AS'
ADOPTED BY THE KERN COUNTY BOARD OF SUPERVISORS.
