PUBLIC STATEMENTS · ANY PERSON wHOSE NAME APPEARS ON THE AGENDA OR WISHES TO SPEAK REGARDING A PUBLIC HEARING NEED NOT FILL OUT A SPEAKER'S CARD. ALL OTHERS WISHING TO SPEAK BEFORE THE COMMISSION MAY FILL OUT A SPEAKER'S CARD AND PRESENT IT TO THE SECRETARY PRIOR TO COMMENCEMENT OF THE MEETING. NOTICE OF RIGHT TO APPEAL Planning Commission decisions on Zone Changes, Parcel Maps and Tentative Subdivision maps are subject to appeal by any person aggrieved. No permit shall be issued for any use involved in an application until after the final acceptance date. of appeal. Such appeal must be filed in writing within 10 days from date of hearing, addressed to the City Council, c/o Office of the City Clerk, 150I Truxtun Avenue, Bakersfield, CA 93301. A $330 non-refundable filing fee must be included with filing of the initial appeal. If all appeals are withdrawn prior to the City Council hearing, it Will not be Conducted and the decision of the Planning Commission will stand. CONSENT AGENDA ITEMS Items marked by asterisk (*) are on consent calendar and will be acted on as a group without individual staff presentations unless taken off consent by anyone who wishes to Speak about them. The chairperson will ask at the beginning of the meeting if anyone wishes to discuss or testify on any of the consent items. If any items are taken off consent they will be considered in their regular order on the agenda. If not, the chairperson will open the public hearings on the items as a group and entertain a motion. o o ° APPROVAL OF MINUTES Approval of minutes of the regular meetings held March 13, and March 16, 1995. PUBLIC HEARING - TENTATIVE TRACT TENTATIVE TRACT 5810 (Herb Hull and Associates) Located on the northwest corner of Gosford Road and South Laurelglen Boulevard. Consisting of 23 lots on 6.62 acres for multiple family residential purposes, zoned R-2 with a request for modification to reduce lot width and frontage. (Negative Declaration on file) Group vote PUBLIC HEARINGS -- ZONE CHANGE, TENTATIVE PARCEL MAP, TENTATIVE TRACT a) FILE 5615 -- Time set for public hearing on a request by Porter-Robertson Engineering to amend the zoning boundaries from an R-1 (One Family Dwelling) zone to a C-1 (Neighborhood Commercial) on 2.11 +/- acres generally located on the southeast corner of Kern Canyon Road (AKA State Route 184) and Mesa Marin Drive. Consisting of 2 parcels and a designated remainder. Parcel 1 is proposed to contain 21.42 acres zoned C-1 (Neighborhood Commercial) zone, including the 2.11 + acres subject to Zone Change 5615. Parcel 2 contains 17.07 acres and is zoned R-1 (One Family Dwelling) zone. Parcel 2 is proposed to be further subdivided with Tentative Tract 5804 as described below. The total acreage for Parcels 1 and 2 is 38.49 acres. The 65.37 acre designated remainder is zoned R-1. PUBLIC HEARINGS - GENERAL PLAN AMENDMENT 1-95, ASSOCIATED REZONING AND TENTATIVE TRACT a) SEGMENT VII: RICKETT, DELMARTER AND DEIFEL has requested an amendment to the Land Use Element of the Metropolitan Bakersfield 2010 General Plan by changing the land use designation from LoTM Density Residential and General Commercial to Low Medium Density Residential on 35.75 acres for property located along the southwest corner of Union Avenue and Panama Lane. (Negative Declaration on file) Roll call vote b) FILE 5627 -- Time set for public hearing on an application by RICKETT, DELMARTER AND DEIFEL to amend the zoning boundaries from C-2 (Regional Commercial) to R-1 (One Family Dwelling) on 7 acres for property located along the southwest corner of Union Avenue and Panama Lane. Consists of 201 lots for single family residential purposes on 35 acres, and one lot for commercial purposes on 1.65 acres, totalling 37.40 acres.
