A final agenda may be obtained from the Planning Department 72 hours prior to the meeting. 2. PUBLIC STATEMENTS ANY PERSON WHOSE NAME APPEARS ON THE AGENDA OR WISHES TO SPEAK. REGARDING A PUBLIC HEARING NEED NOT FILL OUT A SPEAKER'S CARD. ALL OTHERS WISHING TO SPEAK BEFORE THE COMMISSION MAY FILL OUT A SPEAKER'S CARD AND PRESENT IT TO THE SECRETARY PRIOR TO COMMENCEMENT OF THE MEETING. NOTICE OF RIGHT TO APPEAL Planning Commission decisions on Zone Changes, Parcel Maps and Tentative Subdivision maps are subject to appeal by any person aggrieved. No permit shall be issued for any use involved in an application until after the final acceptance date of appeal. Such appeal must be filed .in writing within 10 days from date of hearing, addressed to the City Council, c/o Office of the City Clerk, 1501 Truxtun Avenue, Bakersfield, CA 93301. A $330 non-refundable filing fee must be included with filing of the initial appeal. If all appeals are withdrawn prior to the City Council hearing, it will not be conducted and the decision of the Planning Commission will stand. .Agenda, PC, 3/13/95 page 2 If no appeal is received within the specified time period or if all appeals filed are withdrawn, the action of the Planning Commission shall become final. 3. CONSENT AGENDA ITEMS Items marked by asterisk (*) are on consent calendar and will be acted on as a group without individual staff presentations unless taken off consent by anyone who wishes to speak about them. The chairperson will ask at the beginning of the meeting if anyone wishes to discuss or testify on any of the consent items. If any items are taken off consent they will be considered in their regular order on the agenda. If not, the chairperson will open the public hearings on the items as a group and entertain a motion. APPROVAL OF MINUTES Approval of minutes of the regular meetings held January 19, and January 30, 1995. 5. PUBLIC HEARING - NOTICE OF INTENTION TO FILE A NOTICE OF o VIOLATION Notice of intention to record notice of violation of the Subdivision Map Act and the Bakersfield Municipal Code for an illegal subdivision of real property without approval of a tentative map or parcel map. The property is generally located south of McKee Road and west of Wible Road. (Categorically exempt) Group vote PUBLIC HEARING - TENTATIVE TRACT TENTATIVE TRACT 5799 (Deville Homes) Located on the north side of Hageman Road, approximately 500 feet east of Laural Springs Drive. PUBLIC HEARING - ZONE CHANGE FILE 5618 -- Time set for public hearing on a request by REGIONAL MORTGAGE COMPANY to amend the zoning boundaries from an R-1 (One Family Dwelling) zone to an R-l-CH (One Family Dwelling-Church) zone on 7.57 +/- acres for proPerty generally located at the southeast corner of Stine Road and Hosking Avenue. (Negative Declaration on file) Roll call vote o PUBLIC HEARINGS - GENERAL PLAN AMENDMENTS 1-95, ASSOCIATED REZONINGS AND CIRCULATION ELEMENT AMENDMENTS la) SEGMENT I: DEWALT CORPORATION has requested an amendment to the Land Use Element of the Metropolitan Bakersfield 2010 General Plan by changing the land use designation from General Commercial to High Medium Density Residential on 9.6 acres for property located on the northwest corner of Jewetta Avenue and Hageman Road. (Negative Declaration on file) Roll call vote b) FILE 5612 -- Time set for public hearing on an application by DEWALT CORPORATION to amend the zoning boundaries from Neighborhood Commercial to R-2 (Limited Multiple Family Dwelling) on 9.6 acres on the northwest corner of Jewetta Avenue and Hageman Road. (Negative Declaration on file) Roll call vote 2a) SEGMENT II: DAVID MILAZZO, AIA has requested an amendment to the Land Use Element of the Metropolitan Bakersfield 2010 General Plan by changing the land use designation from High Medium Density Residential to General Commercial on 15.43 acres for property located on the northwest corner of Stine Road and Panama Lane. (Negative Declaration on file) Roll call vote 3) SEGMENT IV: CITY OF BAKERSFIELD has proposed a formal acknowledgement of the Kern County Board of Supervisors' approved amendments to the Metropolitan Bakersfield 2010 General Plan's land use and circulation element maps from September, 1991 through January, 1995. These map changes are necessary to retain consistent land use maps and general plans for the unincorporated and incorporated parcels of land within the Metropolitan Bakersfield 2010 General Plan area. (Categorically exempt) Roll call vote 4) SEGMENT V: CITY OF BAKERSFIELD has requested an amendment to the Circulation Element of the Metropolitan Bakersfield 2010 General Plan by adopting a Specific Plan Line for the State Route 178 Freeway previously adoPted by the State of California for property generally located in northeast Bakersfield beginning at the existing State Route 178, approximately 3,000 feet west of Kern Canyon Road/State Route 184, and continuing northeasterly, a distance of approximately five miles to the city boundary. (Negative Declaration on file) Roll call vote 5) SEGMENT VI: CITY OF BAKERSFIELD has requested an amendment to the Circulation Element of the Metropolitan Bakersfield 2010 General Plan by adopting a Specific Plan Line for Coffee Road for property located west of the existing Coffee Road alignment between Rosedale Highway and Brimhall Road.
