PUBLIC STATEMENTS ANY PERSON WHOSE NAME APPEARS ON THE AGENDA OR WISHES TO SPEAK REGARDING A PUBLIC HEARING NEED NOT FILL OUT A SPEAKER'S CARD. ALL OTHERS WISHING TO SPEAK BEFORE THE COMMISSION MAY FILL OUT A SPEAKER'S CARD AND PRESENT IT TO THE SECRETARY PRIOR TO COMMENCEMENT OF THE MEETING. NOTICE OF RIGHT TO APPEAL Planning Commission decisions on Zone Changes, Parcel Maps and Tentative Subdivision maps are subject to appeal by any person aggrieved. No permit shall be issued for any use involved in an application until after the final acceptance. date of appeal. Such appeal must be filed in writing within 10 days from date of hearing, addressed to the City Council, c/o Office of the City Clerk, 1501 Truxtun Avenue, Bakersfield, CA 93301. A $330 non-refundable filing fee must be included with filing of the initial appeal. If all appeals are withdrawn prior to the City Council hearing, it will not be conducted and the decision of the Planning Commission will stand. Agenda, 1/19/95 Page 2 If no appeal is receiVed within the specified time period or if all appeals filed are withdrawn, the action of the Planning Commission shall become final. 3. CONSENT AGENDA ITEMS Items marked by asterisk (*) are on consent calendar and will be acted on as a group without individual staff presentations unless taken off consent by anyone who wishes to speak about them. The chairperson will ask at the beginning of the meeting if anyone wishes to discuss or testify on any of the consent items. If any items are taken off consent they will be considered in their regular order on the agenda. If not, the chairperson will open the public hearings on the items as a group and entertain a motion. 4. APPROVAL OF MINUTES Approval of minutes of the regular meetings held November 17, November 28, and December 1, 1994. 5. PUBLIC HEARING - PLANNING COMMISSION CONSIDERATION OF e STATUS OF ZONE CHANGE 4924. FILE 4924 -- Time set for public hearing to determine practicability of retaining P.U.D. Zone Change No. 4924 for Stockdale Greens located north of Stockdale Highway, approximately 1/4 mile west of Ashe Road. (Negative Declaration on file) PUBLIC HEARING - ZONE CHANGE FILE 5596 -- Time set for public hearing on an application by MARTIN- McINTOSH to amend the zoning boundaries from an A (Agriculture) zone to an R-1 (One Family Dwelling) zone on 60.18 +/- acres and from an A (Agriculture) zone to an R-2 (Limited Multiple Family Dwelling) zone on 10.81 +/- acres for property located on the southwest corner of Old River Road and the extension of Campus Park Drive. PUBLIC HEARINGS '- GENERAL PLAN AMENDMENT 4-94 AND Page 3 ASSOCIATED REZONING la) SEGMENT IV: MARTIN-McINTOSH FOR CASTLE & COOKE has requested an amendment to the Land Use Element of the Metropolitan Bakersfield 2010 General Plan by changing the land use designation from ER (Estate Residential) and OS (Open Space) to LR (Low Density Residential), or more restrictive designation on 166 +/- acres for property generally bounded by Brimhall Road, the Cross Valley Canal, Calloway Drive and the Goose Lake Slough. (Negative Declaration on file) (Request for reconsideration granted at the meeting of January 5, 1995) Roll call vote b) KERN RIVER FREEWAY SPECIFIC PLAN LINE AMENDMENT: MARTIN-McINTOSH FOR CASTLE & COOKE requests reduction of the right-of-way at the Jewetta Avenue Crossing to 210 feet, which will delete the expanded area needed for the grade separation. (Negative Declaration on file) Roll call vote c) FILE 5603 -- Time set for public hearing on a request by MARTIN- McINTOSH FOR CASTLE & COOKE to amend the zoning boundaries from A-20A (Agriculture-20 acre minimum) to PUD (Planned Unit Development), or more restrictive zone on 225 +/- acres consisting of approximately 735 dwelling units, an 18-hole public golf course, driving range, club house facility and tennis courts for property bounded by Brimhall Road, the Cross Valley Canal, Calloway Drive and the Goose Lake Slough.
