2. PUBLIC STATEMENTS
ANY PERSON WHOSE NAME APPEARS ON THE AGENDA OR WISHES
TO SPEAK REGARDING A PUBLIC HEARING NEED NOT FILL OUT A
SPEAKER'S CARD. ALL OTHERS WISHING TO SPEAK BEFORE THE
COMMISSION MAY FILL OUT A SPEAKER'S CARD AND PRESENT IT
TO THE SECRETARY PRIOR TO COMMENCEMENT OF THE MEETING.
NOTICE OF RIGHT TO APPEAL
Planning Commission decisions on Zone Changes, Parcel Maps and Tentative
Subdivision maps are subject to appeal by any person aggrieved. No permit shall
be issued for any use involved in an application until after the final acceptance
date of appeal.
Such appeal must be filed in writing within 10 days from date of hearing,
addressed to the City Council, c/o Office of the City Clerk, 1501 Truxtun Avenue,
Bakersfield, CA 93301. A $330 non-refundable filing fee must be included with
filing of the initial appeal. If all appeals are withdrawn prior to the City Council
hearing, it will not be conducted and the decision of the Planning Commission
will stand.

If no appeal is received within the specified time period or if all appeals filed are
withdrawn, the action of the Planning Commission shall become final.
3. CONSENT AGENDA ITEMS
Agenda Item #7.1 - General Plan Consistency finding for abandonment of
a portion of the waiver of vehicular access rights along White Lane to
create a.50-foot wide access opening at the northwest corner of Parcel
Map No. 8383.

Agenda Item #7.2 - General Plan Consistency finding for summary
vacation of the unimproved portion of Georgia Drive, South of the Kern
River, between Manor Street and Fallgatter Street.
Items marked by asterisk (*) are on consent calendar and will be acted on as a
group without individual staff presentations unless taken off consent by anyone
who wishes to speak about them.
The chairperson will ask at the beginning of the meeting if anyone Wishes to
discuss or testify on any of the consent items. If any items are taken off consent
they will be considered in their regular order on the agenda. If not, the
chairperson will open the public hearings on the items as a group and entertain a
motion.
4. PUBLIC HEARING - TENTATIVE PARCEL MAP
TENTATIVE PARCEL MAP 10113 (Cuesta Engineering)
Located on the south side of Johnson Road between Renfro Road, and Rider
Street. Consisting of 4 parcels zoned R-1-12,000, R-l-10,000, Rol-8,500, A
(Agriculture) and R-2 (Limited Multiple Family Dwelling). (Categorically
exempt)

5. PUBLIC HEARING - ZONE CHANGE
FILE 5558 -- Time set for public hearing on an application by MILAZZO &
ASSOCIATES to amend the zoning boundaries from an R-1 (One Family
Dwelling) zone, an R-2 (Limited Multiple Family Dwelling) zone, and an R-3
(Limited Multiple Family Dwelling) zone to a C-1 (Limited Commercial) zone on
a total of 4.05 +/- acres for property generally located at the southeast corner of
the intersection of South Real Road and State Route 58 Freeway on-ramp, west
of State Route 99 Freeway. (Negative Declaration on file) (Continued from the
