A final agenda may be obtained from the Planning Department 72 hours prior to the meeting. 2. PUBLIC STATEMENTS ANY PERSON WHOSE NAME APPEARS ON THE AGENDA OR WISHES TO SPEAK REGARDING A PUBLIC HEARING NEED NOT FILL OUT A SPEAKER'S CARD. ALL oTHERS WISHING TO SPEAK BEFORE THE COMMISSION MAY FILL OUT A SPEAKER'S CARD AND PRESENT IT. TO THE SECRETARY PRIOR TO COMMENCEMENT OF THE MEETING. NOTICE OF RIGHT TO APPEAL Planning Commission decisions on Zone Changes, Parcel Maps and Tentative Subdivision maps are subject to appeal by any person aggrieved. No permit shall be issued for any use involved in an application until after the final acceptance ~. date of appeal. Such appeal must be filed in writing within 10 days from date of hearing, addressed to the City Council, c/o Office of the City Clerk, 1501 Truxtun Avenue, Bakersfield, CA 93301. A $330 non-refundable filing fee must be included with filing of the initial appeal. If all appeals are withdrawn prior to the City Council hearing, it will not be conducted and the decision of the Planning Commission will stand. Agenda, PC, 9/1/94 Page 2 If no appeal is received within the specified time period or if all appeals filed are withdrawn, the action of the Planning Commission shall become final. 3. CONSENT AGENDA ITEMS Agenda Item #7.1 - General Plan Consistency Finding - proposed vacation of 26th Street and adjacent alley in Block 115, between "H" and Eye - Streets. Items marked by asterisk (*) are on consent calendar and will be acted on as a group without individual staff presentations unless taken off consent by anyone who wishes to speak about them. The chairperson will ask at the beginning of the meeting if anyone wishes to discuss or testify on any of the consent items. If any items are taken off consent they will be considered in their regular order on the agenda. If not, the chairperson will open the public hearings on the items as a group and entertain a motion. 4. REVISED COMPREHENSIVE SIGN PLAN 5-94 (MEMORIAL HOSPITAL - 420 - 34TH STREET) Request for a revised comprehensive sign plan to allow one new sign and incorporate existing signs previously used by Kern View Hospital. PUBLIC HEARINGS - ZONE CHANGES t 1) FILE 5583 -- Time set for public hearing on an application by MARTIN- McINTOSH to amend the zoning boundaries from an R-3 (Limited Multiple Family Dwelling) zone to an R-2 (Limited Multiple Family Dwelling) zone on 3.46 +/- acres for property located approximately 400 feet east of Old River Road, south of Millikan Way, and north of the Southern Pacific Railroad right-of-way. (Negative Declaration on file) Roll call vote FILE 5584 -- Time set for public hearing on an application by EAST BAKERSFIELD ASSOCIATES, L.P. to amend the zoning boundaries from a PCD (Planned Commercial Development) zone to a PCD (Planned Commercial Development), or more restrictive zone on 3.98 +/- acres for development of a 22,000 square foot United Artists Cinema for property located on the northeast corner of Bernard Street and New Market Way at the south portion of the East Hills Center.
