A final agenda may be obtained from the Planning Department 72 hours prior to the meeting. Items listed on :this agenda will be continued to 5:30 p.m. on the Thursday following the date listed on this agenda. 2. PUBLIC STATEMENTS ANY PERSON WHOSE NAME APPEARS ON THE AGENDA OR WISHES TO SPEAK REGARDING A PUBLIC HEARING NEED NOT FILL OUT A SPEAKER'S CARD. ALL OTHERS WISHING TO SPEAK BEFORE THE COMMISSION MAY FILL OUT A SPEAKER'S CARD AND PRESENT IT TO THE SECRETARY PRIOR TO COMMENCEMENT OF THE MEETING. NOTICE OF RIGHT TO APPEAL Planning Commission decisions on Zone Changes, Parcel Maps and Tentative Subdivision maps are subject to appeal by any person aggrieved. No permit shall be issued for any use involved in an application until after the final acceptance date of appeal. Such appeal must be filed in writing within 10 days from date of hearing, addressed to the City Council, c/o Office of the City Clerk, 1501 Truxtun Avenue, Bakersfield, CA 93301. A $330 non-refundable filing fee must be included with filing of the initial appeal for those appeals filed by the applicant or any person outside the notice area. All appeals filed on land divisions will 'require a $330 non-refundable filing fee. If all appeals are withdrawn prior to the City Council hearing, it will not be conducted and the decision of the Planning Commission will stand. Agenda, PC, 11/13/95 Page 2 If no appeal is received within the specified time period or if all appeals filed are withdrawn, the action of the Planning Commission shall become final. 3. CONSENT AGENDA ITEMS Items marked by asterisk (*) are on consent calendar and will be acted on as a group without individual staff presentations unless taken off consent by anyone who wishes to speak about them. The chairperson will ask at the beginning of the meeting if anyone wishes to discuss or testify on any of the consent items. If any items are taken off consent they will be considered in their regular order on the agenda. If not, the chairperson will open the public hearings on the items as a group and entertain a motion. o ° WALL AND LANDSCAPE PLAN - TRACT 5799 (DeVille Homes) Conceptual wall and landscape plans for Tentative Tract 5799 located north of Hageman Road, approximately 1/4 mile east of Fruitvale Avenue. Group vote PUBLIC HEARING - REVISED COMPREHENSIVE SIGN PLAN (Milazzo & Associates) Revised Comprehensive Sign Plan #P95-0003 for Transamerica Plaza. Request for a change in the existing comprehensive sign plan to permit three additional wall signs within the commercial office/retail center. Group vote PUBLIC HEARING - EXTENSION OF TIME Request for extension of time for Tentative Tract 5301 consisting of 136 lots on 40 acres located on the northwest corner of Morning Drive and Paladino Drive. PUBLIC HEARING - ZONE cHANGE 1) FILE 5657 -- Time set for public hearing on an application by MARTIN- McINTOSH to amend the zoning boundaries from an A-20A (Agriculture- 20 acre minimum lot size) zone to an R-1 (One Family Dwelling) zone on 256.69 +/- acres and to an R-S (Residential Suburban) zone on 121.82 +/- acres, and from an R-S (Residential Suburban) zone to an R-1 (One Family Dwelling) zone on 34.90 +/- acres, on a total of 413.41 +/- acres for property located south of Brimhall Road, east of Allen Road and west of Calloway Drive. (Negative Declaration on file) Roll call vote 2) FILE 5666 -- Time set for public hearing on an application by RANDY WHEELER to revise the PUD (Planned Unit Development), or more restrictive zoning on a 229.31 acre pafcel located to the east of the Rio Bravo Canal. Revision is to the golf course, clubhouse and cluster area layout and internal circulation and reducing the total number of dwelling units from 707 to approximately 678. The total acreage of golf course will increase from 70 to 86.8 acres. The clubhouse is now adjacent to the freeway and the driving range is now more westerly within the freeway right-of-way. The single family lot sizes will range from 4,500 to 7,000 square feet. The cluster area encompasses 22.75 acres. This requested revision is for property generally located south of Brimhall Road, north of Stockdale Highway and west of Calloway Road. DISCUSSION AND POSSIBLE ACTION REGARDING THE TIMING OF THE FIRST OF TWO PUBLIC HEARINGS BEFORE THE PLANNING COMMISSION ON THE DRAFT MARKETPLACE ENVIRONMENTAL IMPACT REPORT.
