A final agenda may be obtained from the Planning Department 72 hours prior to the meeting. 2. pUBLIC STATEMENTS ANY PERSON WHOSE NAME APPEARS ON THE AGENDA OR WISHES TO SPEAK REGARDING A PUBLIC HEARING NEED NOT FILL OUT A SPEAKER'S CARD. ALL OTHERS WISHING TO SPEAK BEFORE THE COMMISSION MAY FILL OUT A SPEAKER'S CARD AND PRESENT IT TO THE SECRETARY PRIOR TO COMMENCEMENT OF THE MEETING. NOTICE OF RIGHT TO APPEAL Planning Commission decisions on Zone Changes, Parcel Maps and Tentative Subdivision maps are subject to appeal by any person aggrieved. No permit shall be issued for any use involved in an application until after the final acceptance date of appeal. Such appeal must be filed in writing within 10 days from date of hearing, addressed to the City Council, c/o Office of the City Clerk, 1501 Truxtun Avenue, Bakersfield, CA 93301. A $330 non-refundable filing fee must be included with filing of the initial appeal for those appeals filed by the applicant or any person outside the notice area. All appeals filed on land divisions will require a $330 non-refundable filing fee. If all appeals are withdrawn prior to the City Council hearing, it will not be conducted and the decision of the Planning Commission will stand. Agenda, PC, 9/21/95 Page 2 If no appeal is received within the specified time period or if all appeals filed are .withdrawn, the action, of the Planning Commission shall become final. 3. CONSENT AGENDA ITEMS Items marked by asterisk (*) are on consent calendar and will be acted on as a group without individual staff presentations unless taken off consent by anyone who wishes to speak about them. The chairperson will ask at the beginning of the meeting if anyone wishes to discuss or testify on any of the consent items. If any items are taken off consent they will be considered in their regular order on the agenda. If not, the chairperson will open the public hearings on the items as a group and entertain a motion. PUBLIC HEARINGS - GENERAL PLAN AMENDMENTS 3-95, ASSOCIATED REZONINGS AND KERN RIVER PLAN ELEMENT AND PARKWAY PLAN AMENDMENTS la) SEGMENT II: CITY OF BAKERSFIELD has requested an amendment to the Land Use Element of the Metropolitan Bakersfield 2010 General Plan by changing the land use designation from GC (General Commercial) to HMR (High Medium Density Residential, > 7.26 and _< 17.42 dwelling units per net acre) on 19.4 acres for property located on the north and south sides of Monterey Street, between King Street on the west and Williams Street on the east. (Negative Declaration on file) Roll call vote b) FILE 5655 -- Time set for public hearing on an application by CITY OF BAKERSFIELD to amend the zoning boundaries from C-1 (Neighborhood Commercial) to R-2 (Limited Multiple Family Dwelling, 2,500 square foot lot area per dwelling unit) on 19.4 acres for property located on the north and south sides of Monterey Street, between King Street on the west and Williams Street on the east. (Negative Declaration on file) Roll call vote Agenda, PC, 2) 9/21/95 Page 3 SEGMENT IV: CITY OF BAKERSFIELD has requested an amendment to the Kern River Plan Element 1-95 and amendment to the Kern River parkway Plan to include establishing five "staging" areas to provide access and facilities for equestrian, bicycle and pedestrian uses to the Kern River and bikepath for five sites located along the north side of the Kern River between Mohawk Street and Enos Lane more specifically located at 1) Mohawk Street~ 2) Coffee Road 3) the extension of Wegis Road, 4) at the Southern Pacific Railroad and 5) the intersection of Enos Lane. PUBLIC HEARING - ADOPTION OF SPECIFIC TRAILS PLAN, ADDITION TO MUNICIPAL CODE, CIRCULATION ELEMENT AMENDMENT, KERN RIVER PLAN ELEMENT AMENDMENT a) Specific Trails Plan adoption including Phase 1 Trails: Contains policies and design standards regarding acquisition and improvement of trails and support facilities city-wide through the approval of trail alignments in phases. Phase I generally covers the area west of Rancheria Road to Alfred Harrell Highway, north of Highway 178 to the Kern River. (Negative Declaration on file) Roll call vote b) Addition of Chapter 12.64 to the Bakersfield Municipal Code: Implements the policies of the Specific Trails Plan by adopting an ordinance which requires new development projects within the planning phase area to provide for trail dedication, reservation, improvement and/or in-lieu fee.
