PUBLIC STATEMENTS ANY PERSON WHOSE NAME APPEARS ON THE AGENDA OR WISHES TO SPEAK REGARDING A PUBLIC HEARING NEED NOT FILL OUT A SPEAKER'S CARD. ALL OTHERS WISHING TO SPEAK BEFORE THE COMMISSION MAY FILL OUT A SPEAKER'S CARD AND PRESENT IT TO THE SECRETARY PRIOR TO COMMENCEMENT OF THE MEETING. NOTICE OF RIGHT TO APPEAL Planning Commission decisions on Zone Changes, Parcel Maps and Tentative Subdivision maps are subject to appeal by any person aggrieved. No permit shall be issued for any use involved in an application until after the final acceptance date of appeal. Such appeal must be filed in writing within 10 days from date of hearing, addressed to the City Council, c/o Office of the City Clerk, 1501 Truxtun Avenue, Bakersfield, CA 93301. A $330 non-refundable filing fee must be included with filing of the initial appeal for those appeals filed by the applicant or any person outside the notice area. All appeals filed on land divisions will require a $330 non-refundable filing fee. If all appeals are withdrawn prior to the City Council hearing, it will not be conducted and the decision of the Planning Commission will stand. CONSENT AGENDA ITEMS - (marked by asterisk' (*) 1) Agenda Item #10. - General plan consistency finding for acquisition of property on the south side of Truxtun Avenue Extension, west of Oak Street, for street widening purposes. These items will be acted on as a group without individual staff presentations if no member of the Planning Commission or audience wishes to comment or ask questions on a case. The items are recommended for approval by staff The applicant has been informed of any special conditions and has signed an agreement-to conditions of approval and requested to be placed on the consent agenda. If anyone wishes to discuss or testify on any of the consent items the item(s) will be taken off consent and will be considered in the order on the agenda. (Negative Declaration on file) STAFF RECOMMENDATION: Approve with conditions. 2) VESTING TENTATIVE PARCEL MAP 10299 (Castle and Cooke California, Inc.) Located north and south of Stockdale Highway and east and west of Buena Vista Road. Consisting of 4 parcels on 111.27 acres for commercial, office and limited multiple family development zoned C-2, C-O, R-3 and a request for waiver of mineral rights signatures pursuant to BMC Section 16.20.060 B1. P96-0275: LARRY KELLER has proposed an amendment of the Land Use Element consisting of changing the land use designation from LR (Low Density Residential) to GC (General Commercial) on 3.85 acres while the zoning map amendment will change the zoning district from R-3-D (Multiple Family-Architectural Design Zone) and C-2 (Regional Commercial) to PCD (Planned Commercial Development) on 5.82 acres for purposes of construCting a mini-storage facility. Subject site is located along the east side of State Route 99 between McCall Avenue, White Lane and Mesa Grande Street. (Negative Declaration on file) STAFF RECOMMENDATION: Approve with conditions. P96-0284: CITY OF BAKERSFIELD has proposed an amendment to the Land Use Element of the Metropolitan Bakersfield 2010 General Plan by changing the land use designation, from Public Facilities to Light Industrial on 113.21 acres. Zone Change from Agriculture to Light Manufacturing on 113.21 acres for property generally located southeasterly of the intersection of South Mount Vernon Avenue and East Belle Terrace, about one-half mile south of the State Route 58 Freeway. P96-0185: CITY OF BAKERSFIELD has proposed a text amendment to the Land Use Element of the Metropolitan Bakersfield 2010 General Plan adding a policy statement concerning the unincorporated community of Lamont. (Referred by County of Kern Planning Department) (Categorically exempt) STAFF RECOMMENDATION: Approve Roll call vote GENERAL PLAN AMENDMENT NO. P96-0289: CITY OF BAKERSFIELD has proposed an amendment to the Kern River Plan Element of the Metropolitan Bakersfield 2010 General Plan by incorporating within the Kern River Parkway Plan/EIR a protocol for the review of proposed landscape planting plans within the Kern River Parkway. P96-0419: CASTLE AND COOKE CALIFORNIA, INC. has propOsed to rescind condition No.s 1-6 and 10 of Council Resolution No. 35-95 and Ordinance No. 3633 approving GPA 4- 94, Segment III and ZC 5599. Located on the north side of Brimhall Road between Jewetta Avenue and Old Farm Road. Consisting of 98 lots (18,000 square foot minimum) for single family residential purposes on 58.13 acres with gated private streets; and a request to waive mineral owner signatures pursuant to BMC Section 16.20060 B.1. PUBLIC HEARING - ZONING ORDINANCE TEXT CHANGE -- BAKERSFIELD MUNICIPAL CODE SECTION 16.28.1700.2 The City of Bakersfield is proposing to amend Municipal Code Section 16.28.170 O.2.c. regarding reduction of lot width, depth, and frontage standards for lots 6,000 square feet and greater in size. STAFF RECOMMENDATION: Approve. Roll call vote PUBLIC HEARING - ORDINANCE AMENDMENT The City of Bakersfield is proposing to amend the text of the City of Bakersfield Zoning Ordinance (Chapter 17.53) regarding the site plan review process for projects. Specifically projects will be defined as large (Class A) or small (Class B) with large projects to be reviewed by the Planning Commission at a public hearing regarding environmental issues. Small projects would continue to be reviewed according to the existing administrative process. STAFF RECOMMENDATION:' Continue to July 18, 1996. Roll call vote Agenda, PC, 6/20/96 Page 6 9. ADMINISTRATIVE REVIEW #P-96-0456 OF P.C. DEVELOPMENT REGARDING PARKING REQUIREMENTS FOR A PROPOSED ICE SKATING FACILITY.
