A final agenda may be obtained from the Planning Department 72 hours prior to the meeting. Items listed on this agenda will be continued to 5:30 p.m. on the Thursday following the date listed on this agenda. 2. PUBLIC STATEMENTS ANY PERSON WHOSE NAME APPEARS ON THE AGENDA OR WISHES TO SPEAK REGARDING A PUBLIC HEARING NEED NOT FILL OUT A SPEAKER'S CARD. ALL OTHERS WISHING TO SPEAK BEFORE THE COMMISSION MAY FILL OUT A SPEAKER'S CARD AND PRESENT IT TO THE SECRETARY PRIOR TO COMMENCEMENT OF THE MEETING. NOTICE OF RIGHT TO APPEAL Planning Commission decisions on Zone Changes, Parcel Maps and Tentative Subdivision maps are subject to appeal by any person aggrieved. No permit shall be issued for any use involved in an application until after the final acceptance date of appeal. Such appeal must be filed in writing within 10 days from date of hearing, addressed to the City Council, c/o Office of the City Clerk, 1501 Truxtun Avenue, Bakersfield, CA 93301. A $330 non-refundable filing fee must be included with filing of the initial appeal for those appeals filed by the applicant or any person outside the notice area. All appeals filed on land divisions will require a $330 non-refundable filing fee. If all appeals are withdrawn prior to the City Council hearing, it will not be' conducted and the decision of the Planning Commission will stand. Agenda, PC, 2/15/96 Page 2 If no appeal is received within the specified time period or if all appeals filed are withdrawn, the action of the Planning Commission shall become final. 3. CONSENT AGENDA ITEMS 1) Agenda Item #5. - Extension of Time - Tentative Tract 5656 Items marked by asterisk (*) are on consent calendar and will be acted on as a group without individual staff presentations unless taken off consent by anyone who wishes to speak about them. The chairperson will ask at the beginning of the meeting if anyone wishes to discuss or testify on any of the consent items. If any items are taken off consent they will be considered in their regular order on the agenda. If not, the chairperson will open the public hearings on the items as a group and entertain a motion. 4. APPROVAL OF MINUTES Approval of minutes of the regular meetings held January 2 and January 18, 1996. 5. PUBLIC HEARING - EXTENSION OF TIME - TENTATIVE TRACT 5656 Located on the southwest corner of State Highway 178 and Miramonte Drive, consisting of 184 lots on 193.68 acres, zoned R-1. (Categorically exempt) Group vote PUBLIC HEARING - TENTATIVE PARCEL MAP VESTING TENTATIVE PARCEL MAP 10118 (Martin-McIntosh) Generally located on the north side of Stockdale Highway, approximately 180 feet west of Buena Vista Road. Contains 2 parcels on 11.19 acres, zoned A and C-O. The applicant is proposing to limit the use of subject property to public access to the river, open space and outdoor recreation. Also, applicant requests a waiver of mineral right signatures pursuant to BMC Section 16.20.060(B)(1). (Categorically Exempt) Group vote Agenda, PC, 2/15/96 Page 3 7. PUBLIC HEARING - TENTATIVE TRACT SECOND REVISED VESTING TENTATIVE TRACT 5386 (PHASED) (Martin-McIntosh) Generally located on the east side of Gandola Drive, approximately 1/4 mile south of Brimhall Road. Consisting of 77 lots for single family dwelling purposes, 1 lot for future park, and 1 lot for freeway right-of-way reservation on 28.18 acres, zoned R-1.
