APPROVAL OF THE MINUTES OF THE REGULAR MEETINGS HELD MARCH 21st, APRIL 4th', and APRIL 18, 1991 Commissioner-Frapweil referred to page 3, 4th paragraph of the April 4th minutes, should read two trees rather than 3 trees. Chairperson Rosenlieb referred to-page 2, paragraph six of the March 21st minutes should be 7 1/2 feet and not 4 1/2 feet. Motion ~was made by ·Commissioner Powers to approve the minutes as amended. Motion was seconded by Commissioner Frapwell, and carried. *Commissioner Cohn was seated. WALL AND LANDSCAPE PLANS - PRESTIGE REALTY AND INVESTMENT' Applicant requested consideration of wall and landscape plans for Tract 5450 generally located between Hosking Road and McKee Road, Akers Road and Wible Road. Mr. Ralph Adame, landscape architect for the project was present and amenable to the conditions listed in the staff report. M6ti0n was made by Commissioner Messner to approve wall and landscape plans~for Tentative Tract 5450 subject to conditions listed in Exhibit ,A" of the staff reportlwitb the change reflected ~in the memo from Parks Department dated May~ 15~1991. Motion was seconded by Commissioner Powers, and carrzed. Minutes, P1/C, 5/-16/91 4. CHANGE OF CONDITION - TENTATIVE TRACT 5215 REVISED (TELSTAR Page 2 ENGINEERING, INC.) Tentative tract is located on the northeast corner of Monitor Street and Panama Lane. A change to the conditions of approval to allow deferral of construc- tion of that portion of the knuckle at Adalaide Street and "Street K" that is off-site. T~e applicant requested the condition be altered to allow the construc- tion of a temporary turnaround within the tract at the east end of Adalaide Avenue. Public hearing was opened. Mr. ~Wayne Vaughn, Jr., with Carriage Homes was amenable to the condi- tions listed in the staff report. There being no others wishing to speak, public hearing was closed. Motion was made by Commissioner Powers to approve the request for modi- fication of condi'tions 'in accordance with Exhibit A of the staff report. Motion was seconded by Commissioner Messner, and carried. TENTATIVE TRACT 5291 (MARTIN-McINTOSH) Tentative ~tract is located approximately half way between Ming Avenue and White Lane, and approximately 1/4 mile east of Buena Vista Road. Tentative tract consists of 27 lots on 19 acres for a density of 1.42 dwelling units-per gross acre. Public hearing was opened. Mr. Roger McIntosh with Martin-McIntosh Engineering was present and amenable to the conditions listed in the staff report. There being no others wishing to speak, public hearing was closed. Motion was made by Commissioner Marino to approve and adopt the Negative Declaration, to make all findings set forth in the staff report, and to approve proposed Tentative Tract 5291 subject to the conditions outlined in Exhibit A of the staff report. Motion was sec- ~nded by Commissioner Powers, and carried. TENTATIVE TRACT 5500 (RICKETT, WARD, DELMARTER & DEIFEL) Tentative tract is located on the northwest corner of Stonecreek Avenue and Wible Road and contains 25 lots on 10.6 acres, zoned R-1. Public hearing was opened. Mr. Jim Delmarter represented Karpe Associates and was in agreement with the staff report as written. Page TENTATIVE TRACT 5500 (RICKETT, WARD, DELMARTER & DEIFEL) (continued) ' Motion was made by Commi~ssioner Messner to approv~ and adopt the Negative Declaration, to make all findings set forth in the staff report, and to approve proposed Tentative Tract 5500 subject to the conditions outlined in Exhibit A of t[ie staff report with the changes reflected in the May 15, 1991 memos from Public Works and Par~s Departments. Motion was seconded by Commissioner Powers, and carried. TENTATIVE TRACT 5505 (DEWALT CORPORATION) Commissioner Marino declared a conflict of interest. from the applicant. There being no one.present to represent the applicant, motion was made by Commissioner Frapwell to continue this hearing to the June 6, 1991 meeting. Motion was seconded by Commissioner Messner, and carried. 8. PROPERTY LOCATED ALONG THE NORTHWEST CORNER OF HAGEMAN ROAD AND VERDUGO LANE (EXTENDED) CONSISTING OF 71 +/- ACRES - AMENDING THE ZONING BOUNDARIES FROM AN A-20A (AGRICULTURE 20-ACRE MINIMUM) ZONING DISTRICT TO R-1 (ONE FAMILY DWELLING, MINIMUM LOT AREA 6,000 SQUARE FEET), OR MORE 'RESTRICTIVE ZONING DISTRICT ON 40 ACRES MORE OR LESS, AND FROM A-20A TO RE (RECREATION), OR MORE RESTRICTIVE ZONING DISTRICT ON 13 ACRES, MORE OR LESS, AND FROM RS (RESIDENTIAL SUBURBAN, MINIMUM LOT AREA TWENTY-FOUR THOUSAND SQUARE FEET) TO R-1 OR MORE RESTRICTIVE ZONING DISTRICT ON 18 ACRES MORE OR LESS ALONG THE NORTH AND WEST SIDES OF THE REQUESTED RE (RECREATION) ZONING DISTRICT. ~(FILE 5127 - SEQUOIA ENGINEERING) Commissioner Martino declared a conflict of interest.~ His employer owns property within 300 feet of subject property. This hearing was continued from-the May 2, 1991 meeting.. Public hearing was opened. Mr' Bentley Mo0ney one of the owners of the property was present,~and in. agreement to the memo dated May 10, 1991. There being no others wishing to speak, public hearing was closed. Commissioner Messner to adopt resolution making findings, approving the Negative Declaration, and approving concurrent zone change #5127 consisting of a change from an A-20A (Agricultural, 20-acre minimum lot size) to R-1 (One Family Dwelling), from RS (Residential Suburban, minimum lot area not less than 24,000 square feet) to R-i, from RS to R-I-CH (ChUrch overlay) and from A-20A to R-l-CH subject to conditions of approval listed in Exhibit A of the staff report and mitigation measures listed in Exhibit B; 'and deny the request for an RE (Recreation) zone, and recommend same to the city Council. Moti.on Was seconded by Commissioner Powers, and carried by the following roll call vote: AYES: Commissioners Cohn, Messner, Powers, Rosenlieb, Frapwell NOES: None ABSENT: Commissioners Anderson, Bjorn ABSTAINED: Commissioner Marino SOUTHWEST CORNER OF SOUTH' ALLEN ROAD AND STOCKDALE HIGHWAY COMMONLY KNOWN AS 13001 STOCKDALE HIGHWAY -- AMENDING THE ZONING BOUNDARIES FROM A P.C.D. (PLANNED COMMERCIAL DEVELOPMENT) ZONE TO A P.C.D. (PLANNED COMMERCIAL DEVELOPMENT) ZONE FOR A NEIGHBORHOOD SHOPPING CENTER CONSISTING OF TWO, ONE-STORY SRUCTURES TOTALING APPROXIMATELY 47,000 GROSS SQUARE FEET. IN ADDITION, APPLICANT REQUESTED CHANGES IN THE PREVIOUSLY APPLIED CONDITIONS OF APPROVAL TO ALLOW A WIDER RANGE OF COMMERCIAL USES. (FILE 5176 - WHITMAN ARCHITECTURAL DESIGN) Appli'cant requested approval of a zone change and final development plans to allow a 46,586 square foot retail shopping center. Public hearing was opened. Mr. Duane Keathley~with Coldwell Banker Commercial represented the applicant. He indicated they are in agreement with the conditions with the exception of the limiting of~hours of operation for Building "A" and requested elimination of that condition. There being no others wishing to speak, public hearing was closed. Mr. Kloepper brought to Mr. Keathley and Commission's attention that Public Works Condition 13 reads, South Allen Road shall be improved as authorized by the City Engineer and as previously approved with Tract 4445. Mr. K!oepper indicated that one of the conditions on improvement of Allen Road is construction of a full median and has not been done and remains an outstanding obligation, and could be satisfied by pay- ment of a fee in lieu of actual construction. He 3added the following verbiage to Condition 13. '!Prior to additional certificates of occu- pancy beingissued." Cpmmissioner .Cohn gave a brief history of the project as it came to ~C0mmission in the-past. Minutes, P1/C, 5/16/91 Page 5 9. FILE 5176 - WHITMAN ARCHITECTURAL DESIGN (continued) Commissioner Powers made the comment ~that-in light of the fact that there were property owners here, the neighborhood may not have the kinds of concerns that they voiced in the past with regard to the development and to strike a median the hours of operation might be changed from-9 p.m. to-12 p.m. He also was in support of restaurants in the center because it would reduce the poor air quality by people not having to drive to eat out but objected to the design qualities of the center itself. Mr. Hardisty_commented that the time period was originally imposed because it was a decent hour of night to begin closing down and would be less disruptive to the neighborhood. Commissioner Marino commented that he would like Condition 4 replaced with a restriction on deliveries to the back of Building "A". Commissioner Messner was concerned with the possibility of glare from the lighting to the homes to the south. He did object to the extension of hours of use at this time. Chairperson Rosenlieb commented that when this came to Commission a while ago, it had the most restrictive uses she had ever seen on a com- mercial piece. Chairperson Rosenlieb recognized Mr. Harlan Anderson, resident behind the proposed Shopping center. He commented that the residents were not aware ~of a change in hours of operation nor the types of uses to go in~o the center. Chairperson Roseniieb c6mmented that she does want to honor past commitments that were made to the neighborhood but felt there was room for some amending and loosening of some of these restrictions so that this shopping center will work, and would support the allowing of C-1 uses that would require a Conditional Use Permit. When asked about the possibiiity of a continuance, Mr. Keithley indi- cated they would be happy to meet with the residents to address their concerns. Motion was made by Commissioner Messner to refer this to the Zoning Ordinance Committee and bring this back to the June 6, 1991 meeting, and would like the issue of a possible fountain at the entry way looked at. Motion was seconded by Commissioner Powers, and carried. Commissioner Cohn asked that staff look into the files for any names of individuals who had interest in the numerous issues on this center and invite them to attend the committee meeting. ADDITION OF AN ORDINANCE RELATED TO INDUSTRIAL USES TO THE CITY OF · BAKERSFIELD MUNICIPAL CODE (CHAPTER 17.31) The creation of an M-3 District is necessary to implement 2010 General Plan Land Use PoliCy No.' 29, which requests the provision for a variety of industria% uses. The purpose of the M-3 zone is to provide areas suitable for the development of heavy manufacturing and industrial uses, processing of animals for food or by-products, waste recycling or dis- posal processing, energy .production, mineral exploration and refining, and processing orlmanufacturing of undesirable products. 'Public hearing was opened. There being no one present to speak either in favor or opposition, public hearing was closed. Commissioner Powers commented that staff has adequately addressed the concerns that he raised with respect to setbacks. Motion was. made by Commissioner Marino to adopt the resolution making findings set forth in the staff report, adopting the Negative Declaration and approving Municipal Code Chapte~ 17.31, Heavy Industrial (M-3) Zone, as noted in Exhibit A of the staff report with the following changes; add Section 17.31.060, all buildings shall be l~cated not nearer.than 10 feet from the front property line, add Section 17.31.070, side yard. A. All buildings shall be located not nearer than 20 fret from the side property lines. B. If located adja- cent to residential zones., 45 feet setback for single story~structures, 65-foot setback for multi-story structures. .Required setback area to be used only for landscaping and parking. Addition' of 17.31.080, rear yards. Ail buildings shall be located not nearer than 20 feet from the rear property line. B. If located adjacent to residential zones, 45-foot setback-for single story structures, 65-foot setback for multi- story structures, and the required setback area'to be used only for landscaping and parking~ and recommend same to the City Council. Motion was secohded by Commissioner Powers, and carried by the follow- ing roll call vote: AYES: Commissioners Marino, Cohn, Messner, Powers, Rosenlieb, Frapwell NOES: None ABSENT: Commissioners Anderson, Bjorn 11. PRESENTATION OF RESOLUTION AND PLAQUE TO FORMER'PLANNING COMMISSIONER OSCAR ANTHONY Mr. Hardisty presented former Commissioner Oscar Anthony with a resolu- tion signed by the Commissioners and a plaque for his civil service. Mr. Anthony thanked everyone for their appreciation. Minutes, P1/C, 5/16/91 Page 7 12. PROPOSED NEGATIVE DECLARATION FOR THE TRUXTUN CORRIDOR TRAFFIC IMPROVEMENT MASTER PLAN The Truxtun Avenue Corridor Traffic Improvement Master Plan is a phased Capital Improvement Program and Master Landscape Plan proposed over the next two to three years to greatly improve traffic operations and level of service reduce potential conflicts and reduce the number of traffic accidents. Mr. Steve Walker, Traffic Engineer gave the presentation. Public hearing was opened. -Mr. Norman Walters spoke in opposition to the taking of the trees. Reverend Walter Jones with a church located on E Street and Truxtun Avenue spoke in opposition to the project citing that traffic would be restricted into the church parking area. Mr. Dennis Fox commented he would like to see synchronization of lights. Mr. Walker replied tha~ the lights from F Street easterly and from Truxtun northerly are now synchronized and "A" Street.will be included as part of the synchronization hook-up along with Oak and Truxtun. Mr. Patrick Jacobs, Facilities Manager for Mercy Hospital spoke in favor indicating their concern of the traffic safety along Truxtun Avenue and concurs with the recommendation of city staff. Ms. Karen Cutsforth spoke in favor of the project. Mr. Mike DePetro with Mercy Hospital spoke in favor of the project. There being no others wishing to speak, public hearing was closed. Commissioner Messner asked for staff comment on the use of the Sequoia and Cedar Trees. Mr. Gauthier replied that a landscape architect was retained to work with staff' and design the type of trees that would work. Commissioner Messner stated his support of the proposed plan. Commissioner Marino complimented staff on a rather innovative approach to the problem. He also stated that it is a shame to take out any tree along Truxtun Avenue but in time Truxtun Avenue will be enhanced by the proposed project. Commissioner Cohn expressed his concern regarding pedestrian traffic on Truxtun Avenue. Minutes,'P1/C, 5/16/91 12. Commissioner Powers commended staff for this innovative approach. Chairperson Rosenlieb thanked the audience for their participation. She commented that she would do~ anything that she could to avoid seeing the trees g? but'it has become a safety issue and staff has done an lexcellent job of mitigating the loss of the trees. She shares the majority of C~mmission's concerns about pedestrian traffic, i ~ Motion was made by Commissioner Powers to adopt the Negative Declaration and approve the Truxtun Avenue Corridor Traffic Improvement Master Plan and recommend same to the City Council. EQUESTRIAN TRAIL DESIGN STANDARD Chairperson Rosenlieb waived the staff report. Mr. Dennis Fox commented there is a mechanism to get trails in through the use of utilization of Soil and Conservation Service. Commissioner Marino requested that staff provide the Council with a copy of the trails standard for information purposes as well as sending it to the Board of Supervisors attached to the letter from Commission regarding the western Rosedale Specific Plan program. Motion was made by Commissioner Marino to approve. Motion was seconded by Commissioner Powers, and carried. 14. CONFORMITY OF THE CAPITAL IMPROVEMENT PROGRAM WITH THE METROPOLITAN BAKERSFIELD 2010 GENERAL PLAN PURSUANT TO SECTION 65401 California Government Code Section 65401 requires review and report as to the conformity of the Capital Improvement Program and the adopted general plan. Ail projects proposed for the next five years involve improvements to public facilities to meet the needs of existing and/or future develop- ment in the city. commissioner Messner refer~ed to page 9 of the Capital Improvement ~Progcam and asked for clarification of funds for parks. CAPITAL IMPROVEMENT PROGRAM (continued) Mr. John .Stinson, analyst for the Capital Improvement Program replied that the figures shown on strictly developer fees that are being assessed as part Of the park ordinance and shown in future years. ~Motion was made by Commissioner Messner to find the City of Bakersfield Capital Improvement Program (fiscal year 1991-1992) consistent with the adopted Metropolitan Bakersfield 2010 General Plan. Motion was sec- onded by Commissioner Powers, and carried. 15- PROPOSED SALE OF SURPLUS PROPERTY AT 4101 PACHECO ROAD CONSISTENT WITH THE METROPOLITAN BAKERSFIELD 2010 GENERAL PLAN The City purchased a 0.60 acre lot at the southwest corner of Pacheco Road and Akers Road to provide needed road right-of-way for both roads. Motion was 'made by Commissioner Powers pursuant to Government Code Section 65402 to find the authorization and sale of the City-owned remainder parcel at 410-1Pacheco Road, as surplus property consistent with the MetrQpolitan Bakersfield 2010 general Plan. Motion was sec- onded by Commissioner Frapwell,' and carried. 16. CORRESPONDENCE TO THE KERN COUNTY BOARD OF SUPERVISORS RECOMMENDING INCLUSION OF A REGIONAL EQUESTRIAN TRAIL IN THE WESTERN ROSEDALE 17 SPECIFIC PLAN PROGRAM It was noted that the equestrian trail standard approved earlier would be attached to subject letter and also noted that the standard would be called multi-purpose trail standard. Motion was made by Commissioner Powers to approve and authorize to transmit. Motion was seconded by Commissioner Marino, and carried. COMMISSION COMMENTS Chairperson Rosenlieb commented on the draft goals from the Parks and Environmental Quality Committee. Commissioner Messner reviewed the goals. ICommissioner Powers asked about the scheduling of a speaker on the Sphere of Influence. Mr. Hardisty informed-Commission that the Executive Officer of LAFCO is scheduled to speak at the June 3rd pre-meeting. Chairperson Rosenlieb asked staff not to forget the Oilwell Ordinance. She also asked that staff look at setbacks on freeways for walls.
