APPROVAL OF MINUTES OF THE REGULAR MEETINGS HELD JULY 5, AND AUGUST 16, 1990. Commissioner Martno requested that the minutes of July 5th regarding the development agreement, pages 12 and 13 reflect his discussion with the applicant as to changing the language in the agreement or voiding the agreement if the proposed project is not built or if it is subdivided. Also, for the record, it was his preference to continue the matter and not deny it. In reference to the August 16th meeting, item 8, page. 5 the second to the motion was omitted. Item 14, Commission CommentS,' Commissioner Marino requested that "to the upcom- ing committee meeting" be added after the word "committee." Chairperson Rosenlieb referred to item 12 of the August 16th meeting -indicating that-the heading on page 11 was wrong causing misnumbering- of the rest of the pages. Motion was made by Commissioner Powers to approve the minutes as amended. Motion was seconded by Commissioner Bjorn and carried. Minutes, P1/C, 9/6/90 Page 2 3.PUBLIC 'HEARING - MODIFICATION TO THE SUBDIVISION ORDINANCE - TENTATIVE TRACT MAP 5369 (PORTER-ROBERTSON) Applicant proposed a modification to the Subdivision Ordinance to allow · minimum lot widths of less than 60 foot wide on 8 lots within subject tentative tract located on the south side of Pacheco Road on the east side of Monitor Street. Tentative tract 5369 contains~39 lots on 20 acres, zoned R-1. The Planning Commission conditionally approved this tentative tract on August 16, 1990. Public hearing was opened. Mr. Randy Bergquist represented Porter-Robertson. There being no others wishing to speak, public hearing was closed. Motion was made by Commissioner Powers to make all findings set forth in the staff report and approved the modification to the Subdivision Ordinance to allow a reduction in the minimum lot width from 60 feet ' wide to 58 feet wide on Lots 31 to 38 of Tentative Tract 5369. Motion was seconded by Commissioner Marino, and carried. PUBLIC HEARING - TENTATIVE PARCEL MAP 9463 (PORTER-ROBERTSON) Commissioner Powers abstained due to a financial conflict of interest. Commissioner Bjorn abstained due to the fact that the applicant is a client of her lawfirm. Tentative parcel map is located on the northeast corner of Coffee Road and Brimhall Road and contains .87 acres, zoned M-2. Applicant requested a continuance to the September 20th meeting. Public hearing was opened. Motion was made by Commissioner Anthony to continue this matter to the September 20, 1990 meeting. Motion was seconded by Commissioner Anderson, and carried. o PUBLIC HEARING - TENTATIVE TRACT 5355 (JOHN SARAD) Tentative tract is located on the south side of Berkshire Road approXi- 'mately 2786]feet east of South H Street, and contains 91 lots on 20.02 acres zoded R-I. APplicant requested a continuance. .Public hearing was opened. Motion was made by Commissioner Anthony to continue this.hearing to the September '20 1990 m~eting. Motion was seconded by Commissioner Bjorn, and carried., Minutes, ?l/C, 9/6/90 Page 3 6.THOSE CERTAIN PROPERTIES CONSISTING OF 39+/- ACRES LOCATED SOUTH OF BRIMHALL ROAD APPROXIMATELY 700 FEET WEST OF COFFEE ROAD -- AMENDING THE ZONING BOUNDARIES FROM AN M-2 (GENERAL MANUFACTURING) ZONE TO A C-2 (GENERAL COMMERCIAL) ZONE WITH RESTRICTIONS TO ALLOW ONLY MEDICAL RELATED USES AND MEDICAL SUPPORT SERVICES. (FILE 5069 - MARTIN-McINTOSH ENGINEERING) Commissioner Powers abstained due to financial conflict of interest. Applicant requested a zone change from an M-2 (General Manufacturing) Zone to a C-2 (Commercial) Zone with restrictions to allow only medical related uses and medical support services, in accordance with the McIntosh-General Plan and associated E.I.R. Subject site is located on the south side of Brimhall Road approxi- mately 700 feet west of Coffee Road. Public hearing was opened. Mr. Roger McIntosb representative for Reuben Bartell was present and amenable to the conditions listed in the staff report. There being no'others wishing to speak, public hearing was Closed. Motion was made by Commissioner Marino to approve the Negative Declaration and C-2 zoning with restrictions to medical related uses and support services as proposed and advertised subject to the condi- tions of apprbval in Exhibit "A" of the staff report, make findings set forth in the staff report and recommended adoption of same to the City Council. Motion was seconded by Commissioner Anderson, and carried by the following roll call vote: AYES: Commissioners Marino, Anderson, Anthony, Bjorn, Cohn, Rosenlieb NOES: None ABSTAINED: commissioner Powers 7. THOSE CERTAIN PROPERTIES LOCATED SOUTH OF THE ARVIN-EDISON CANAL BETWEEN STINE AND WIBLE ROAD, NORTH OF HIGHWAY 119 -- INITIATED ACTION BY THE PLANNING COMMISSION TO ZONE UPON ANNEXATION TO AN R-1 (ONE FAMILY DWELLING) AND R-S (RESIDENTIAL SUBURBAN), OR MORE RESTRICTIVE ZONE FOR 649.96 NET ACREAGE, KNOWN AS AKERS NO. 4 ANNEXATION. (FILE 504s) The proposed project is to accommodate the development of single family residential units for the site. The project site is designated LR (Low Density Residential) and S-R (Suburban Residential) on the Metropolitan Bakersfield 2010 General Plan. publiC hearing Was °pened. Mr. Maurice Etchechury~with Cuesta Engineering .reprgsented two of the landowners involved in this annexation in favor of-the annexation. Minutes, P1/C, 9/6f90 page 4 7 AKERS NO. 4 ANNEXATION - FILE 5048 (continued) There being no others wishing to ~speak, public hearing was closed. Commissioner Marino asked if this would be giving double zoning'by giv- ing an RS zone to be held at A-20A until the contracts expire at which time they will automatically become RS zones. Deputy City Attorney replied that this is zoning upon annexation of property in an agricultural zone with a R-i, (10,000 acre minimum) at the time of expiration of the contract. Motion was made by Commissioner Powers to adopt resolution making find- ings approving the Negative Declaration and approving concurrent Zoning Upon Annexation No. 5048 consisting of a change of zone from County A (Exclusive Agriculture) zone to an R-1 (One Family Residential), R-1 - 10,000 (One Family - 10,000 square feet minimum site area), and A-20A (Agricultural - twenty-acre minimum lot size) zone with conditions in attached Exhibit "A", and recommend same to City Council. Motion was seconded by Commissioner Marino, and carried by the following roll call vote: AYEs: Commissioners Marino, Anderson, Anthony, Bjorn, Cohn, Powers, Rosenlieb NOES: None 8. PROPERTY IN THE COUNTY OF KERN LOCATED SOUTH OF PANAMA LANE TO APPROXIMATELY 260 FEET SOUTH OF THE ARVIN-EDISON CANAL, EAST OF WIBLE ROAD - INITIATED ACTION BY THE PLANNING COMMISSION TO ZONE UPON ANNEXATION TO R-1 (ONE FAMILY DWELLING) AND C-1 (NEIGHBORHOOD COMMERCIAL) OR MORE RESTRICTIVE ZONE AND ANNEXATION OF 17.26 +/- ACRES. (FILE 5042 - WIBLE NO. 7 ANNEXATION) Commissioner Powers abstained due to financial conflict of interest. The proposed annexation to the City of Bakersfield would accommodate the development of a neighborhood shopping center at the southeast corner Of Wible Road and Panama Lane. The annexation consists of uninhabited land contiguous to the city l~imits southerly of Panama Lane and easterly of Wible Road and within the Bakersfield Sphere of Influence.~ Public hearing was opened. Mr. Tom Boozer, owner of 7 1/2 acres shown as R-1 on the map indicated that during the 2010 hearings it was his understanding that bis pro- perty would be zoned R-2 if annexed into the City. Minutes, P1/C, 9/6/90 Page 5 8. FILE 5042 - WIBLE~ NO. 7 ANNEXATION (continued) Mr. Hardisty replied that ~he land use designation is LMR and LR. In the County it isILMR which coud result in development up to 10 units or more per acre and in the City it would be LR which would be single family residential. He recommended a continuance in order to collect the information needed to. c0mplete this hearing. Motion was made by Commissioner Cohn to continue this hearing to 6:30 to give staff time to gather the information needed. Motion was seconded by Commissioner Bjorn, and carried. 9 INITIATED ACTION BY THE PLANNING COMMISSION TO ANNEX 651 +/- ACRES OF PROPERTIES IN THE COUNTY OF KERN LOCATED SOUTH OF THE ARVIN-EDISON CANAL TO HIGHWAY 119 BETWEEN WIBLE AND STINE ROAD -- ARERS NO. 4 ANNEXATION Staff report was waived by Chairperson Rosenlieb. Public hearing was opened. Mr. Maurice Etchechury with Cuesta Engineering was in agreement with Staff recommendation. There being no others wishing to speak, public hearing was closed. Motion was made by Commissioner Powers to adopt resolution making fin- dings and approving Negative Declaration and approving Akers No. 4 Annexation application and .recommend same to City Council. Motion was seconded by Commissioner Marino, and carried by the following roll call vote: AYES: Commissioners Marino, Anderson, Anthony, Bjorn, Cohn, Powers, Rosenlieb NOES: None ABSENT: 10. WRITTEN COMMUNICATION Request from Parks Department for committee meeting to discuss landscape ~medians. Mr. Hardisty commented this request from the Parks Department is a response to a concern which was also referred to the Urban Development Committee and the City Council and was referred to the Joint Committee for discussion of landscaping of median islands and the effects on maintenance copts, and recommended that this be referred to the joint committee. . ChairpersOn Rosenlieb asked Ken Trone of the Parks Division if he had a definition of hardscaping. Minutes, P1/C,. 9/6/90 'Page 6 10. WRITTEN COMMUNICATION (continued) Mr. Trone replied they would start with stamped concrete and would look at other things such as cobble stone and possibly colored concrete. Chairperson Rosenlieb suggested that at the time of the meeting that staff have a definition of hardscape. She further commented that it would be helpful if the department-believes that grass shouldnot be used then this would be the time to request strictly shrubs and bubblers. She asked Mr. Trone if the Parks Department would encounter resistance to a proposal for just shrubs and trees. Mr. Trone replied that they have in the past. Chairperson Rosenlieb asked if the request was only for median strips. Mr. Trone replied that the overall streetscape needs to be looked at. Chairperson Rosenlieb commented that it would be helpful to have speci- fic recommendations. Commissioner Marino commented that he liked the concept and supported sending this to committee. Commissioner Powers supported Chairperson Rosenlieb's comments, and further stated that the Parks Department should be calling out the spe- cific hardscape that should be used within the criteria that is going to be developed. Commissioner Anderson stated his opposition to a smooth concrete sur- facelbecause of the ultimate cracking and discoloration. Commissioner Cohn suggested the use of leaky pipe to water turf in the median islands thus-eliminating the problem of water runoff. Commissioner Rosenlieb commented that the Subdivision Committee did look at this and it was their consensus that the development community should have some options. She was in agreement with Commissioner Anderson in that if turf is such a problem in the median islands in the center of the arterials they should be done away with entirely. · Motion was made by Commissioner Marino to refer this to the Joint City Council/Planning Commission committee. Motion was seconded by Commissioner Powers, and carried. 11. VERBAL COMMUNICATION Mr. Hardisty commented that the City Council is trying to enhance staff capability in response to 2010 needs by considering one additional Principal Planner in the Planning Department. Minutes, P1/C, 9/6/90 Page 7 12. ZONE UPON ANNEXATION - WIBLE NO. 7 ANNEXATION (continuance) Commissioner Powers continued his disqualification. Mr. Hardisty indicated that in the county designated area, the 2010 plan showed this property as LMR and LR in the city. The existing General Plan showed it as single family residential 6,000 square foot lots. The existing zoning is AG and the county showed it as LMR a max- imum of 10 units to the net acre. The applicant requested commercial and the County staff recommended denial and retention of the County's LMR and the mapping was confirmed as presented. Public hearing was closed. Mr. Tom Boozer spoke regarding his property being zoned for multi- family. Motion was made by Commissioner Cohn to adopt resolution making find- ings approving Negative Declaration, and approving concurrent Zoning Upon Annexation No. 5042 consisting of a change from the County .A-1 and C-1PD zone to a city R-1 and C-1 zone as requested and recommend same to the City Council. Commissioner Marino was unsure as to the motion at the 2010 hearings. Mr. H~rdisty commented that this needs further research and this should be eontinued, and if there is a mapping error he would advise the Council at their consideration of the zoning. Chairperson Rosenlieb agreed with the postponement until the Commission and staff, feel certain as to what the actual motion was. Commissioner Cohn withdrew his motion. Motion was made by Commissioner Bjorn to continue this hearing to the September 20, 1990 meeting. Motion was seconded by Commissioner Marino, and carried. 13. COMMISSION COMMENTS Chairperson R°senlieb updated the Commission on the status of the free- Way rlghtrof-way acquisition at committee level and requested that staff do research and provide the committee with numbers with the intent being .that within a month of that time frame a meeting would be requeSted with not only city staff and committee but with other members of the community, and asked if there is a date for the next meeting. Mr. Hardisty indicated that he spoke with the Urban Development Committee and felt the committee's proposal was in line with their own efforts and also thought the development of .a broader based community type of a task force would be a good thing to pursue. Commissioner Marino asked if the Council has been apPrised that the Commission would like to have one member of the Council on this committee. · Minutes, P1/C,.6/9/90 Page 8 13 COMMISSION COMMENTS Mr..Hardisty replied that the Urban Development committee has and sug- gested that the Commission report to the Council this proposal so that they can assign, a Council member to sit as a part of that task force. Commissioner Marino suggested that the request be placed on the next agenda. Chairperson Rosenlieb asked that the request also be placed on agenda of the Joint City Council/Planning Commission committee. Chairperson Rosenlieb asked if another General Plan Committee meeting should be held_just with staff. Mr. Hardisty replied that'would be good. It was decided that the General Plan Committee would meet on-Wednesday September 12 at noon. Commissioner Anthony asked for an update on the Park Ordinance. Mr. Hardisty replied that the City Council had first reading of an ordinance that embodied a portion of the ordinance that Commission rec- ommended they adopt. Commissioner Anderson asked if there were any comments from the Council with regards to alternate source of funds for building these parks. Mr. Hardisty replied that he discussed with one Council member the dif- ficulty in funding development of parks because he had expressed a frustration with getting Just the ground and not the ability to construct. Commissioner Anderson commented that the committee had originally looked at a dedication of three acres per thousand and as a compromise they came up with 2 1/2 acres for a trade off with the people from BIA and stated he was disappointed that this has been broken apart that they have accomplished the 2 1/2 acres per thousand and yet there is nothing to go on to be able to solicit funds from the developers for the building of the parks. Chairperson Rosenlieb commented that the issue of parks and the bill- boards and the past issue of not allowing commercial uses into indus- trial zones and even the animals ordinance, have gone by the way side because of political reasons. She further stated that with a new staff member in the Planning Department, maybe some smaller battles can be won by having someone who can devote some time to. implementing ordinances. Commissioner Anderson in referring to the Parks Ordinance commented that maybe additional staff is not-what is needed but stronger Council c6mmitment ~ Minutes, P1/C, 9/6/90 13. Commission Comments Page 9 Commissioner Powers commented that he is Chairman of the Bike/Pedestrian Ways and Trails Committee and he has asked for several ordinances from various cities who have ordinances on pedestrian ways and trails to be distributed to members of that committee so that some- thing can start to be formulated on a city-wide basis. Commissioner Marino made comment regarding the League of California Cities Conference~taking place October 21-24 in Anaheim. Mr. Hardisty commented that this conference is much broader than the annual Planning. Commissioner's conference and in anyone is interested in attending he would assist in making arrangements. 14.
