ROLL CALL COMMISSIONERS: Present: JIM MARINO, Chairperson STEVE ANDERSON, Vice Chairperson TERI BJORN DAVID COHN STEVE MESSNER DARREN POWERS KATE ROSENLIEB C. PUBLIC STATEMENTs No-one made any public statements at this time. Chairmanread the notice of right to appeal as set forth on the agenda. APPROVAL OF MINUTES Motion was made by Commissioner Rosenlieb, seconded by Commissioner Bjorn to approve minutes of the regular meetings held January 9, and January 23, 1992, with th-e following change to January 23, 1992 minutes, Page 5, last paragraph, deletion of the wording "no one spoke in opposition." MotiOn carried. *Commissioner Cohn was seated. Minutes, PC, 2/20/92 4.1 WALL AND LANDSCAP~ E PLANS - TENTATIVE TRACT 5432 Page 2' Staff report was given. No one was present to represent the applicant. Mr. Hardisty stated it was at the commission's discretion to either approve or continue this niatter. Motion was made by Commissioner Rosenlieb, seconded by Commissioner Messner to continue this item to the next regularly scheduled meeting of March 5, 19921 -Motion carried. Commissioner R0senlieb felt a motion should be made' to refer the issue of the rolled concrete cap to committee. She therefore made the motion, which was seconded by Commissioner Messner to send this issue to the subdivision committee with a'meeting already scheduled for March 4th. 4.2 WALL AND LANDSCAPE PLANS - TENTATIVE TRACT 5462 4.1 Staff report was given. Jeff Mills represented the applicant. He stated he agreed with the conditions of approval.- Motion was made by Commissioner Rosenlieb, seconded by Commissioner Bjorn to approve Wall and' landscape plans for Tentative Tract 5462 subject to conditions on Exhibit "A" attached to the staff report. Motion carried. WALL AND LANDSCAPE PLANs - TENTATIVE TRACT 5432 Gene Hosford stated he was late to this hearing due to unexpected traffic. He stated the applicant was in agreement with the recommendation of staff regarding the concrete cap. Motion was made by commissioner Messner, seconded by Commissioner Frapwell to reconsider this item. Motion carried. Responding t° a question by Commissioner Rosenlieb, Mr, Hosford said he is in agreement with all conditions'listed in exhibit "A". Motion was made bY Commissioner Rosenlieb, seconded by Commissioner AnderSon to approve Wall and landscape plans for Tentative Tract 5432,. subject to conditions on Exhibit "A" attached to the staff report. Motion carried. Minutes, PC,' 2/20/92 4.3 WALL AND LANDSCAPE PLANS - TENTATIVE.TRACT 5386 Page 3 4.4 Commissioner Anderson abstained from participating on this item due to a conflict of interest in that his firm has provided services to the applicant within the past 12 months. Staff report was given. Michael Dhanens represented the applicant. Regarding Item #5, Page 3 of 3 of Exhibit "A", he said a modification had been granted from the Board of Zoning Adjustment. Mr. Hardisty recommended the deletion of this condition. Commissioner-Rosenlieb felt with the color coding of the wall the appearance is enhanced. She stated she is still concerned about the wall height. Motion was made by Commissioner Rosenlieb, seconded by Commissioner ' Messner to approve revised wall and landscape plans for Tentative Tract 5386, subject to conditions on the Exhibit "A" attached to the staff report, with the deletion of Condition #5, Page 3 of 3 of Planning Department conditions. Motion carried. WALL AND LANDSCAPE PLANS - TENTATIVE TRACT 5489 ' o Commissioner Anderson abstained from participating on this item due to a · conflict of interest in that his firm has provided services to the applicant. Staff report was given. Michael Dhanens spoke on this item. Regarding Item #4, Page 3 of 3, he stated they had gone before the Board of Zoning Adjustment for approval on this item and asked that this condition be deleted. Motion was made by Commissioner Messner, seconded by Commissioner Rosenlieb to approve revised wall and landscape plans for Tentative Tract 5489, subject to conditions on Exhibit "A" attached to the staff report, with the deletion of Condition #4 on page-3 of 3. Motion carried. PUBLIC HEARING - CONDITION CHANGE - TENTATIVE TRACT 5386 Commissioner Anderson abstained from participating on this item due to a conflict of interest in that his firm has provided services to the applicant within the past 12 months. Minutes, PC, 2/20/92 6.1 Page 4 Commissioner Powers abstained from participating on this item due to a possible Conflict of interest. Staff report was given. PubliC-portion of the hearing was opened; no one spoke in opposition. Roger Mclntosh represented the applicant. He said they are no longer requesting deletion of the walls along the Commercially zoned portion. They agree with conditions of the staff report. The reason for requesting, deferment of improvements is that the fate of the specific plan alignment is unsure. Public portion of the hearing was closed. Responding to a question by Chairman Marino, Mr. Hardisty stated he eXPected if a redesign of the specific plan alignment takes place it will be back before the Commission. MOtion was made by Commissioner Bjorn, seconded by CommiSsioner Messner to approve the request for change of conditions of Proposed Tentative Tract 5386, as depicted on Pages 3 through 6 of the staff report. Motion carried. PUBLIC HEARING - TENTATIVE TRACT 5276 Commissioner Anderson abstained from participating on this item due to a bonflict of interest in that his firm has provided services to the applicant within the past 12 months. This item was continued from the January 9, 1992 meeting. Staff report was waived. Public portion of the hearing was reopened; no one spoke in opposition. Roger Mclntosh was present stating he requested continuance of this item due to the fact the traffic study will take three weeks for review and therefore asked for a continuance to the meeting of March 19, 1992. Motion was made by Commissioner Rosenlieb, seconded by Commissioner Bjorn to continue this item to the regular meeting of March 19, 1992. Motion carried. Minutes, PC, 2/20/92 Page 5 '6.2 PUBLIC HEARING,- TENTATIVE TRACT 5292 6.3 PUBLI~ HEARING - TENTATIVE TRACT 5428 Agenda item numbers 6.2 and 6.3 were heard concurrently since the applicant submitted a letter, requesting continuance on both items. Commissioner Anderson abstained from participating on this item due to a conflict of interest in that his firm has provided services to the applicant within the past 12 months.. Staff report was waived. Commissioner Powers abStained from participating on this item due to a possible conflict of interest. Public portion of the. hearing was opened; no one spoke in favor or opposition. 'Motion was made by Commissioner Rosenlieb, seconded by Commissioner Bjorn to continue this item to the next regular meeting of March 5, !992. Motion carried. 7. PUBLIC HEARING -- ZONE CHANGE #5122 -- TIME SET FOR PUBLIC HEARING ON AN APPLICATION BY MARTIN-MCINTOSH TO AMEND THE ZONING BOUNDARIES ON 22.9 ACRES FROM AN M-2 (GENERAL MANUFACTURING) ZONE TO A C-2 (COMMERCIAL) OR MORE RESTRICTIVE ZONE FOR PROPERTIES LOCATED AT THE SOUTHWEST CORNER OF COFFEE ROAD AND BRIMHALL ROAD. Commissioner Powers abstained from participating on this item due to a possible conflict of interest. Staff report was given. Public portion of the hearing was opened; no one spoke in favor or opposition. Roger McIntosh requested a continuance on this item to the next regular meeting of March 5, 1992. Motion was made by Commissioner Rosenlieb, seconded by Commissioner Bjorn to continue this item to the next regular meeting of March 5, 1992. Motion carried. Minutes, PC, 2/20/92 8. Page 6 AMENDMENT TO PLANNING COMMISSION BY-LAWS - CONDUCT OF 9.A) 9.B 9.B MEETINGS Mr. Hardisty recommended this item be continued. Motion was made' by Commissioner Rosenlieb, seconded by Commissioner Anderson to continue this item. Motion carried. -WRITTEN COMMUNICATIONS Mr. Hardisty stated a notice of public hearing had been submitted to the commission concerning the Metropolitan Bakersfield Parks and Recreation Improvement Plan. He also cited an update addressed to Commissioner Messner responding to his concern about the status of the master park plan. VERBAL. COMMUNICATIONS Status of Habitat ConservatiOn Plan " Mr. Hardisty cited'the letter submitted to the Commission outlining the update of the Habitat ConServation Plan. Panama #11 Annexation - Discussion regarding upholding of aPpeal Mr: Hardisty brought to the Commission's attention the upholding of the appeal by the City Council-of the Panama #11 Annexation prezoning. He asked whether the Commission wished the-proposed general plan hearing to go forward. Motion was made by Commissioner Rosenlieb, seconded by Commissioner Messner to rescind direction to staff to proceed with general plan amendment hearing .on this item. Motion carried. 'Minutes, PC, 2/20/92 10. COMMISSION 'COMMENTS Page 7 Commissioner Rosenlieb requested that the minutes be approved before they are distributed to anyone. If this is not possible she asked that they be marked draft. Mr. Hardisty said this can be done, explaining that often times when a case comes up at the Council an excerpt is taken from the minutes to be forwarded with a it. cOmmissioner Messner thanked staff for the update on the master park plan issue stating he agreed with its direction. Commissioner Frapwell brought up the discussion of the problem with respect to second entrances, Signage and monumentation of entrances asking if clear definition was-needed to adopt a policy. Commissioner Rosenlieb felt it is the intent of the subdivision committee to look at this at the March 4th meeting. Commissioner Marino said it was discussed with him as to whether the commission would like to send a delegate to attend meetings or follow items of interest. If a controversial item is being sent to the City Council perhaps a representative of the 'Commission could attend the meeting to monitor or answer questions: He felt the Metropolitan Bakersfield Park and Recreation Improvement Plan is the type of item that the Chairman of the Park Committee should attend and provide a report back to the Commission. 11.
