3. APPROVAL OF MINUTES
Motion was made by Commissioner Rosenlieb, seconded by Commissioner
Frapwell to approve minutes of the regular meeting held June 18, 1992 as
submitted. Motion carried.

Chairman Powers stated he would abstain on the following agenda items: 5.
(Comprehensive Sign Plan), 7.3 (Tentative Tract 5758), 7.4 (Tentative Tract 5738)
saying there Would not be a quorum and these items would automatically be
continued to' the next regular _meeting.
4. WALL AND LANDSCAPE PLANS - TENTATIVE TRACT 5623
Staff report was given.
Roger McIntosh represented the owner of subject property. He stated that in a
meeting with P.G.&E. and staff, the issue of fencing along White Lane had been
resolved with P.G.&E. not allowing a fence. He agreed with the staff report,
conditions of approval and memo of August 4, 1992 from the Planning
Department and requested no changes.
Commissioner Rosenlieb proposed that Planning Department condition #7 be
deleted because she felt if the easement cannot be fenced partial fencing would
not accomplish anything. She stated she would like to delete condition #2 as it
exists and replaCe it with the following: "The subdivision identification sign will
not be allowed." Mr. McIntosh stated he had no problem with this change.
Regarding Condition #5, she asked if this condition were eliminated would the
Parks condition cOVer the landscaping. ROb Cramer, City Parks stated it would.
Commissioner Rosenlieb was concerned that the landscaping On lot 7 should
match the landscaping proposed for the area east of Kilterbury. She asked if
landscaping for Lot 7 could be added as part of the homeowner's association
responsibility. Mr. Cramer stated his agreement with this. She proposed an
additional sentence to condition #8 as follows: "The landscaping installed on the
north side of Lot 7 will match the landscaping approved for White Lane, east of
Kilterbury Lane within the P.G.&E. easement and shall be maintained by the
homeowner's association." Mr. McIntosh stated his agreement with this addition.
Responding to a qUestion by Commissioner Rosenlieb, Mr. Cramer, City Parks
said under their condition they have the option of changing any plant material
shown on the plato
Motion was made by Commissioner Rosenlieb, seconded by Commissioner
Messner to approve wall and landscape plans for Tentative Tract 5623 subject to
conditions of approval on the attached Exhibit "A" as amended in the
memorandum from the Planning Department dated August 4, 1992, with the
following changes:
Planning Department, Condition #2 shall be changed to read as follows:
SubdivisiOn identification signs will not be allowed.

Planning Department Conditions #5 and #7 shall be deleted.

Additional language to be added to Planning Department Condition #4,
second bullet as follows:
The proposed block wall shall connect with the existing block wall at
the homeowner's lot on Gosford Road.
Condition Of memo dated August 4, 1992 from the planning Director to be
changed to read as follows:
Landscaping shall be installed by the developer and maintained by
the homeowner's association along the north side of Lot 7 to match
the landscape concept approved for White Lane east of Kilterbury
Lane' within the P.G.&E. easement.
She clarified on the changing of the bullet on Condition #4, the intent is
that the prOPosed block wall has to match in terms of the existing block
wall at that homeowner's lot. How it makes the transition from that point
would be left to the discretion of the Planning Director.
Motion carried.

FILE 5259 -- APPLICATION BY MARTIN-MCINTOSH TO AMEND THE
ZONING BOUNDARIES FROM A-20-A (AGRICULTURE-20-ACRE
MINIMUM LOT SIZE) TO AN R-1 (ONE FAMILY DWELLING) OR MORE
RESTRICTIVE ZONE FOR 46 ~-/- ACRES LOCATED SOUTH OF
BRIMHALL ROAD, EAST OF JEWETFA AVENUE, WEST OF CALLOWAY
DRIVE, NORTH OF THE CROSS VALLEY CANAL.
Motion was made by Commissioner Rosenlieb, seconded by Commissioner
FrapWell to hear Agenda Item #8.1) (Zone Change #5259) concurrently with this
item since they are related projects. Motion carried.

Public pOrtion of the hearing was opened.
Steve Hartsell, Schools Legal Service, represented Rosedale Union School District
and Kern Union High School District. He said an agreement between the
applicant and each of the school districts had been reached. He submitted a copy
of the letter outlining the language for inclusion into the action' at this hearing to
which each party has agreed.
Roger McIntosh represented the applicant: He asked for approval of the zone
change and cOntinUance of the tract map for two weeks, because they have
submitted a revised tentative map for staff's review.

Motion was made by Commissioner Frapwell, seconded by Commissioner
Messner to continue Tentative Tract 5544 to the next regular meeting of August
20, 1992. Motion carried.
MOtion was made by Commissioner Frapwell, seconded by Commissioner
Rosenlieb.to make findings set forth in the staff report and approve the zone
change as proposed and advertised and recommend adoption of same to the City
Council, subject to the following conditions:
Inclusion of the memo regarding Zone Change #5259, prepared August 6,
1992 and inclusion of the following condition:
This approval and issuance.of each building permit for the project
are expressly conditioned on full compliance with the terms and
conditions of the memorandum of understanding entered into
between the applicant and Rosedale Union School District dated
August 6, 1992 and a memorandum of understanding between the
applicant and the Kern High School District dated August 6, 1992.
Motion carried by the following vote:

Maurice Etchechury represented the property owner. He stated his agreement
with conditions of approval recommended by staff including the August 4, 1992
memo from the Planning Director, August 3, 1992 memo from Public Works and
August 6, 1992 memo from Public Works regarding their Condition #22.

Discussion reSUmed between Commissioner Rosenlieb and Mr. Etchechury
regarding the conditions of approval of the August 4, 1992 memo from the
Planning DireCtor. Ms. Marino, Attorney, stated the condition regarding the
construction of a fence as outlined in the memo is placed on this subdivision as a
mitigation measure under CEQA, if the applicant does not agree to this condition
as mitigation, an EIR could be required. Mr. Etchechury stated his agreement
with the added conditions of this memo.
Motion was made by Commissioner Rosenlieb, seconded by Commissioner
Frapwell to approve and adopt the Negative Declaration, to make all findings set
forth in the staff report, and to approve proposed Tentative Tract 5559 subject to
the conditionS outlined in the Exhibit "A", with amendments to findings and
conditions outlined in the memorandum from the Planning Department dated
August 4, 1992, and the memorandums from the Public Works Department dated
August 6, August 3 and July 8, 1992. Motion carried.

Motion was made by Commissioner Rosenlieb, seconded by Commissioner
Messner, to approve the reduction of lot frontage from 60 feet to 58 feet and 55
'feet as shown-on the tentative map. Motion carried.

ROger MCIntosh repreSented the property owner. He requested a two-week
continuance on this tract because of wording problems they have not been able to
resolve with staff. The continuance would allow time to resolve these issues.
Motion was made by Commissioner Rosenlieb, seconded by Commissioner
Frapwell to continue this item to the next regular meeting of August 20, 1992.

Joseph Leon stated he was in favor of this item asking the reason for the
continuance. Mr. Lee explained the reason was that two concurrent zone changes
exist on this project containing mitigation which the applicant has not agreed to
meet. This map cannot be approved without the proper zoning. The applicant
has requested a continuance until September 17, 1992. Mr. Hardisty responded
to a question by Mr. Leon saying the subject mitigation is in regard to school fees
and must be stipulated within approval of this map.
Motion was made bY Commissioner Rosenlieb, seconded by Commissioner
Messner to hear Agenda Item #'s 8.2 and 9.1 Concurrently with this item.

FILE 4969 -- PROPOSAL BY THE CITY OF BAKERSFIELD TO PREZONE
TO M-2 (GENERAL MANUFACTURING) OR MORE RESTRICTIVE ZONE
OF SAID PROPERTY LOCATED NORTH OF BRUNDAGE LANE TO
VIRGINIA AVENUE GENERALLY WEST OF INDUSTRIAL STREET
KNOWN AS THE-BRUNDAGE NO. 4 ANNEXATION.

Motion was made by Commissioner Rosenlieb, seconded by Commissioner
Frapwell to approve resolution making findings, presented in the staff report
approving the Negative Declaration and approving Prezoning #4969 to the City
designation of M-2 (General Manufacturing) with conditions as attached in
Exhibit "A'! and recommend same to City Council. Motion carried by the
follOwing roll call vote:

Referrals from City Council regarding Sign Ordinance revisions
B)
Mr. Hardisty cited requests had been received for amendment to the sign
ordinance from the Building Industry Association, Castle and Cooke and
Board of. Realtors. He recommended these be referred to the sign
ordinance Committee for study and recommendation to the full
Commission. Motion was made by Commissioner Rosenlieb, seconded by
Commissioner Messner to refer these items to the sign ordinance
committee. Motion carried.
Verbal
Mr. Kloepper submitted a report to each Commissioner, stating.a
workshop had been given before the City Council at the meeting of August
5, 1992 regarding Wastewater Treatment Plant 2 Option Study involving
future plans for the possibility of moving the City's wastewater treatment
functions to a location at Millux Road, west of Interstate 5. He said an
environmental review would probably be performed on the various
alternate sites previously identified. Mr. Hardisty said the County would
· have to make a general plan consistency finding for acquisition.
11. COMMISSION COMMENTS
Commissioner Rosenlieb stated the wall and landscaping issue which the
subdivision ordinance committee has been looking into is making progress. The
· Committee'is attempting to bring about an ordinance which .would allow staff
approval of wall and landscaping plans if they meet very standardized criteria. If
it does not meet the standardized criteria it would come before the Commission.
Regarding a question by her, Mr. Hardisty recommended that the zoning
ordinance address the situation of front yards of residential looking out onto C-2
property which is allowed in the current subdivision ordinance. He said staff
would ~draft something for the Commission's review. In response to a question by
her, Mr. Hardisty said he felt between now and the Thanksgiving holiday would
allow time to accomplish this.
Responding to a question by Commissioner Powers, Commissioner Rosenlieb said
the issues that are being worked on in committee regarding wall and landscape
are those which are routine.
