MINUTES OF THE REGULAR MEETING OF THE PLANNING COMMISSION OF THE CITY OF BAKERSFIELD Held Monday, May. 2, 1994, 12:15 p.m., City Council Chamber, City Hall, 1501 Truxtun Avenue, Bakersfield, California. 1. Approved as consent agenda item. PUBLIC HEARINGS - ORDINANCE AMENDMENTS 1. AMENDMENT TO SECTION 17.08.180 OF THE BAKERSFIELD MUNICIPAL CODE PERTAINING TO EXCLUDING SUBDIVISION AND NOISE ATFENUATION WALLS IN EXCESS OF 4 FEET HIGH FROM THE ZONE MODIFICATION REQUIREMENT AMENDMENT TO SECTIONS 16.16.010 AND 17.64.035 OF THE BAKERSFIELD MUNICIPAL CODE PERTAINING TO PROCEDURES FOR FILING TENTATIVE MAPS AND MODIFICATIONS OF MINIMUM LOT SIZE STANDARDS IN CONJUNCTION WITH A TENTATIVE MAP, AND FILING OF APPEALS OF SAiD MAPS AMENDMENT TO SECTIONS 16.28.170 C, D & H OF THE BAKERSFIELD MUNICIPAL CODE PERTAINING TO MINIMUM SIZE FOR LOT DEPTH, WIDTH, AND DOUBLE FRONTAGE LOTS AMENDMENT T© SECTIONS 16.28.170 I AND J OF THE BAKERSFIELD MUNICIPAL CODE PERTAINING TO PROCEDURES FOR APPROVING WALL AND LANDSCAPE PLANS. 5. Staff reports recommending approval were given. Minutes, PC, 5/2/94 ' Page 3 Commissioner Brady asked if a specific formula would be applied to the change to Section 16.28.170 O.F.3. Mr. Hardisty said this would be up to the discretion of the Planning Commission whether or not the overall design has a balance of open space and recreational amenity to justify a trade-off in lot size. Commissioner Brady was concerned that direction was not being given concerning requirements and that each project would be judged differently depending on who is voting. Mr. Hardisty said if a consistent pattern is seen, it would be common to propose an ordinance amendment. Commissioner Hersh asked Commissioner Brady if he were looking for a minimum that may act aS a guideline. Commissioner Brady responded he wanted to know if there were guidelines that this could reference. Responding to questions by Commissioner Hersh, Mr. Hardisty explained the 80 percent rule relating to small lot subdivisions, saying in the past developers were using this section to squeeze more lots within the subdivision. Commissioner Delgado explained for the new commissioners that_the small lot subdivisions have been a matter of concern for quite some time. He said a workshop had been held and asked that copies of the minutes of this workshop be provided. Responding to question by Commissioner Marino, Mr. Hardis~y said if the Commission wishes to delete the 80 percent rule they would need to direct staff to advertise this as a matter under consideration since it was not included in this review. Responding to question by Commissioner Boyle regarding the 80 percent rule, Mr. Hardisty said a subdivision cOuld be phased to provide a variety of housing types. FILE 5502 -- TIME SET FOR PUBLIC HEARING ON A REQUEST BY SKIP HARDY TO AMEND THE ZONING BOUNDARIES FROM A C-1 (NEIGHBORHOOD COMMERCIAL) ZONE TO AN R-1 (ONE FAMILY DWELLING) ZONE ON23.77 +/- ACRES AND TO AN R-l-CH (ONE FAMILY DWELLING-CHURCH) ZONE ON 2.5 +/- ACRES, CONTAINING A TOTAL OF 26.27 +/- ACRES FOR PROPERTY GENERALLY LOCATED EAST AND WEST OF WIBLE ROAD, NORTH OF BERKSHIRE ROAD, AND SOUTH OF THE ARVIN-EDISON CANAL Staff report recommending approval was given. Mr. Lee, staff planner said an additional memo had been submitted to the Commission regarding questions raised at the previous hearing on this item. This item was continued to the Thursday night meeting. Minutes, PC, 5/2/94 8. COMMUNICATIONS Page 4 A. Written 1) Planning Commissioners Orientation Program - diScussion. Mr. Hardisty said a copy of outline was submitted to the Commission. Responding to question by Commissioner Messner, Mr. Boyle Said he felt the previous workshop was a good presentation. Mr. Hardisty explained topics he wished to discuss. 2) Report and recommendation by the Central Business District Advisory Committee for Downtown Bakersfield Zoning and Development. (Referral from the City Council) Mr. Hardisty gave synopsis on this item.' B) Verbal 9. COMMISSION COMMENTS 10. Ao Committees Appointment t° sign committee to discuss off-site residential directional signs. Mr. Hardisty explained the necessity for this appointment saying this should be made a Standing committee. ADJOURNMENT.
