Commissioner Andrew stated he would abstain on this item because he is
marketing proper.ties for the subdivider.
Commissioner Rosenlieb gtated she would abstain due to a conflict of interest
because one of the owners of subject property has been a source of income to her
within the last year. ~
This item was continued tb the following Thursday evening meeting due to a lack
of quorum:

CommisSioner Andrew stated he had marketed properties in the area and
received commissions in the. last year, therefore he would abstain on this item.
Chairman Powers said he :would abstain on this item due to a conflict of interest.

AND ASSOCIATED ZONE CHANGE #5542
Commissioner Slocumb stated he had previously abstained on these items due to
a conflict of interest.
Commissioner Delgado abstained on this item.
Due to lack of quorum, staff report was not given and this matter was continued
to the Thursday meeting.

Commissioner Andrew abstained on this item beCause he markets properties
within 300 feet of subject site.

Commissioner Slocumb said he was not present at the previous hearing on this
item, therefore would have to abstain.
Mr. Hardisty requested that this item be dropped from this agenda and carried to
the next cycle. This item ~Was continued to the Thursday meeting.
6. ORDINANCE ADDING POLICIES AND PROCEDURES FOR ALLOWING.
SECOND DWELLING UNITS AS A PERMITTED USE IN RESIDENTIAL
ZONES CONSISTENT WITH THE PROVISIONS OF SECTION 65852.2 OF
7;
THE CALIFORNIA GOVERNMENT CODE (OR. 17.65-94).
Staff report was given.
Responding to question by Chairman Powers, Mr. Eggert said staff was concerned
about the second unit being constructed at the same time as the main unit. He
said the intent was that a second unit be somewhat of an infill.
Mr. Hardisty gave exampl~ of a second unit being built simultaneously with the
main house saying it crea~ed considerable problems with the neighborhood. He
said State law outlines criteria, which if present, must allow the granting of this
permit. :
Responding to question by Commissioner Rosenlieb, Mr. Hardisty said the
conditional use permit process would be used in the event a home has burned
and the applicant wants to construct a second dwelling unit at the time of
reconstruction.
COMMUNICATIONS
A) Written
Commisgioner Rosenlieb stated she had received a memo regarding
postponement of a deposition, but she had not been notified of the
deposition. Mr. Sherfy said the city received numerous requests for
depositions and immediately moved to have this halted, therefore if no
notification was given it was because it was worked out very quickly. He
said unless further notification is given there was nothing to be concerned
about.

8. COMMISSION' COMMENTS
Commissioner Rosenlieb Commented on previous discussions regarding amenities
and lack of amenities in R-2 zones where single family detached homes are being
constructed. She felt it was critical to the community that this item not die in a
committee. She recalled a workshop on February 3, in which the commishon
agreed on a proposed change to an ordinance, stating it has not come forth. She
felt as if a window of opportunity may have closed on an issue the commission
has diligently sought. She stated her deep disappointment that this issue has
again fallen by the wayside.
