Motion was made by Commissioner Marino, seconded by Commissioner Hersh to appoint Commissioner Andrew ~/s acting chairperson. Motion carried. 1. No one made any public Statements at this time. Chairman read the notice of right to appeal as set forth on the agenda. 3. CONSENT AGENDA ITEMS None Minutes, PC, 2/14/94 4. PUBLIC HEARING - ZONE CHANGE #5541 -- APPLICATION BY Page 2 MARTIN-MclNTOSH ENGINEERING TO AMEND THE ZONING BOUNDARIES FROM AN A (AGRICULTURE) ZONE TO AN R-3 (LIMITED MULTIPLE FAMILY DWELLING) ZONE ON 3.49 +/- ACRES LOCATED WEST OF THE SOUTHERLY EXTENSION OF EXISTING OLD RIVER ROAD ALIGNMENT, EAST OF THE WEST SECTION LINE OF SECTION 17, T.30S., R.27E., M.D.B.&M., APPROXIMATELY 700 FEET SOUTH OF CAMPUS PARK DRIVE. Staff report was given. CommissiOner Marino stated he would not participate on this item at this time and may abstain at the Thursday hearing. This item was continued t° the Thursday night meeting. RESOLUTION VACATItNG A PORTION OF A WAIVER OF DIRECT ACCESS FROM souTH ALLEN ROAD FROM SHOPPING CENTER. LOCATED AT 13001 STOCKDALE HIGHWAY Staff report was given. Public portion of the hearing was opened. Mr. Hardisty said the driveway has been constructed and this would allow it to remain in legal conformance. He stated the previous case may be withdrawn, leaving this as possibly the only item on the agenda for Thursday evening. He asked that an exception be made to the normal Monday proceedings and that this item be approved. If the previous item is withdrawn the meeting will be canceled and the commission will be notified. Motion was made by Commissioner Slocumb, seconded by Commissioner Hersh to make findings as stateff, in staff report and adopt resolution approving vacation of a portion of the waiver:of direct access as described in the project description stated in the staff report, and direct staff to record the resolution with the County Recorders Office.
