Staff report was given. Regarding the retention basin' not being fenced on the corner, Commissioner Rosenlieb asked if staff has liability concerns, to which Mr. Hardisty responded that the design is to limit the depth of water to less thafi 18 inches at all times which waives the fencing requirement. Rosenlieb, Mr. Hardisty recommended that a condition be added for deferral of the block Wall perhaps with an agreement posting .a bond ifor its construction. Mr. Hardisty said language would be developed fOr Thursday's meeting. PUBLIC HEARING - CHANGE OF CONDITIONS - TENTATIVE TRACT 5688 ',: Commissioner 'Andrew abstained because he was. involved in the property sale on this item. staff report was given. PUBLIC HEARING - TENTATIVE PARCEL MAP 9899 Chairman Powers stated Agenda Item #9 would be heard concurrently with this item. PUBLIC HEARING - ZONE CHANGE 5452 ; Chairman Powers stated he was not at the previous hearing on this item, therefore would abstain. He stated Commissioner Messner will be listening to the tape of this hearing and would be chairing the hearing on Thursday. Minutes, PC, 1/31/94 i page 3 Commissioner Delgado said he was absent from the meeting at which this was originally heard and would be abstaining. Commissioner Rosenlieb asked that the staff report include the recommendation from the previous committee meeting on this item. Staff report was given. Mr. Hardisty said the committee has been trying to resolve several unresolved issues such as the requirement for public access to and along the ri~er, the Kern River Plan's policies toward the development of trails systems to serve multiple purposes, the treatment of the bluff with respect to its position within the development. He said staff concurred with the recommendation that the zoning be granted in part, however not grant it on those areas adjacent to the river. Commissioner Slocumb sa'id regarding the term in the staff report referred to as "pedestrian access easement'' saying it Was his understanding the committee was discussing "public access easement.'' The committee was not trying to define what public access meant. Commissioner Rosenlieb ~aid she was concerned that if the modification is not communicated to the appl:icant soon this hearing will be delayed .again. She said she did not want to see thlis item delayed again at the city's request. Regarding Planning Department condition #8 she asked who would precisely define the proposed Route 178 freeWay alignment corridor. Mr. Hardisty said the State has a route described by cent~rIine for this location, the ci. ty is looking for the precise mapping of the route as Well as right-of-way requirements for it. The definition would be performed in conjunction with Public Works, CalTrans and the applicant. Regarding Planning Department Condition #9 she said it has been almost 3 months since she was told the slope ordinance would come before the Commission for review and asked what the status of this was. Mr. Hardisty said it has been drafted and is':being reviewed by himself and the Attorney's Office. She encouraged that this item be hurried along. Mr. Hardisty indicated it would be forthcoming. Responding to question by Commissioner Rosenlieb, Mr. Hardisty said he is not 'aware of any earthquake faults on this property. She felt possibly an ordinance should be created to address earthquake fault setbacks. Commissioner Rosenlieb asked for Thursday's hearing that an extended staff report be given because of the tremendous amount of public interest regarding the river access issue. She indicated she had received a number of letters which she would share with the entire commission, saying she felt these letters indicated a feeling that the commission has a blank table with which to work, saying she would appreciate the staff report explaining some of the constraints under which the commission is working with regard to the access issue. ...~ ~' .~Minutes, PC, 1/31/94 . page 4 Commissioner Marino was' concerned about an A zone requiring 20 acre parcels, asking that staff be sen sitive to this in preparing a more extensive staff report and committee report. Mr. Hardisty Called attention to letters received. Chairman Powers asked that his new phone number be published. Mr. Hardisty said this would be' changed in the directory. 10. AMENDMENTS Responding to question b~ Chairman Powers, Ms. Marino said this ·would be a ~discussion of the commission's options with respect to the committee structures.
