Because both the chair and vice-Chair were absent, Commissioner Marino chaired this meeting. 1. CONSENT AGENDA ITEMs None Minutes, PC, 1/18/94 APPROVAL OF MINUTES Page 2 No action taken 5.1 PUBLIC HEARING - TENTATIVE PARCEL MAP 9899 Responding to question by Chairman Marino, Mr. Hardisty said hearing should be held on Agenda Item #7 concurrently. 5.2 PUBLIC HEARING - ZONE CHANGE 5452 Commissioner Sl°cumb agked that the staff report be waived since a request was received for continuance On this item. PUBLIC HEARING - TENTATIVE PARCEL MAP 10054 Commissioner Marino-abStained on this item due to a conflict of interest in that he is employed by the applicant. He turned the chair over to Commissioner Andrew. Staff report was given: Responding to Condition #19, Mr. Kloepper said the applicant is requesting that signals be allowed at the ieferenced location. Discussion continued regarding signalization, Mr,. Kloepper stating the reason for the Wording of Condition #'s 19 and 20 so that they can be installed without disruption to the flow of traffic and to cover the 'cost of operation and maintenance. The city would not consider signalizing these intersection without the development of this shopping center. Regarding concern of neighbors to the east, Commissioner Rosenlieb asked that staff ensure for the Thursday night hearing that no conditions were placed on this property during the zone change phase that are not reflected in this staff.report. Responding to a question by Commissioner Rosenlieb regarding Condition #24, Mr. Kloepper said it is an! advisory condition informing the seller of the property and developer of an outstanding obligation which involves the most northerly tower on the property. Responding to a question by her regarding Condition # 18, Mr. Kloepper said the reason for recommendation of deletion of a sentence per the January 14th memo being that this is an off-site portion of road which is a one-lane city-maintained road. The developer argued and staff agreed that it is not his obligation to bring; an off-site portion of road to an acceptable standard before he makes a connection to it. Minutes,~ PC, 1/18/94 e Page 3 Commissioner Slocumb felt the road maintenance is project related, however felt the community as a whole also benefits, asking if any thought has been given to apportioning the cost. Mr. Kloepper said there has been none. puBLIc HEARING - TENTATIVE TRACT 5721 Staff report was given. Commissioner Rosenlieb said regarding the staff report that staff had recommended a Conditioni requiring the design of the emergency access to be apprOVed by the Fire Department, Planning Director and City Engineer, saying she could not find this condition, asking that it be added for Thursday night. Regarding the comment in the staff report that the applicant is requesting the wall and landscaping match that across the street, she felt language should be added to this effect in the~form of a condition. 8. GENERAL PLAN CONSISTENCY FINDING FOR THE PROPOSED SALE OF SURPLUS LAND COMPRISING .21 ACRES WEST OF CASTRO LANE AND NORTH OF WILSON ROAD. 10. Staff report was given.
