Commission adjourned to City Manager conference room and met with legal
counsel on existing litigation regarding Southwest Community Action Committee
and Jill Kleiss vs. City of Bakersfield, et. al. (Marketplace).

PUBLIC HEARING - EXTENSION OF TIME FOR VESTING
TENTATIVE TRACT 5716 (PHASED)
Staff report was given.
City Attorney, Judy Skousen addressed Commission apprising them of
bankruptcy proceedings and this being the Unibell portion of the tract,
they are subject to a development agreement which requires a golf course,
lakes and parks, and the new owners have no intentions of putting in a golf
course, lakes and parks, therefore this needs to be looked at more closely.
This item was continued to the Thursday night meeting.
PUBLIC HEARING - VESTING TENTATIVE TRACT 5425
Staff report was given.
Jack LaRochelle informed Commission that the condition regarding secondary
access will be changing, and the Fire Department will be looking at that and have
a new condition for Thursday night.
This item will be continued to the Thursday night meeting.
GENERAL PLAN CONSISTENCY FINDING
Staff report was given recommending approval.
This item was continued to the Thursday night meeting.
