Chairman read the notice of right to appeal as set forth on the agenda.
Mr. Hardisty stated Commissioner Delgado informed staff that he would be
absent from this hearing and he did not know whether he would attend
Thursday's hearing.

Commissioners Brady and Boyle stated they would abstain from participating on
this item because their firm represents the applicant.
Mr. Gauthier said a staff report would be available at the Thursday hearing,
therefore this item should be dealt with at that time.
4. FINAL DEVELOPMENT PLANS FOR UA THEATER AT EAST HII.I.S
MALL

This item will be acted on at the Thursday hearing.
Mr. Hardisty reminded the Commission that 4 affirmative votes are needed to
recommend approval of general plan amendments.
PUBLIC HEARINGS - GENERAL PLAN AMENDMENT 4-94, SEGMENT I1
AND ZONE CHANGE #5568 - REQUEST BY DAVID MILAZZO, AIA TO
AMEND THE LAND USE ELEMENT OF THE METROPOLITAN
BAKERSFIELD 2010 GENERAL PLAN BY CHANGING THE LAND USE
DESIGNATION FROM HMR (HIGH MEDIUM DENSITY RESIDENTIAL)
TO GC (GENERAL COMMERCIAL) ON 15.43 ACRES FOR PROPERTY
LOCATED ON THE NORTHWEST CORNER OF STINE ROAD AND
PANAMA LANE.
Chairman Andrew stated a conflict of interest, turning the chair to Commissioner
Marino in Commissioner Delgado's absence.
Staff report recommending disapproval was given. Mr. Gauthier stated a
continuance had been requested by the applicant.
Public portion of the hearing was opened.
Responding to questions by Commissioner Brady, Mr. Gauthier verified that
there are parcels large enough for a major shopping center at Gosford Road and
Panama Lane, at the southwest corner of Stine Road and Panama Lane and at
the corner of Wible Road and Panama Lane.

Chairman Andrew abstained because of a possible conflict of interest.

CASTLE & COOKE TO AMEND THE LAND USE ELEMENT OF THF.
METROPOLITAN BAKERSFIELD 2010 GENERAL PLAN BY CHANGING
THE LAND USE DESIGNATION FROM ER (ESTATE RESIDENTIAL)
AND OS (OPEN SPACE) TO LR (LOW DENSITY RESIDENTIAL), OR
MORE RESTRICTIVE DESIGNATION ON 166 +/- ACRES FOR
PROPERTY GENERALLY BOUNDED BY BRIMHALL ROAD, THEE

Mr. Gauthier said a written staff report was not available because the comment
period fOr environmental review will not be over until after Thursday. He gave a
detailed description of the project.
Mr. Hardisty said because there are members of the public wishing to speak on
this item, a summary statement of the proposal with relevant maps would be
provided to the Commission for the Thursday meeting.
CommisSioner Marino asked for background regarding the discussion of subject
property.during the 2010 Plan hearings.

Commissioner Marino said he may have a conflict of interest on this item because
of ownership in a downtown building.

STREET CORRIDOR SPECIFIC PLAN FOR PROPERTY GENERALLY
LOCATED BETWEEN BERNARD STREET, EAST CALIFORNIA AVENUE,
WASHINGTON AVENUE AND UNION AVENUE.

VIII -- REQUEST BY CITY OF BAKERSFIELD TO ESTABLISH SPECIFIC
PLAN LINES FOR MORNING DRIVE PALADINO DRIVE AND AN

"UNNAMED COLLECTOR," IN NORTHEAST BAKERSFIELD BETWEEN
PALADINO DRIVE AND ALFRED HARRELL HIGHWAY.
Staff report recommending approval was given.
Responding to question by Commissioner Boyle, Ms. Marino said commissioners
are required to do what is possible to become aware of possible conflicts of
interest with 300 feet of a property in question.
Public portion of the hearing was opened.
Mr. Hardisty said a list of property owners within 300 feet of the alignment would
be provided.
Responding to question by Commissioner Marino, Mr. LaRochelle said he would
provide information regarding active wells within the proposed rights-of-way
areas. Commissioner Marino also asked if idle wells exist what steps could the
city take to abandon these wells.
Commissioner Brady cited the study regarding alignment alternatives asking why
"D" and "E" were eliminated. Mr. Hardisty said the traffic engineer would
respond to this at the Thursday meeting.

Mr. Hardisty said at the following Council meeting a recommendation
would be forwarded for reclassification of Mr. Grady as the Planning
Director so he could better concentrate on his role of department head.
