HomeMy WebLinkAbout11/28/94MINUTES OF THE REGULAR MEETING OF THE PLANNING COMMISSION OF THE CITY OF BAKERSFIELD Held Monday, November 28, 1994, 12:15 p.m., City Council Chamber, City Hall, 1501 Truxtun Avenue, Bakersfield, California. 1. ROLL CALL COMMISSIONERS: Present: JEFF ANDREW, Chairperson DOUG DELGADO, Vice-Chairperson MATHEW BRADY KENNETH HERSH JIM MARINO ROBERT ORTIZ DARREN POWERS, Alternate Absent: STEPHEN BOYLE ADVISORY MEMBERS: Present: LAURA MARINO, Assistant City Attorney JACK LaROCHELLE, Engineer IV DENNIS FIDLER, Building Director STAFF: Present: JACK HARDISTY, Planning Director JIM MOVIUS, Principal Planner JIM EGGERT, Principal Planner MIKE LEE, Associate Planner LAURIE DAVIS, Recording Secretary 2. PUBLIC STATEMENTS No one made any public statements at this time. Chairman read the notice of right to appeal as set forth on the agenda. 3. CONSENT AGENDA ITEMS None Minutes, PC, 11/28/94 4.1 PUBLIC HEARING - TENTATIVE TRACT 5464 4.2 Page 2 Commissioner Powers refrained from voting on this item in Commissioner Boyle's absence because he lives in the neighborhood. Staff report recommending approval was given. Public portion of the hearing was opened. Regarding Building Department condition #4, Mr. Fidler asked that it be amended to add the following wording "or approval by the Building Director" to the end of the first sentence after the word "consultant". This item was continued to the following Thursday hearing. PUBLIC HEARING - TENTATIVE TRACT 5680 (REVISED) Staff report recommending approval was given. Regarding Building Department condition #4 Mr. Fidler asked that it be amended to add the following wording "or approval by the Building Director" be added to the end of the first sentence after the word "consultant". Public portion of the hearing was opened. Responding to question by Commissioner Brady, Mr. Hardisty said a revised condition regarding school mitigation should be available at the Thursday hearing. This item was'continued to the following Thursday hearing. PUBLIC HEARING - PROPOSED ORDINANCE AMENDMENT TO TITLE 17 OF THE BAKERSFIELD MUNICIPAL CODE ADDING CHAPTER 17.25 (CENTRAL BUSINESS) ZONE DISTRICT AND AMENDING CHAPTER 17.26 (COMMERCIAL CENTER) ZONE DISTRICT Commissioner Marino abstained from participating on this item because he owns property in the downtown area which may create a conflict. Staff report recommending approval was given. Responding to question by Chairman Andrew, Mr. Hardisty said the committee's work on this item is completed, the public hearing process and public review by the CDDA are necessary at this point. The efforts on this issue have been to expand downtown zoning to be much more inclusionary. Minutes, PC, 11/28/94 Page 3 Responding to question by Chairman Andrew, Mr. Hardisty explained regarding heights of buildings the difficulty of placing tall buildings in the downtown area. Commissioner Brady asked for possible reworking of the following sentence, under the heading "Sculptured building tops": "As building increase in height, the more visible upper portion is shaped to appear increasingly slender and more ornamental." Mr. Hardisty said this statement would be reworded to be more straight-forward. Responding to question by Commissioner Brady regarding the definition of public art, Mr. Hardisty said the only thing that can be regulated by the city is size and location. He felt what would likely happen is that when a plan is submitted for approval if it is not.felt to be "art" it would be appealed to the Commission. o WORKSHOP - DEPARTMENT ROLES IN THE REVIEW OF DEVELOPMENT PROJECTS This item to be handled at the Thursday meeting. 7. COMMUNICATIONS A) Written None B) Verbal Mr. Hardisty welcomed Commissioner Ortiz to the Commission. Responding to question by Commissioner Powers, Mr. Hardisty went over the general plan amendment cases for the December 15, 1994 meeting, stating a list would be provided for the Thursday meeting. 8.
