2. PUBLIC STATEMENTS
John Peterson submitted a speaker's card. He wanted to speak on Amendment
3-94, Segment VIII. Assistant City Attorney, Laura Marino informed him that
public testimony must be taken on Thursday night.
Roger McIntosh also submitted a speaker's card for Agenda Item #4 in that he
would not be present at Thursday night's meeting, and therefore would like to
have this item acted on today. He requested that Planning Commission direct
staff to accept an application for a Zone Change to R-2 for an 18.76 acre parcel
at the southeast corner of White Lane and Mountain Vista Drive.
Chairman read the notice of right to appeal as set forth on the agenda.

1. Agenda Item #5 - Determination of Adequate Access (Parcel Map Waiver

REQUEST FOR CONSIDERATION OF RE-APPLICATION FOR A ZONE
CHANGE ON PROPERTY LOCATED AT THE SOUTHEAST CORNER OF
WHITE LANE AND MOUNTAIN VISTA DRIVE
Staff report denying request to waive the non-reapplication period was given.
Commissioner Marino commented that the original application was for a General
Plan Amendment and a Zone Change that would have allowed 17 units per acre,
R-2 zoning and currently it is being requested as a zone change that would not
Change the General Plan and that would limit it to 10 units per acre.
Assistant Planning Director Stanley Grady replied this request is for a zone
change without the general plan amendment.
Commissioner Marino also commented that the existing density is LMR which is
10 units per acres. The General Plan Amendment would have increaSed the
density to HMR increasing it to 17 units per acre to concurrent zone change to
R-2 would have also increased the density to 17 units per acre, and the request is
for R-2 without a general plan amendment in which he would be limited to the
LMR density which would be a maximum of 10 units per acre. He further stated
that this does not appear to be the same application that was filed before.
Mr. Grady replied "that whether or not it is the same application, it is the same
zone change, they are still asking for R-2 zoning.
Commissioner Powers stated he had a conflict of interest on this item and also on
Item #5.
Commissioner Hersh stated he would like to read Council minutes, and act on
this Thursday night.'
Commissioner Boyle stated he may have a conflict of interest, and if this is going
to be voted on, he would excuse himself. There were some "cc's" on the letter
from Martin-McIntosh that he would have to check out.
Commissioner Marino suggested a two-week continuance unless there is a
problem with expediency.

Mr. McIntosh stated that at the very least the request for zone change should be
reheard in March, what is being requested is that the application be accepted and
processed now. There are other parcels that this same property owner owns in
Tevis Ranch that could be tied in with this parcel and do some good planning
such as a proposal for a park.
Commissioner Marino made the motion that staff accept the application.
· Ms. Marino informed Commission they would have to make a'finding that public
~, interest must be served by re-consideration of a new hearing.
Commissioner Marino made the findings that this property is associated with
other properties and there is a possibility that the city could reek some public
benefit, and public interest is served in re-hearing this project, and the
information provided by the applicant is completely different than what was
previously submitted.
Motion died for lack of a second.
