A RESOLUTION ORDERING THE VACATION OF THE
FUTURE ALLEY EASEMENT RESERVED IN TRACT NO.
1348 IN THE CITY OF BAKERSFIELD.
WHEREAS, on WEDNESDAY, DECEMBER 18, 1996, the Council of the City
of Bakersfield, pursuant to the provisions of the "Public Streets, Highways and Service Easements
Vacation Law," being Chapter 3 of Part 3 of Division 9 of the Streets and Highways Code of the
State of California, passed and adopted its Resolution of Intention No. 1155 declaring its intention
to order the vacation of the Future Alley easement reserved in Tract No. 1348 in the City of
Bakersfield; and
WHEREAS, for the above-described project, it was determined that the proposed
vacation is exempt from CEQA according to Section 15061(b)(3) in that there is no possibility that
the Future Alley Easement vacation will have a significant effect on the environment; and
WI~EREAS, at its meeting on November 21, 1996, the vacation was duly heard and
considered by the Planning Commission and was found to be consistent with the Metropolitan
Bakersfield General Plan.
WHEREAS, said Council did fix a time and place for hearing all persons interested
in or objecting to said proposed vacation, which hearing was held on Wednesday, January 22,
1997, after notices were duly published and posted as required by law.
NOW, THEREFORE BE IT RESOLVED by the Council of the City of Bakersfield
as follows:
1. The above recitals are true and correct and are incorporated herein.
The Future Alley easement reserved in Tract No. 1348 in the City of
Bakersfield, County of Kern, State of California, more particularly described
as all of the 20 foot wide Future Alley easement shown as the south 20 feet
of lots 1 through 5 and 50 through 54 of Tract No. 1348 filed for record in
Book 5 of Maps, Page 188 in the Office of the Kern County Recorder, is
unnecessary for present or prospective public use or public alley purposes and
is hereby vacated, subject to the conditions enumerated herein.
A non-exclusive easement shall be reserved for City sewer main purposes in,
under, over and upon that portion of above described alley lying within said
lots 3, 4 and 5.
The existing 10 foot wide public utilities easement overlaying the south 10
feet of above described alley shall not be vacated by this action.
The City Clerk shall certify to the passage of this Resolution and shall cause
a certified copy hereof, attested by the Clerk under the seal of the City, to be
recorded in the Office of the County Recorder of the County of Kern,
Caiifomia.
