2. PUBLIC STATEMENTS
No 'one made any public statements at this time.
Chairman read the notice of right to appeal as set forth on the agenda.
Mr. Grady stated Agenda Item #6.1 -'Tentative Tract #5716 would be removed
from the agenda because the applicant requested staff make a determination of
whether or not they had spent the requisite amount of funds which would by law
give them an automatic extension. The analysis has been made and the proper
amount of funds have been spent for off-site improvements.
Mr. Grady stated a request had been received from the applicant for Agenda
Item #6.2 to be placed on the consent calendar; however because some extensive
changes were required he recommended the commission leave this item in its
proper place on the agenda.

3. CONSENT AGENDA ITEMS
The following items were added to the consent agenda at the request of the
applicants:
Agenda Item #9A. - General Plan Consistency Finding - vacation of public
street right-of-way of Garland Avenue, east of Wible Road.
Agenda Item #9B. - General Plan Consistency Finding - vacation of the
pedestrian way between Lakeview Avenue and South Haley Street, east of
the East 3rd Street intersection, in Tract No. 1286.
4. APPROVAL OF MINUTES
Action on this item was continued to Thursday's meeting.
5.1 PUBLIC HEARING - VESTING TENTATIVE PARCEL MAP 10118

Chairman Andrew stated because he is marketing property for the applicant he
would not participate on Agenda Item #'s 5.1 and 5.2.
Staff report recommending approval was given.
Public portion of the hearing was opened; there were no comments made by the
Commission.

PUBLIC HEARING - EXTENSION OF TIME - TENTATIVE TRACT 5716
Chairman Andrew stated because this item was qualified through the Subdivision
Map Act for an automatic extension it would not be heard at this time.

6.2 PUBLIC HEARING - EXTENSION OF TIME - TENTATIVE TRACT 5436

Commissioner Dhanens abstained on Agenda Item #'s 6.2, 6.3 and 6.4 because
his wife is employed by the subdivider.
Chairman Andrew abstained on Agenda Item #'s 6.2, 6.3, 6.4 because he has
received income from the subdivider in the last year. He also abstained on
Agenda Item #7.1 because he is marketing property for the subdivider.

Responding to question by Commissioner Hersh, Ms. Marino stated she had
nothing to add to previous information given on the Riverlakes Ranch issue.

PUBLIC HEARING - TENTATIVE TRACT 5426
Staff report recommending approval was given.
Public portion of the hearing was opened.
Commissioner Hersh recalled a problem in this area with pipeline easements,
stating he would raise this issue at Thursday's meeting.
Responding to question by Commissioner Boyle, Mr. LaRoChelle stated block
lengths are considered individually, this particular situation allows for changes in
design to allow the standard to be met.

Mr. Lee responded to question by Commissioner Dhanens regarding residential
lots backing up to canals, stating this situation is different than the situation on
this map because a requirement has been placed on this map for a chainlink
fence along the north side of the pipeline easement which satisfies the ordinance
requirement. Commissioner Dhanens asked if the general plan amendment
referenced with respect to parks only addressed the north side of Ming Avenue or
the entire Seven Oaks development. Mr. Grady said this amendment addressed
both north and south sides of Ming. The city is in the process of executing an
agreement with Castle and Cooke that would put a mechanism in place to ensure
construction of the parks.

8. PUBLIC HEARING - AMENDMENT TO TITLE 15 OF THE BAKERSFIELD
MUNICIPAL CODE - TRANSPORTATION DEVELOPMENT FEES FOR
COMMERCIAL, INDUSTRIAL AND RESIDENTIAL PROJECTS.
Mr. LaRochelle submitted the written staff report to the Commission and stated a
verbal report would be given on Thursday.

Commissioner Boyle asked for a breakdown of transportation monies from
sources other than subject fees for Thursday's meeting.
Commissioner Hersh asked for information concerning the pros and cons of
existing regional impact fees and impact study cost per project vs. the proposed
fees which eliminates the per project traffic studies.
