Items will be voted on Thursday night. 4.2 Public Hearing Items 4.2a Approval of Extension of Time for Vestinq Tentative Map No. 6033 (SmithTech, USA, Inc.) (Ward 4) 4.2b Approval of Extension of Time for Vestinq Tentative Map No. 5923 (Porter- Robertson) (Ward 4) Staff report given recommending approval with conditions. There were no Commissioner comments or questions. Items will be voted on Thursday night. PUBLIC HEARINGS - General Plan Amendments, Circulation Element Amendments and Associated Rezoninqs: 5.3a&b) General Plan Amendment/Zone Chanqe 02-0837 (Frank Trippichio) (Ward 6) Staff Report given recommending approval with conditions. Commissioner Gay asked if the same owner owned the narrow strip of R-1 CH (One Family Dwelling-Church) on the easterly side of the property? Mr. Gauthier said "no." Commissioner Gay asked if Alum will continue through the property? Ms. Shaw said no, the concern was that Alum Road would be too long, too straight and too fast if it were connected to Akers Road. Alum will be a cul-de-sac. Commissioner Sprague asked if secondary access will be dealt with when the site plan comes forward? Mr. Grady said if it is necessary it will be evaluated at that time. Commissioner Blockley asked if there will be an outdoor amplified sound system? Mr. Grady said he would have an answer by Thursday night. Minutes, PC, January 13, 2003 Page 3 There were no other Commission comments. Item was continued until Thursday night. 5.4a&b) General Plan Amendment/Zone Chanqe 02-0853 (G.W. Wilson) (Ward 3) Staff Report given recommending approval with conditions. Commissioner McGinnis asked Mr. Walker for a synopsis of the traffic situation. Mr. Walker said basically they want to turn Height Street into a two-way street. CalTrans and the city are discussing the options. Commissioner McGinnis asked if Height Street becomes a two-way street, if it would have access to the on-ramp at Mt. Vernon? Mr. Walker said no it would terminate a few hundred feet west. Commissioner McGinnis asked Mr. Walker which in his opinion would be best and he said he would prefer it as is. Commissioner McGinnis said he thinks it should be kept as simple as possible. He would like to see a PUD overlay on the project so they can keep a closer look as the project goes forward. Commissioner Tkac asked what the density is for R-37 Mr. Gauthier said it is 17 to 29 a net acre. Commissioner Tkac said he agrees with having a PUD placed on the project. Commissioner Gay asked if a trash or long term maintenance problem would be created along the two fence lines near the 99¢ store and asked for staff to find out who owns the property. Commissioner Blockley asked what amenities should be expected for a project like this? Mr. Grady said that under straight zoning, there are none. Commissioner Blockley said he is also leaning toward a PUD. There were no other Commission comments. Item was continued until Thursday night. 5.5a&b) General Plan Amendment/Zone Chanqe 02-0939 (Porter-Robertson Eng) (Ward 4) Staff Report given recommending approval with conditions. There were no Commission comments. Item was continued until Thursday night. 5.6) General Plan Amendment 02-0958 (Mclntosh & Associates) (Ward 4) Staff Report given recommending the Commission deny this project. There were no Commission comments. Item was continued until Thursday night. 5.7a&b) General Plan Amendment/Zone Chanqe 02-0959 (Rosedale Construction Co.) (Ward 4) Staff Report given recommending approval with conditions. Minutes, PC, January 13, 2003 Page 4 Commissioner Ellison pointed out that Appendix G, Page 8 states that the project is not located in a state designated oil field but that in fact it is and there are five abandoned wells in this area that needs to be addressed. He then recognized Joe Austin, from the Division of Oil and Gas, who presented a letter to the Commission regarding the wells. There were no other Commission comments. Item was continued until Thursday night. 5.8a&b) General Plan Amendment/Zone Chanqe 02-0961 (Bakersfield Redevelopment Agency) (Ward 2) Staff Report given recommending approval with conditions. Commissioner McGinnis asked if it will be an age restricted development? Mr. Gauthier said there is nothing to indicate that. Commissioner McGinnis asked about soil contamination and Mr. Gauthier said they identified the problems and have taken care of them. It is ok now. Commissioner McGinnis said he would like to see a PUD placed on it since it is so unique. Mr. Gauthier said that the pictures show what the project looks like and it will be built like the pictures. Site plan review has placed their conditions on it. Commissioner Gay asked about the parking situation. Mr. Gauthier said that 148 spaces were required and 178 were shown on the proposed site plan. Commissioner Sprague asked if there is a pool or security gate? Mr. Gauthier said he didn't recall that being on the site plan but would have an answer by Thursday night. There were no other Commission comments. Item was continued until Thursday night. 5.9a&b) General Plan Amendment/Zone Chanqe 02-0962 (Mclntosh and Associates) (Ward 6) Applicant requested this project be withdrawn. 5.10a&b) General Plan Amendment/Zone Chanqe 02-0976 (Towery Homes) (Ward 4) Staff Report given recommending approval with conditions. Commissioner Gay asked if it is typical on subdivisions to put the improvements in proportionately? Ms. Shaw said yes that is correct. It is only required that the improvements of Old Farm, Noriega and Jewetta be put in in proportion to the amount of development that is going in the 80 acres. There were no other Commission comments. PUBLIC HEARINGS - TENTATIVE TRACT MAPS 6.1 Revised Tentative Tract Map 6104 (Mclntosh & Associates) (Ward 5) Minutes, PC, January 13, 2003 Page 5 Staff Report given recommending approval with conditions. Applicant is requesting to be put on the Consent Agenda for Thursday night. There were no Commission comments. Item was continued until Thursday night. 6.2 Vestinq Tentative Map 6146 (Quad Knopf) (Ward 4) Staff Report given recommending approval with conditions. Applicant is requesting to be put on the Consent Agenda for Thursday night. Commissioner Gay asked if full curb and gutter will be put in along Noriega and Jewtta when the subdivision is developed? Ms. Shaw said that they have requested that street improvements be constructed on both Noriega and Jewetta alongside the house. Commissioner Gay asked if the Commission has any rights to approve or disapprove when there is the one piece on that corner that will not match development? Mr. Grady said he would look into it for Thursday. Commissioner McGinnis had a concern that one of the streets will be named Potomac since Bakersfield already has a Potomac Street. Mr. Grady said that the street names will be looked at when the tract is recorded. There were no other Commission comments. Item was continued until Thursday night. 6.3 Vestinq Tentative Tract 6160 (Pinnacle Engineering) (Ward 3) Staff Report given recommending approval with conditions. Commissioner Sprague asked if it is still staff's recommendation that sidewalks are not necessary in this area because of the golf course? Ms. Shaw said the remainder of Rio Bravo has specific pedestrian easements throughout the golf course. This piece is outside the plan and does not have the pedestrian access that the remaining parcels do. That is why sidewalks are being required on one side. Commissioner Sprague asked if there is a crash gate on the south end for access out for fire? Dave Weirather, Fire Prevention, said there is a request for a crash gate on the north end. There were no other Commission comments. Item was continued until Thursday night. 6.4 Vestinq Tentative Map 6164 (Porter-Robertson) (Ward 4) Staff Report given recommending approval with conditions. Applicant has requested this item be put on the Consent Calendar. There were no Commission comments. Item was continued until Thursday night. 7. PUBLIC HEARING - Comprehensive Siqn Plan 02-1052 (Clarion Hotel) (Ward 4) Minutes, PC, January 13, 2003 Page 6 Staff Report given recommending approval. Applicant has requested this item be put on the Consent Calendar. There were no other Commission comments. Item was continued until Thursday night. COMMUNICATIONS: None COMMISSION COMMENTS: ~,ommissioner Sprague announced that he would be resigning as a Planning Commissioner 9ffective January 14, 2003 at 9 a.m. 10. DISCUSSION AND ACTION REGARDING POSSIBLE CANCELLATION OF THE NEXT PRE- MEETING: This will be discussed on Thursday night. 11.
