HomeMy WebLinkAboutRES NO 106-2024106 RESOLUTION NO. -2024 A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD AUTHORIZING THE PURCHASE OF TAX DEFAULTED REAL PROPERTIES FROM THE KERN COUNTY TREASURER -TAX COLLECTOR WHICH HAVE BEEN DESIGNATED AS TAX -DEFAULTED PROPERTIES IN AN AMOUNT NOT TO EXCEED $800,000. ;;-,Ref. 00DH - ava f-\ WHEREAS, on March 2, 2022, the City Council allocated Coronavirus State and Local Fiscal Recovery Funds (SLFRF) (31 CFR Part 35, also commonly known as American Rescue Plan Act, or ARPA) funding for the purchase of blighted properties for the purposes of the elimination of blight, including vacant and abandoned properties citywide; and WHEREAS, on March 2, 2022, the City Council allocated SLFRF funding for the purchase of vacant or blighted properties in the downtown area and other business districts within the City, and WHEREAS, on October 5, 2022, the City Council adopted Resolution No. 155- 2022, giving staff authorization to acquire properties designated as chronic nuisance properties within the city of Bakersfield; and WHEREAS, California Government Code Section 37350 authorizes a City to purchase, lease, receive, hold and enjoy real and personal property, and control and dispose of it for the common benefit; and WHEREAS, the City Charter authorizes the CITY to acquire and purchase property for any municipal purpose; and WHEREAS, the Kern County Treasurer -Tax Collector ("COUNTY") notified its Board of Supervisors of the intention to sell at public auction certain parcels of real property, which are subject to the power of sale pursuant to Revenue and Taxation Code Section §3691; and WHEREAS, the COUNTY has submitted to its Board and public agencies the list of properties for delinquent tax sale, attached hereto and incorporated by reference herein, which provides a description and minimum price of the tax - defaulted properties to be sold by the Treasurer -Tax Collector at public auction; and WHEREAS, the California Revenue and Taxation Code ("RT&C"), Chapter 8 of Part 6 of Division 1 (''Chapter 8") allows public agencies, taxing agencies and nonprofit organizations to enter into Chapter 8 agreements to purchase tax- - Page 1 of 3 Pages - r- m OORIGINALc defaulted properties; and WHEREAS, the City of Bakersfield ("CITY"), in compliance with the State of California law and its Housing Element, must provide affordable housing to meet the full spectrum of the housing needs of its population, and particularly to provide housing opportunities for low- and moderate -income residents of the City; and WHEREAS, the COUNTY has provided an agreement for the purchase of real properties that have annually defaulted in the payment of property taxes, penalties, and/or administrative fees attached hereto and incorporated by reference herein as Exhibit A; and WHEREAS, the CITY agrees to pay the sum of Seven Hundred Forty -One Thousand Nine Hundred Fifty -Three Dollars and Eighty -Five Cents ($741,953.85) plus all associated costs of the sale for the real property described in Exhibit A for a total amount not to exceed Eight Hundred Thousand Dollars ($800,000); and WHEREAS, the City Council authorizes the City Manager or designee to execute the COUNTY's agreement for the purchase of real properties that have been slated as tax -defaulted for purposes of affordable housing. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as follows: The above recitals are true and correct and incorporated herein by reference. 2.
